Although it is not always easy to determine whether a receipt is income in its ordinary sense, case law has, over the years, set down some basic rules. These may be summarised as follows: income is something which comes in; income imports the notion of periodicity, recurrence and regularity, and; whether a particular receipt is income depend upon its quality in the hands of the recipient. Linked to this is the proposition that income is something which is money or money's worth. In other words according to the Income Tax Act 2007, unless a benefit can be converted into money or money's worth, it is not something which has come in and, therefore, it is not taxable as income.
