Book excerpt: The increasingly transnational nature of terrorist activities compels the international community to strengthen the legal framework in which counter-terrorism activities should occur at every level, including that of intergovernmental organizations. This unique, timely, and carefully researched monograph examines one such important yet generally under-researched and poorly understood intergovernmental organization, the Organization of Islamic Cooperation ('OIC', formerly the Organization of the Islamic Conference). In particular, it analyses in depth its institutional counter-terrorism law-making practice, and the relationship between resultant OIC law and comparable UN norms in furtherance of UN Global Counter-Terrorism Stategy goals. Furthermore, it explores two common (mis)assumptions regarding the OIC, namely whether its internal institutional weaknesses mean that its law-making practice is inconsequential at the intergovernmental level; and whether its self-declared Islamic objectives and nature are irrelevant to its institutional practice or are instead reflected within OIC law. Where significant normative tensions are discerned between OIC law and UN law, the monograph explores not only whether these may be explicable, at least in part, by the OIC's Islamic nature, and objectives, but also whether their corresponding institutional legal orders are conflicting or cooperative in nature, and the resultant implications of these findings for international counter-terrorism law- and policy-making. It adopts an historical approach to examine the development of risk control measures used across the US, UK, New Zealand, Australia and Canada - particularly since the 1980’s - with the rise of the "security sanction". It also takes a criminological and sociological approach to analysing shifts in criminal law and punishment and its implications for contemporary society and criminal justice systems. Law, Insecurity and Risk Control analyses the range and scope of the ‘security sanction’ and its immobilizing measures, ranging from control over minor incivilities to the most serious crimes. Despite these innovations, though, it argues that our anxieties about risk have become so extensive that the "security sanction" is no longer sufficient to provide social stability and cohesion. As a consequence, people have been attracted to the ‘magic’ of populism in a revolt against mainstream politics and organisations of government, as with the EU referendum in the UK and the US presidential election of Donald Trump in 2016. While there have been political manoeuvrings to rein back risk and place new controls on it, these have only brought further disillusionment, insecurity and anxiety. This book argues that the "security sanction" is likely to become more deeply embedded in the criminal justice systems of these societies, as new risks to both the well-being of individuals and the nation state are identified.

Book excerpt: The Science and Technology Committee warns that the UK's prominence in astronomy and particle physics, and its ability to attract and inspire the next generation of scientists in these areas, could be at risk if reduced budgets hit the UK's growth prospects, reputation and expertise. Although science did relatively well in the recent Spending Review, funding for astronomy sees a total reduction of 21% over the next four years compared with 2010-11. More starkly, comparing 2014/15 with 2005, spending in astronomy and particle physics will be around 50% lower than its level six years ago. This is worrying, particularly when set against the planned increased investment in science and innovation by the UK's international peers as part of long-term strategies to ensure economic growth. The Science and Technology Facilities Council (STFC) - the research council which funds research and facility development in astronomy, particle physics and nuclear physics - is risking the UK's ability to stay at the forefront of future developments by focusing its astronomy and particle physics programmes into fewer areas. A case in point is the UK's planned withdrawal from all Northern Hemisphere optical and ground based astronomical facilities, which could see UK leadership and competitive advantage being handed over to international peers. The Committee is also highly critical of past STFC strategies, especially its failure to incorporate into policy documents details of the planned withdrawals. The report also addresses the future of the National Schools Observatory and outreach, which is essential to inspire the next generation of scientists.

Herein lies the role of subsequent practice as a key tool for treaty change. Subsequent practice-a well-established means of treaty interpretation-sometimes diverges from the original treaty provision to such an extent that it can no longer be said to constitute an act of interpretation or application. Rather, it becomes, in effect, one of treaty modification. The modification of treaties by subsequent practice extends to all fields of international law, from the law of the sea, environmental law, and investment law, to human rights and humanitarian law. Such modifications can have significant practical consequences, from revising or creating new rights and obligations, to establishing new institutional mechanisms. Determining when and how treaty modification by subsequent practice occurs poses difficulty to legal scholars and dispute settlement bodies alike, and impacts States' expectations as to their treaty obligations. This significant yet underexplored process is the focus of this book. Modification of Treaties by Subsequent Practice proves that subsequent practice can-under carefully defined conditions that ensure strict accordance with the will of the treaty parties-alter, supplement, and terminate treaty provisions or even entire treaty frameworks. It can also generate customary law and fuel regime interaction. Ultimately, this book demonstrates the relevance and dynamism of the process of treaty modification by subsequent practice, emphasizing the need to deal with the issue head on, and explains-on a theoretical and practical level-how it can be identified and dealt with more consistently in the future. Parental control over their children's education has gained impressive momentum in recent years at the state level. Meanwhile, states have been increasingly willing to relinquish sovereignty over education in exchange for more federal dollars. Failure would help bring clarity to these issues by examining whether students and the country better off after 30 years with the Department of Education and suggesting alternatives to an ever-expanding federal education bureaucracy. Part I would begin by examining the development of the current Department of Education, including the legislation that gave rise to it, and the pressure groups that have shaped it. Additional chapters would examine related issues including the arguments for and against the creation of a national education department, its origin, current structure, spending, and growth over time. Part II would examine the results to date against the education department's own standards. These include overall student achievement nationally before and after the advent of the Department of Education as well as international comparisons of U.S. student achievement. Outcomes of some of the largest Department of Education programs would also be considered in this section, along with some of the lesser-known department programs and initiatives. Part III would examine truly federal alternatives to the current tug-of-war between the national and state governments in light of the growing parental-choice movement. Included in this section would be chapters examining a strict-constitutionalist model, which denies any federal authority in education. Another alternative model examined would be the National Bureau of Education model, inspired by the original 1867 precursor to the current Department of Education, whose primary mission was to serve as a repository of information so schools nationwide could emulate best practices. In addition, this section would seek to include cross-country comparisons of education systems of top-performing Organization of Economic Cooperation and Development (OECD) countries.
