Book Synopsis The Institutional Topology of International Regime Complexes by : Benjamin Daßler
Download or read book The Institutional Topology of International Regime Complexes written by Benjamin Daßler and published by Oxford University Press. This book was released on 2023-10-05 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: The implicit topology of international institutional complexes varies greatly across policy areas. In some areas, the lion's share of everyday policy cooperation is shaped by a single institution with alternative and more regional institutions operating in its shadow. In other policy fields, institutional structures appear to be different, seeing a range of non-hierarchical, decentralized, alternative institutions. The Institutional Topology of International Regime Complexes: Mapping Inter-Institutional Structures in Global Governance provides a systematic conceptualization and explanation of the evolution of these varying institutional topologies underlying regime complexes across five issue areas of Global Governance: Intellectual Property Protection, Tax Avoidance, Financial Stability, Development Aid, and Energy Governance. By providing an empirically grounded, network-based conceptualization and mapping of institutional topologies, as well as a theoretical explanation for their variation across policy space and time, the book offers a comprehensive analysis of both the empirical manifestation of inter-institutional structures across various policy fields of Global Governance and the issue specific factors that shape the varying institutional trajectories spurring (de-) centralization. Daßler combines quantitative network analyses with qualitative case studies to trace institutional decentralization processes across five highly relevant issue areas of Global Governance. This volume shows how the nature of issue-specific cooperation problems translates into disparate structures among multilateral institutions occupying the same regime complex. In light of growing concerns about the future trajectories of Global Governance in times of heightened geopolitical tensions, Daßler offers a fresh perspective to comparatively capture the profoundly varying institutional landscapes across different issue areas and their associated challenges and benefits of multilateral cooperation. Transformations in Governance is a major academic book series from Oxford University Press. It is designed to accommodate the impressive growth of research in comparative politics, international relations, public policy, federalism, and environmental and urban studies concerned with the dispersion of authority from central states to supranational institutions, subnational governments, and public-private networks. It brings together work that advances our understanding of the organization, causes, and consequences of multilevel and complex governance. The series is selective, containing annually a small number of books of exceptionally high quality by leading and emerging scholars. The series is edited by Liesbet Hooghe and Gary Marks of the University of North Carolina, Chapel Hill, and Walter Mattli of the University of Oxford.

Book Synopsis The European Parliament and Global Health by : Vincent Rollet
Download or read book The European Parliament and Global Health written by Vincent Rollet and published by Taylor & Francis. This book was released on 2024-07-19 with total page 274 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book examines the actorness of the European Parliament (EP) and its roles in global health. In doing so, it appreciates to what extent this democratically elected entity can be considered as a global health actor. Applying an original analytical framework to measure actorness, the book assesses the EP’s capacity to act regarding five major global health issues including the pandemic response, access to essential medicines in developing countries, international trade and global health, medical research and development in the field of poverty-related and neglected diseases (PRNDs), and global health governance. It demonstrates that, despite many challenges, the EP has indeed displayed a polymorphic actorness and multiple roles towards most of these global health issues, especially by succeeding in mobilizing its main competences and instruments to deal with them, finalizing initiatives, and having a substantive influence on the way they were addressed. As such, the book reveals the salience of democratically elected institutions for global health governance. This book will be of key interest to students and scholars of European studies, global and regional health, legislative studies, and International Relations, but also to parliamentarians and (non-) governmental actors engaged in global health.
