Book excerpt: A forma como cada país define sua inserção internacional nas negociações globais em propriedade intelectual é fundamental para o seu desenvolvimento econômico, científico e tecnológico. Durante décadas de economia fechada, o Brasil deixou de aproveitar janelas de oportunidade para a construção de um parque industrial verdadeiramente competitivo que conferisse prioridade à inovação. Adotou-se nesse período uma postura diplomática predominantemente de resistência e baixo perfil no campo da propriedade intelectual, condizente com o ambiente protecionista vigente. A predominância de uma concepção de industrialização de inspiração nacional-desenvolvimentista entre os anos 30 e 70 não favoreceu, contudo, o fortalecimento da capacidade endógena de produção e de proteção do conhecimento e da tecnologia nacionais. A abertura econômica promovida a partir dos anos 90 e as mudanças importantes nas normas globais de comércio levaram à necessidade de transformações no padrão de inserção do Brasil no regime internacional de propriedade intelectual. Nos Governos FHC e Lula, o país passou gradualmente por modificações em sua via diplomática, abandonando uma posição tradicionalmente reativa e de resistência para uma de mais engajamento e proposição. Não obstante, mesmo na passagem do Governo FHC para o Governo Lula, diferenças importantes se observaram em relação ao modo como o Brasil formulou a sua política externa e planejou sua articulação com outras políticas públicas, particularmente a política industrial. Essas diferenças se concentraram em três variáveis fundamentais: as ideias, as instituições (como o Ministério da Indústria e o Instituto Nacional da Propriedade Industrial) e as lideranças, com desdobramentos relevantes para o Brasil nos rumos das negociações globais e das políticas públicas nacionais.

How will developing countries fare in this new international environment? Intellectual Property and Development brings together empirical research that assesses the effects of changing intellectual property regimes on various measures of economic and social performance - ranging from international trade, foreign investment and competition, to innovation and access to new technologies. The studies presented point to an important development dimension to the protection of intellectual property. But a one-size fits all approach to intellectual property is unlikely to work. There is need to adjust intellectual property norms to domestic needs, taking into account developing countries' capacity to innovate, technological needs, and institutional capabilities. In addition, governments need to consider a range of complementary policies to maximize the benefits and reduce the costs of reformed intellectual property regulations.
