Available in PDF, EPUB and Kindle. Book excerpt: The Operational Law Handbook is a "how to" guide for Judge Advocates practicing operational law. It provides references and describes tactics and techniques for the practice of operational law. It supports the doctrinal concepts and principles of FM 3-0 and FM 1-04 (formerly FM 27-100). The Operational Law Handbook is not a substitute for official references. Like operational law itself, the Handbook is a focused collection of diverse legal and practical information. The handbook is not intended to provide "the school solution" to a particular problem, but to help Judge Advocates recognize, analyze, and resolve the problems they will encounter in the operational context. Similarly, the Handbook is not intended to represent official U.S. policy regarding the binding application of varied sources of law, though the Handbook may reference source documents which themselves do so. The Handbook was designed and written for Judge Advocates practicing operational law. The size and contents of the Handbook are controlled by this focus. Frequently, the authors were forced to strike a balance between the temptation to include more information and the need to retain the Handbook in its current size and configuration. Simply put, the Handbook is made for the Soldiers, Marines, Airmen, Sailors, and Coast Guardsmen of the service Judge Advocate General's Corps, who serve alongside their clients in the operational context. Accordingly, the Operational Law Handbook is compatible with current joint and combined doctrine. Unless otherwise stated, masculine pronouns apply to both men and women. The proponent for this publication is the International and Operational Law Department, The Judge Advocate General's Legal Center and School (TJAGLCS). Send comments, suggestions, and work product from the field to TJAGLCS, International and Operational Law Department, Attention: Major Sean Condron, 600 Massie Road, Charlottesville, Virginia 22903-1781. The Operational Law Handbook is on the Internet at www.jagcnet.army.mil in both the Operational Law and CLAMO databases. The digital copies are particularly valuable research tools because they contain many hypertext links to the various treaties, statutes, DoD Directives/Instructions/Manuals, CJCS Instructions, Joint Publications, Army Regulations, and Field Manuals that are referenced in the text.

Available in PDF, EPUB and Kindle. Book excerpt: During the past eight years the Department of Defense has initiated a series of fundamental changes -in both culture and operational capability -in order to better protect the U.S. homeland from catastrophic events, natural and manmade. By necessity, these changes are closely linked to an evolving assessment of the 21st century threat environment. The legal implications associated with these changes are inevitably profound. Indeed, they go to the very definition of the military's proper role within domestic society -reigniting in the process a public policy debate that is as old as the Republic itself. For lawyers within the Department of Defense the professional challenge is immediate and rewarding -the stakes involve core questions of national security, public safety and the preservation of essential liberty. In my judgment, this new edition of the Domestic Operational Law Handbook is the seminal compilation of legal authorities (and related analysis) relevant to DOD's homeland defense and civil support missions. For most of our nation's history the United States was effectively buffered by two great oceans and secured by the war fighting capabilities of forward deployed combat forces. Moreover, a significant threat to our country's security generally required the collective resources and manpower of an adversarial nation state -or frequently, a coalition of hostile nation states. The CBRNE technology of the 21st Century has shattered that paradigm. The brutal attack of September 11, 2001, should not be seen as an isolated event, but rather, as a case study in modern conflict. While DOD must remain ever vigilant in guarding against the continuing threat from aggressive nation states, it's now clear that the asymmetric threat from terrorist organizations -or even isolated individuals -when strengthened by WMD destructive power, can pose a fundamental challenge to public safety and our vital institutions of government.

This fifth edition incorporates recent treaties such as the Kampala amendments of the Statute of the International Criminal Court, new case law from the International Court of Justice and other tribunals, and contemporary doctrinal debates. Several new supplementary sections are also included, which take into account recent conflicts around the world, and consideration is given to new resolutions of the Security Council. With many segments having been rewritten to reflect recent State practice, this book remains a wide-ranging and highly readable introduction to the legal issues surrounding war and self-defence.

