Those who are diagnosed with a mental illness, tend to be legally involved with the criminal justice system. In order to offer services and treatment to those in need, California voters passed the Mental Health Services Act (MHSA) in 2004. The goals of the act were to reduce the legal involvement of individuals using MHSA services and programs. This study is a policy analysis examining whether California's MHSA is decreasing arrest and incarceration rates for individuals utilizing its services. Secondary data were accessed through various government and county websites. Nine California counties were selected using purposive sampling. Data were analyzed to determine whether or not the county decreased the legal involvement for those who were utilizing its programs and services offered by the county. For the purpose of this study, legal involvement is defined as arrests and incarcerations. The data indicate that California's MHSA is decreasing arrest and incarceration rates for individuals who are enrolled in MHSA programs and services. A majority of the counties sampled demonstrated a decrease in legal involvement for its participants. The findings also show which counties succeed and which counties need more assistance in the legal involvement aspect of the MHSA. The data clearly show that each county implements their MHSA programs differently from one another, each having their own strength and weaknesses. Overall, California's MHSA is decreasing the legal involvement for individuals utilizing its services.

The Mental Health Services Act (MHSA) was designed to implement comprehensive policy initiatives, to address the need for an integrated public mental health service system within the state of California. Community mental health services have been found to be fragmented and under funded, leaving many individuals and families without access to needed care. This thesis includes a detailed historical review of mental health services on a national, and state level. This policy analysis, using Gil's (1992) social policy analysis framework, explores the evolution of the MHSA and its impact on the mental health treatment provided for citizens in the state of California. The prevalence of mental health issues within this society warrants current and comprehensive analysis of the policies that govern provision of services. Findings indicate that the MHSA serves to establish long-term funding, and ultimately transformation of the public mental health system in California. Social work implications will be discussed.

However, the study also found that the state has failed to provide proper guidance to counties for effective program evaluation.

Book excerpt: In 2004, California voters passed the Mental Health Services Act, which was intended to transform California's community mental health system from a crisis-driven system to one that included a focus on prevention and wellness. The vision was that prevention and early intervention (PEI) services comprised the first step in a continuum of services designed to identify early symptoms and prevent mental illness from becoming severe and disabling. Twenty percent of the act's funding was dedicated to PEI services. The act identified seven negative outcomes that PEI programs were intended to reduce: suicide, mental health-related incarcerations, school failure, unemployment, prolonged suffering, homelessness, and removal of children from the home. The Mental Health Services Oversight and Accountability Commission (MHSOAC) coordinated with the California Mental Health Services Authority (CalMHSA), an independent administrative and fiscal intergovernmental agency, to seek development of a statewide framework for evaluating and monitoring the short- and long-term impact of PEI funding on the population. CalMHSA selected the RAND Corporation to develop a framework for the statewide evaluation. This report describes the approach, the data sources, and the frameworks developed: an overall approach framework and outcome-specific frameworks.

The strengths and weaknesses of the Act were assessed and special attention was placed on transitional age youth (TAY) who are consumers of Full Service Parternship (FSP) services in Los Angeles County. This analysis found that there have been some improvements in the provision of services to TAY as a result of the MHSA (2004). However, TAY continue to be a group that remains underserved despite the availability of MHSA (2004) funds. The lack of infrastructure of Department of Mental Health to oversee MHSA (2004) funded projects is likely one of the main reasons why new programs for TAY have not been developed. This analysis did find that TAY, who have been served under MHSA (2004) funded programs, have lower rates of incarceration and hospitalization. The recommendations for social work practice, policy and research are discussed.
