Book excerpt: The 18th century was a wealth of knowledge, exploration and rapidly growing technology and expanding record-keeping made possible by advances in the printing press. In its determination to preserve the century of revolution, Gale initiated a revolution of its own: digitization of epic proportions to preserve these invaluable works in the largest archive of its kind. Now for the first time these high-quality digital copies of original 18th century manuscripts are available in print, making them highly accessible to libraries, undergraduate students, and independent scholars. This collection reveals the history of English common law and Empire law in a vastly changing world of British expansion. Dominating the legal field is the Commentaries of the Law of England by Sir William Blackstone, which first appeared in 1765. Reference works such as almanacs and catalogues continue to educate us by revealing the day-to-day workings of society. ++++ The below data was compiled from various identification fields in the bibliographic record of this title. Available in PDF, EPUB and Kindle. Book excerpt: What happened to the culture of common law and English barristers in the long eighteenth century? In this wide-ranging sequel to Gentlemen and Barristers: The Inns of Court and the English Bar, 1680-1730, David Lemmings not only anatomizes the barristers and their world; he also explores the popular reputation and self-image of the law and lawyers in the context of declining popular participation in litigation, increased parliamentary legislation, and the growth of theimperial state. He shows how the bar survived and prospered in a century of low recruitment and declining work, but failed to fulfil the expectations of an age of Enlightenment and Reform. By contrast with the important role played by the common law, and lawyers, in seventeenth-century England and in colonialAmerica, it appears that the culture and services of the barristers became marginalized as the courts concentrated on elite clients, and parliament became the primary point of contact between government and population. In his conclusion the author suggests that the failure of the bar and the judiciary to follow Blackstones mid-century recommendations for reforming legal culture and delivering the Englishmans birthrights significantly assisted the growth of parliamentary absolutism ingovernment.

Available in PDF, EPUB and Kindle. Book excerpt: Twelve Good Men and True brings together some of the most ambitious and innovative work yet undertaken on the history of an English legal institution. These eleven essays examine the composition of the criminal trial jury in England, the behavior of those who sat as jurors, and popular and official attitudes toward the institution of jury trial from its almost accidental emergence in the early thirteenth century until 1800. The essays have important implications for three problems central to the history of criminal justice administration in England: the way in which the medieval jury was informed and reached its verdict; the degree and form of independence enjoyed by juries during the early modern period when the powers of the bench were very great; and the role of the eighteenth-century trial jury, which, although clearly independent, was, by virtue of the status and experience of its members, arguably a mere extension of the bench. This extensive collection marks the first occasion on which scholars working in several different time periods have focused their attention on the history of a single legal institution. Written by J. M. Beattie, J. S. Cockburn, Thomas A. Green, Roger D. Groot, Douglas Hay, P.J.R. King, P. G. Lawson, Bernard William McLane, J. B. Post, Edward Powell, and Stephen K. Roberts, the essays utilize sophisticated techniques to establish from a variety of manuscript sources the wealth, status, and administrative experience of jurors. Originally published in 1988. The Princeton Legacy Library uses the latest print-on-demand technology to again make available previously out-of-print books from the distinguished backlist of Princeton University Press. These editions preserve the original texts of these important books while presenting them in durable paperback and hardcover editions. The goal of the Princeton Legacy Library is to vastly increase access to the rich scholarly heritage found in the thousands of books published by Princeton University Press since its founding in 1905.

Available in PDF, EPUB and Kindle. Book excerpt: Arguing that the female criminal subject was central to the rise of the British novel, Kirsten T. Saxton provides fresh and convincing insights into the deeply complex ways in which categories of criminality, gender, and fiction intersected in the long eighteenth century. She offers the figure of the murderess as evidence of the constitutive relationship between eighteenth-century legal and fictional texts, comparing non-fiction representations of homicidal women in biographies of Newgate Ordinaries and in trial reports with those in the early novels of Aphra Behn, Delariviere Manley, Daniel Defoe, and Henry Fielding. As Saxton demonstrates that legal narratives informed the budding genre of the novel and fictional texts shaped the development of legal narratives, her study of deadly plots becomes a feminist intervention in scholarship on the literature of crime that simultaneously insists on the centrality of crime literature in feminist histories of the novel. Her epilogue shows that more than two centuries later, we still contend with displays of female violence that defy and define our notions of textual and sexual license and continue to shape legal and literary mandates, even as the lines between the real and the fictive remain blurred.

Available in PDF, EPUB and Kindle. Book excerpt: The Useful Knowledge of William Hutton shows the rapid rise of a self-taught workman and the growing prominence of the city of Birmingham during the two major events of the eighteenth-century - the Industrial Revolution and the Enlightenment. Hutton achieved wealth, land, status, and literary fame, but later became a victim of violent riots. The book boldly claims that an understanding of the Industrial Revolution requires engagement with the figure of the 'rough diamond', a person of worth and character, but lacking in manners, education, and refinement. A cast of unpolished entrepreneurs is brought to life as they drive economic and social change, and improve their towns and themselves. The book also contends that the rise of Birmingham cannot be understood without accepting that its vibrant cultural life was a crucial factor that spurred economic growth. Readers are plunged into a hidden provincial world marked by literacy, bookshops, printing, authorship, and the spread of useful knowledge. We see that ordinary people read history and wrote poetry, whilst they grappled with the effects of industrial change. Newly discovered memoirs reveal social conflict and relationships in rare detail. They also address the problems of social mobility, income inequality, and breath-taking technological change that continue to perplex us today.