Available in PDF, EPUB and Kindle. Book excerpt: Released March 2015 This Handbook is designed to assist Commanders with legal situations by helping them to recognize and avoid issues or take immediate actions necessary to preserve the situation when legal issues arise. It serves as a helpful reference guide for commanders in the field, providing general guidance and helping commanders to clarify issues and identify potential problem areas. This Handbook will assist you in taking proper immediate action when faced with a variety of legal issues that might arise during your command. The purpose of your actions should be to preserve the legal situation until you can consult with your servicing Judge Advocate. However, like most aspects of your command responsibilities, you can fail if you just wait for things to come to you. You need to be proactive in preventing problems before they occur. First you gotta find a good clean (legible) copy and make sure it's the latest version (not always easy). Some documents found on the web are missing some pages or the image quality is so poor, they are difficult to read. We look over each document carefully and replace poor quality images by going back to the original source document. We proof each document to make sure it's all there - including all changes. If you find a good copy, you could print it using a network printer you share with 100 other people (typically its either out of paper or toner). If it's just a 10-page document, no problem, but if it's 250-pages, you will need to punch 3 holes in all those pages and put it in a 3-ring binder. Takes at least an hour. It's much more cost-effective to just order the latest version from Amazon.com This book includes original commentary which is copyright material. Note that government documents are in the public domain. We print these large documents as a service so you don't have to. The books are compact, tightly-bound, large-size, with large text and glossy covers. 4th Watch Publishing Co. is a SDVOSB. www.usgovpub.com The Military Commander and the Law (2017) Uniform Code of Military Justice (UCMJ - 2018) DoD Manual for Courts-Martial (2018) DoD Military Judges' Benchbook (2017) DoD Law of War Manual (2016) DoD Operational Law Handbook (2017) DoD Domestic Operational Law Handbook (2015) DoD Rule of Law Handbook (2015) Defense Support of Civil Authorities (2016) DoD IG Manual (2018) DoD Dictionary of Military and Associated Terms (2018) DoD Personnel Security Program (2017) Federal Rules of Appellate Procedure (2017) Federal Rules of Rules of Criminal Procedure (2017) Federal Rules of Rules of Civil Procedure (2017) Federal Rules of Rules of Bankruptcy Procedure (2017) Benchbook for U.S. District Court Judges (2013) Principles of Federal Appropriations Law 4th Edition Immigration Court Practice Manual The Science of Military Strategy (PLA 2013) Translated from Chinese The Science of Campaigns (PLA 2006) Translated from Chinese Federal Acquisition Regulation (2018) Defense Federal Acquisition Regulation Supplement (2017) Army Federal Acquisition Regulation Supplement (2018) U.S. Courts Design Guide + Standard Level Features and Finishes Look for these titles on Amazon.com

Available in PDF, EPUB and Kindle. Book excerpt: This fully revised and updated second edition of The Oxford Handbook of Comparative Law provides a wide-ranging and diverse critical survey of comparative law at the beginning of the twenty-first century. It summarizes and evaluates a discipline that is time-honoured but not easily understood in all its dimensions. In the current era of globalization, this discipline is more relevant than ever, both on the academic and on the practical level. The Handbook is divided into three main sections. Section I surveys how comparative law has developed and where it stands today in various parts of the world. This includes not only traditional model jurisdictions, such as France, Germany, and the United States, but also other regions like Eastern Europe, East Asia, and Latin America. Section II then discusses the major approaches to comparative law - its methods, goals, and its relationship with other fields, such as legal history, economics, and linguistics. Finally, section III deals with the status of comparative studies in over a dozen subject matter areas, including the major categories of private, economic, public, and criminal law. The Handbook contains forty-eight chapters written by experts from around the world. The aim of each chapter is to provide an accessible, original, and critical account of the current state of comparative law in its respective area which will help to shape the agenda in the years to come. Each chapter also includes a short bibliography referencing the definitive works in the field.

Available in PDF, EPUB and Kindle. Book excerpt: Aerial bombardment remains important to military strategy, but the norms governing bombing and the harm it imposes on civilians have evolved. The past century has seen everything from deliberate attacks against rebellious villagers by Italian and British colonial forces in the Middle East to scrupulous efforts to avoid "collateral damage" in the counterinsurgency and antiterrorist wars of today. The American Way of Bombing brings together prominent military historians, practitioners, civilian and military legal experts, political scientists, philosophers, and anthropologists to explore the evolution of ethical and legal norms governing air warfare. Focusing primarily on the United States—as the world’s preeminent military power and the one most frequently engaged in air warfare, its practice has influenced normative change in this domain, and will continue to do so—the authors address such topics as firebombing of cities during World War II; the atomic attacks on Hiroshima and Nagasaki; the deployment of airpower in Iraq, Afghanistan, and Libya; and the use of unmanned drones for surveillance and attacks on suspected terrorists in Pakistan, Yemen, Sudan, Somalia, and elsewhere.
