Available in PDF, EPUB and Kindle. Book excerpt: Few legal events loom as large in early modern history as the trial of Galileo. Frequently cast as a heroic scientist martyred to religion or as a scapegoat of papal politics, Galileo undoubtedly stood at a watershed moment in the political maneuvering of a powerful church. But to fully understand how and why Galileo came to be condemned by the papal courts—and what role he played in his own downfall—it is necessary to examine the trial within the context of inquisitorial law. With this final installment in his magisterial trilogy on the seventeenth-century Roman Inquisition, Thomas F. Mayer has provided the first comprehensive study of the legal proceedings against Galileo. By the time of the trial, the Roman Inquisition had become an extensive corporatized body with direct authority over local courts and decades of documented jurisprudence. Drawing deeply from those legal archives as well as correspondence and other printed material, Mayer has traced the legal procedure from Galileo's first precept in 1616 to his formal trial in 1633. With an astonishing mastery of the legal underpinnings and bureaucratic workings of inquisitorial law, Mayer's work compares the course of legal events to other possible outcomes within due process, showing where the trial departed from standard procedure as well as what available recourse Galileo had to shift its direction. The Roman Inquisition: Trying Galileo presents a detailed and corrective reconstruction of the actions both in the courtroom and behind the scenes that led to one of history's most notorious verdicts.

Book excerpt: The waning influence of the Catholic church in the ethical and political debate For centuries the Catholic Church was able to impose her ethical rules in matters related to the intimate, that is, questions concerning life (from its beginning until its end) and the family, in the so-called Catholic countries in Western Europe. When the polity started to introduce legislation that was in opposition to the Catholic ethic, the ecclesiastical authorities and part of the population reacted. The media reported massive manifestations in France against same-sex marriages and in Spain against the de-penalization of abortion. In Italy the Episcopal conference entered the political field in opposition to the relaxation of several restrictive legal rules concerning medically assisted procreation and exhorted the voters to abstain from voting so that the referendum did not obtain the necessary quorum. In Portugal, to the contrary, the Church made a “pact” with the prime minister so that the law on same-sex marriages did not include the possibility of adoption. And in Belgium the Episcopal conference limited its actions to clearly expressing with religious, legal, and anthropological arguments its opposition to such laws, which all other Episcopal conferences did also. In this book, the authors analyse the full spectrum of the issue, including the emergence of such laws; the political discussions; the standpoints defended in the media by professionals, ethicists, and politicians; the votes in the parliaments; the political interventions of the Episcopal conferences; and the attitude of professionals. As a result the reader understands what was at stake and the differences in actions of the various Episcopal conferences. The authors also analyse the pro and con evaluations among the civil population of such actions by the Church. Finally, in a comparative synthesis, they discuss the public positions taken by Pope Francis to evaluate if a change in Church policy might be possible in the near future. Research by GERICR (Groupe européen de recherche interdisciplinaire sur le changement religieux), a European interdisciplinary research group studying religious changes coordinated by Alfonso Pérez-Agote.

Available in PDF, EPUB and Kindle. Book excerpt: In Sexuality in the Confessional: A Sacrament Profaned, Stephen Haliczer places the current debate on sex, celibacy, and the Catholic Church in a historical context by drawing upon a wealth of actual case studies and trial evidence to document how, from 1530 to 1819, sexual transgression attended the heightened significance of the Sacrament of Penance. Attempting to reassert its moral and social control over the faithful, the Counter-Reformation Church underscored the importance of communion and confession. Priests were asked to be both exemplars of celibacy and "doctors of souls," and the Spanish Inquisition was there to punish transgressors. Haliczer relates the stories of these priests as well as their penitents, using the evidence left by Inquisition trials to vividly depict sexual misconduct, during and after confession, and the punishments wayward priests were forced to undergo. In the process, he sheds new light on the Church of the period, the repressed lives of priests, and the lives of their congregations; coming to a conclusion as startling as it is timely. Based on an exhaustive investigation of Inquisition cases involving soliciting confessors as well as numerous confessors' manuals and other works, Sexuality in the Confessional makes a significant contribution to the history of sexuality, women's history, and the sociology of religion.
