Book excerpt: Excerpt from A General View of the Criminal Law of England The History is, however, too long and elaborate for general purposes, and in particular for the purpose of an introduction to the two Digests; and I have been informed that my first work, the General View of the Law of England, is still in request, as a first book on Criminal Law, amongst students at the Universities and elsewhere, although it has become so rare as to he in practice unobtainable. I have accordingly re-written it, giving an account of the subject, which contains in a very moderate compass the essence of what I have learnt during a long and greatly varied experience of thirty-six years as a barrister, a member of the Indian Council, an author, a draftsman, and a judge. Book excerpt: Excerpt from A History of the Criminal Law of England, Vol. 1 of 3 This work, which attempts to relate the history of the Criminal Law of England, has a history of its own. In 1863 I published what in one sense may be called the first edition of this work under the title of A General View of the Criminal Law. In 1869 I became Legal Member of the Council of the Viceroy in India, and held that office for about two years and a half, during which time my attention was strongly directed, from the legislative point of view, to the subject of Criminal Law, and particularly to its codification. Amongst other things, I drew and carried through the Legislative Council the Code of Criminal Procedure, Act X. of 1872, which, with some slight alterations and variations has just been reenacted and extended to the High Courts by Act X. of 1882. In 1873 or 1874 I was informed that a second edition of my General View was wanted. I began to prepare one, but I found myself hampered at every page by the absence of any authoritative statement of the law to which I might refer. It then occurred to me that as there was no such statement in existence I might write something which at all events would express my own views as to what the law was, to which I might refer in discussing its provisions historically and critically. Acting on this I wrote my Digest of the Criminal Law which was published in 1877, and cf which a third edition is just coming out. Book excerpt: Excerpt from Observations on the Criminal Law of England: As It Relates to Capital, and on the Mode in Which It Is Administered The following Observations contain the Substance of a Speech delivered in the House of Commons on the 9th Feb.1810 on moving for leave to bring in bills to repeal the Acts of 10 and 11 Will III.12 Ann, and 24 Geo, II., which make the crimes of stealing privately in a shop, goods of the value of five shillings; or in a dwell King-house, or on board a vessel in a navigable river, property of the value of forty shillings, capital felonies. Some arguments are added, which on that occasion were suppressed, that the patience of the House might not be put to too severe a trial. Book excerpt: Excerpt from Selection of Cases Illustrative of English Criminal Law The increased attention which, of recent years, has been bestowed, both in England and in the United States, upon the methods of legal education, has caused a fuller recognition of the great value which case-law possesses for even the elementary student. Only by means of concrete cases can he give vividness and reality to the abstract principles which he learns from his text-books, or even form a clear idea of the way in which questions, whether of law or of feet, are bandied in everyday practice by our courts of justice. But, valuable though this part of his legal training is, it is the part in which he most needs direction. Elementary students who read the Reports under their own guidance are prone to reverse the true order of things, by attending to the names of cases rather than to their facts, and to the facts rather than to the principles decided. Even when the principle itself is sought for, it is too often sought only by the compendious method of perusing nothing of the case beyond the head note; a plan of study which combines the disadvantages of reading case-law with those of reading text-books. And even a student whose greater assiduity has saved him from these errors is often led, by a natural inclination for reading recent cases in preference to older ones, to waste his time upon the study of decisions that are concerned only with some refined limitation of a fundamental doctrine, when he has not yet become acquainted with the cases in which that broad doctrine itself is established.
