Book excerpt: An upsurge in violence between Uyghur and Han in China’s far western region of Xinjiang has gained increased media and academic attention in recent years as was evidenced in the July 2009 riots. Numbering over eight million, the Uyghur are China’s fifth-largest minority nationality, and their mounting aspiration for obtaining more autonomy has contributed to the recent ethnic conflicts in the region. This book looks at those who are seeking to preserve the Uyghur identity, and support the secession of Xinjiang from China in order to create their own independent state by exploring the global operations and sister groups of the Uyghur diaspora umbrella organization, the World Uyghur Congress (WUC). It examines the networks of the WUC, the coalitions it has formed, the strategies the organization pursues to raise public awareness about Uyghur issues around the globe, and looks at the actors that have emerged as key players in the contemporary WUC network. Further, this book shows that the Uyghur lobby is not a unified movement, but that the local groups that it consists of are highly constrained by the broader domestic politics of their host countries, a fact which has a significant impact on the lobby’s ability to realize its strategic and political ambitions. In turn, Yu-Wen Chen gauges the impact of the WUC on public opinion and policymakers in the world’s democracies, and shows how since Uyghur organizations have been given legitimacy by liberal democracies and international governmental organizations, they can no longer be considered merely splintered members of a far-flung diaspora locked in a one-sided struggle with Beijing. Indeed, Uyghur activists can and do use their hard-won legitimacy as legal migrants and asylum seekers to influence politics in their host countries. This unique and timely study reveals how an issue concerning a Chinese minority has been catapulted onto the wider global political stage, and as such, it will be of great interest to students and scholars working on Chinese politics, the Uyghur issue, and minority and ethnic politics, social movements, human rights, and international politics more broadly.

The latter two regional instruments are examined in depth. This includes the first fulsome account of the African Refugee Conventions drafting, an interpretation of its unique refugee definition and original analysis of the relationships between the three treaties. Significant attention is devoted to the systemic relationship between the international and the regional refugee treaties and to the discrete relationships of conflict and complementary relationships between the two refugee instruments, as well as to the relationships between the African Refugee Convention and African Charter. Part Two focuses on the institutional architecture supporting the treaty framework. It not only addresses the controversial long-lasting “problem” (of nuclear, other toxic or CO2 waste) but investigates some ways to approach for “solutions” or solution spaces – not just technical but also institutional, societal and personal. It includes the tailored transfer of knowledge, concept and system understanding, experience and documentation to specific audiences above. It is an integrative tool of targeted yet adaptive management and may be applicable to other long-term sociotechnical fields.

Private international law (conflict of laws) and civil procedure rules concerning the application and ascertainment of foreign law differ significantly from jurisdiction to jurisdiction. Combining general and individual national reports, this volume demonstrates when and how foreign law is applied, ascertained, interpreted and reviewed by appeal courts. Traditionally, conflicts lawyers have been faced with two contrasting approaches. Civil law jurisdictions characterize foreign law as “law” and provide for the ex officio application and ascertainment of foreign law by judges. Common law jurisdictions consider foreign law as “fact” and require that parties plead and prove foreign law. A closer look at various reports, however, reveals more differentiated features with their own nuances among civil law jurisdictions, and the difference of the treatment of foreign law from other facts in common law jurisdictions. This challenges the appropriacy of the conventional “law-fact” dichotomy. This book further examines the need for facilitating access to foreign law. After carefully analyzing the benefits and drawbacks of existing instruments, this book explores alternative methods for enhancing access to foreign law and considers practical ways of obtaining information on foreign law. It remains to be seen whether and the extent to which legal systems around the world will integrate and converge in their treatment of foreign law.
