Book excerpt: Improving Banking Supervision shows how greater market discipline can be used to help improve the quality of banks and their management in a world of increasing complexity, size and innovation. The book is based on research undertaken in the Nordic countries and New Zealand, and set in an international context through reference and comparison to the experiences of banks throughout the EU and the US. The authors show how traditional methods of regulation, particularly across borders face limits and can impose substantial costs on customers. They propose alternatives for today's international banks, based on a network of incentives to prudential behaviour and focusing on three main issues: - the development of transparent corporate structures - the public disclosure of comparable meaningful information so that markets can assess banks - the implementation of effective means to allow banks to exit without unacceptable costs to society

Book excerpt: Basel I, Basel II and Basel III Accord are important instruments to develop regulatory and supervisory principles and standards applicable for global community. Earlier, credit system was only the target of the authority but with the establishment of Basel Committee on Bank Supervision in Bank for International Settlement it has been developing and updating new and new standards, framework and guideline in regular interval of time. With the financial crisis of 2009-2011, it developed enhanced system of 'Basel II Accord' under 'Basel III Accord' which is in implementation process across the globe. In 2011, Basel Committee on Bank Supervision developed Core Principle of Bank Supervision which is implemented by the global community in their supervisory framework. Nepal also implements same principles for banking supervision. As the crisis occurred with economic depression and natural calamities like Corona Virus pandemic, it may need more resilient method for the banking operation because all the country of the world is badly affected by it. Still the loss of it cannot be determined. Economic activities are neutralized and banking activities are only limited in withdrawal of deposit. It can be worst situation than the past economic crisis of the history if it prolongs. It shows that it may establish new world economic order and new economic and banking principles and practices. In such case, time specific banking operation, regulation and supervision system with relief packages requires to develop. This paper aims to mention the role of Basel Accords in regulatory and supervisory practices of Nepali Central Bank. Additionally, as regulatory and supervisory perspective, Nepal follows onsite and offsite bank supervision method; under onsite approach, consolidated supervision, special supervision, targeted supervision and follow up supervision are used whereas under offsite supervision approach Cash Reserve Ratio (CRR), Statutory Liquidity Ratio (SLR), Deprived Sector Lending Ratio (DSLR), Capital Adequacy Ratio (CAR) and Credit to Core Capital and Deposit Ratio (CCD) are monitored. This approach is regularly changed and extended as per necessity of the market. Assurance of good governance, credit information system, credible banking transactions and fraudulent behavior control are the purpose of banks and financial institutions' regulation and supervision.

Book excerpt: The 21st century witnessed major changes in the financial environment surrounding bank regulators and banks. Banking and Monetary Policies in a Changing Financial Environment delves into three of these developments and challenges. The first change in the financial environment relates to the rise in the number and sophistication of financial and economic crimes which shaped the international regulatory architecture. New rules and regulations led to the creation of new strategies to combat these crimes, especially those concerning the spread of more advanced money laundering methods and techniques, terrorist financing after the 9/11 attacks, and the proliferation of weapons of mass destruction. The second development concerns the global financial crisis of 2008 which drastically affected the regulatory environment of various international and domestic financial authorities causing major changes in bank lending and corporate governance policies, and in the development of the Basel III accord on capital adequacy for bank supervision. The third development manifests itself in the creation of a major European monetary union without a fiscal union and a giant European central bank impacting the conduct of monetary policy. This book combines theory, policy, regulation and institutional approaches with empirical testing, analyzing applications and case studies of various international regulatory authorities and administrations, countries and jurisdictions, central banks and commercial banks. This volume is suitable for those who study international finance, Banking and white collar crime.

Available in PDF, EPUB and Kindle. Book excerpt: The turmoil in financial markets that resulted from the 2007 subprime mortgage crisis in the United States indicates the need to dramatically transform regulation and supervision of financial institutions. Would these institutions have been sounder if the 2004 Revised Framework on International Convergence of Capital Measurement and Capital Standards (Basel II accord)—negotiated between 1999 and 2004—had already been fully implemented? Basel II represents a dramatic change in capital regulation of large banks in the countries represented on the Basel Committee on Banking Supervision: Its internal ratings–based approaches to capital regulation will allow large banks to use their own credit risk models to set minimum capital requirements. The Basel Committee itself implicitly acknowledged in spring 2008 that the revised framework would not have been adequate to contain the risks exposed by the subprime crisis and needed strengthening. This crisis has highlighted two more basic questions about Basel II: One, is the method of capital regulation incorporated in the revised framework fundamentally misguided? Two, even if the basic Basel II approach has promise as a paradigm for domestic regulation, is the effort at extensive international harmonization of capital rules and supervisory practice useful and appropriate? This book provides the answers. It evaluates Basel II as a bank regulatory paradigm and as an international arrangement, considers some possible alternatives, and recommends significant changes in the arrangement.

Book excerpt: The quality of financial sector supervision has emerged as a key issue from the financial crisis. While most countries operated broadly under the same regulatory standards, differences emerged in supervisory approaches. The international response to this crisis has focused on the need for more and better regulations (e.g., in areas such as bank capital, liquidity and provisioning) and on developing a framework to address systemic risks, but there has been less discussion of how supervision itself could be strengthened. The IMF's work in assessing compliance with financial sector standards over the past decade in member countries suggests that while progress is being made in putting regulation in place, work remains to be done in many countries to strengthen supervision. How can this enhanced supervision be achieved? Based on an examination of lessons from the crisis and the findings of these assessments of countries' compliance with financial standards, the paper identifies the following key elements of good supervision-that it is intrusive, skeptical, proactive, comprehensive, adaptive, and conclusive. To achieve these elements, the "ability" to supervise, which requires appropriate resources, authority, organization and constructive working relationships with other agencies must be complemented by the "will" to act. Supervisors must be willing and empowered to take timely and effective action, to intrude on decision-making, to question common wisdom, and to take unpopular decisions. Developing this "will to act" is a more difficult task and requires that supervisors have a clear and unambiguous mandate, operational independence coupled with accountability, skilled staff, and a relationship with industry that avoids "regulatory capture." These essential elements of good supervision need to be given as much attention as the regulatory reforms that are being contemplated at both national and international levels. Indeed, only if supervision is strengthened can we hope to effectively deliver on the challenging-but crucial-regulatory reform agenda. For this to happen, society must stand with supervisors as they play their role as naysayers in times of exuberance.

Book excerpt: This Technical Assistance report on the Lao People’s Democratic Republic provides advice toward implementing risk-based supervision (RBS). Special attention needs to be given to expediting the formal approval of the RBS manual and fully implementing RBS methods in practice. Although this could be delayed due to other supervisory priorities, it is considered essential as the quality of supervision is improved by the practical application of RBS tools and learning-by-doing. The root causes of risks should be better identified, and greater attention should be paid to well-reasoned analysis of risks and the accompanied supervisory action. In addition, the mission advised additional modification of these documents to enhance its usefulness and quality. With respect to foreign-branch supervision, special consideration should be given to the extent of adequate oversight by the branch head office, supervision by the home supervisor, and overall financial condition of the foreign banking group. The mission provided examples of qualitative criteria for foreign-branch rating.
