Book excerpt: Excerpt from The Law of Artistic Copyright: A Handy Book for the Use of Artists, Publishers, and Photographers, With Explanatory Dialogues Tt is not the object of this little work to enter into a Lengthy discussion on the respective rights of the public and of the artist in a property which is exclusively the creation of the genius of the latter. The purpose is rather to try and explain the compromise between them by which they are at present bound, and which is known as Artistic Copyright. Artists are unanimous in thinking that in the making of this compromise they have been hardly treated by the Legislature. "Copyright," they complain, "should be ours until we part with it." The answer of the Copyright Commissioners is as follows:- "The evi-dence shows that persons buying pictures do not in general think about the Copyright, but that if the subject happens to be mentioned they are generally under the impression that the Copyright is included in the purchase,*and arc astonished if they are told that it is not. It is said that owing to this fact an artist, however eminent, when he is selling a picture, shrinks from mentioning the Copyright .and asking for an agreement to enable him to retain it; he usually prefers that the Copyright should be lost to both parties, as in the absence of any written agreement it would be, than that the purchaser should think that he is losing a valuable part of his bargain, and consequently should decline to complete the purchase. The principal reason why artists wish to retain the Copyright is to keep control over the engraver and photographer.