Book Synopsis Pluralism or Universalism in International Copyright Law by : Tatiana Eleni Synodinou
Download or read book Pluralism or Universalism in International Copyright Law written by Tatiana Eleni Synodinou and published by Kluwer Law International B.V.. This book was released on 2019-10-24 with total page 594 pages. Available in PDF, EPUB and Kindle. Book excerpt: In a world where powerful intermediaries like Google and Facebook are de facto regulators of the communication of copyright-protected works, the democratization of access to content has both substantially expanded the availability of new markets and dramatically increased copyright infringements. Does this mean that the long-sought ideal of a “universal” copyright regulation, which would harmoniously combine effective protection of intellectual creations with public interest goals, is a lost cause? Taken together, the contributions to this insightful and thoroughly researched book suggest that despite the prevailing labyrinthine mosaic of divergent national responses to fragmentation at international level, the foundations of a universal approach can be found in the interaction of regional, national and international copyright law instruments when responding to current and emerging technologies. Emphasizing the adaptation of copyright law to the needs of the information society, this volume provides critical approaches by leading copyright scholars on whether pluralism or universalism is the appropriate path to follow for the development of international copyright law. The authors deal with such issues and topics as the following: the application of core copyright law principles worldwide; authorship, rights and exceptions in the international copyright acquis; Internet copyright enforcement; global collective management of copyright; copyright contracts; database and design rights; intermediary liability; the global reach of the U.S. Fair Use doctrine; World Intellectual Property Organization’s role and strategy in international copyright lawmaking; and bilateral trade and investment agreements involving copyright. Specific evolutions and emerging trends in national and regional digital copyright laws are analyzed and assessed as they have developed in the European Union, the United States, Canada and Australia, as well as in several Asian and African countries. Throughout, attention is paid to compatibility with the Berne Convention, the perceived core of copyright law in the international copyright acquis, and the key question of the balancing of copyright law with fundamental rights from an international and comparative law perspective. As a comprehensive analysis of how core copyright law concepts and principles function in today’s fragmented copyright legal system, this book has no peers. Its detailed treatment of numerous specific instruments and regimes, as well as its insightful approaches to the future of international copyright lawmaking, will prove of immeasurable value to lawyers, judges, policy makers, academics and researchers working in the field of copyright law.
Download or read book Mediation written by Theophile Margellos and published by Kluwer Law International B.V.. This book was released on 2016-04-24 with total page 307 pages. Available in PDF, EPUB and Kindle. Book excerpt: Disputes about intellectual property (IP) rights are frequently multinational, with allegations of infringement and arguments about validity and ownership spanning numerous jurisdictions. As an alternative to expensive, risk-prone and time-consuming litigation, out-of-court settlements conducted through mediation are becoming more common, with the added advantage that they are not tied to the geographical scope of the IP rights at stake. This book is the first work of its type devoted to the practical A to Z of IP mediation. It is written in a reader-friendly style which makes it accessible to a wide readership. With numerous case study examples demonstrating the kind of challenges that arise and how they can be met, a team of internationally recognized mediators and IP experts offers in-depth discussion of how mediation mitigates difficulties in such IP areas as the following: • disputes on trademarks, designs, patents, copyrights and other IP rights; • allegations of breach of contract; • licences and transfers; and • R&D cooperation agreements. The authors provide analysis and recommendations about drafting settlement agreements, including standard clauses and enforcement, as well as an overview of the main mediation services which may be used to settle IP disputes. Showing how mediation offers a dispute resolution process at a human level where parties can not only discuss and resolve their differences but also create added value to the existing IP rights and the business surrounding them, the book will be warmly welcomed by lawyers, both in-house and outside counsels, IP professionals in general and rights holders and licensees. Review taken from ‘Ines Duhanic. The winner does not take it all: productivity and economic success through peace, harmony and mediation in intellectual property disputes. Journal of Intellectual Property Law & Practice (2019) 14 (9): 739-740' ‘...the work is a refreshing and bold undertaking...’ ‘The writing style of each chapter is to the point, clear and concise, the book is well-structured and user-friendly and the authors provide interesting examples from practice’ ‘... it is a valuable and original contribution amidst the rather fragmentary landscape of existing literature in the field of intellectual property.’

Book Synopsis The WIPO Internet Treaties at 25 by : R. V. Vaidyanatha Ayyar
Download or read book The WIPO Internet Treaties at 25 written by R. V. Vaidyanatha Ayyar and published by Springer Nature. This book was released on 2023-01-01 with total page 339 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book explores the WIPO journey so far and looks at how relevant the treaties are in contemporary world after 25 years of their existence. It revisits the WIPO Diplomatic Conference, narrates briefly how the Internet Treaties came into being, describes all the developments germane to the Internet Treaties over the last twenty-five years and examines at length how well these treaties withstood the creative gales of destruction having a bearing on the production, distribution and consumption of digital content. The retrospective consists of two parts. The first part looks back at the conference, its course of events, its negotiation dynamics, the doctrinal differences and sharply conflicting economic interests underlying the stands taken by the main parties to negotiations and the national and transnational interest groups that sought to influence the negotiation process and outcomes. The second part reflects on the outcomes and assesses with the wisdom of hindsight, how appropriate the outcomes were and how well they withstood the passage of time. This second aspect is the main focus of this book. The retrospective is limited to the digital agenda of DipCon; but for the digital agenda, the DipCon is convened so soon and the Internet Treaties concluded so fast. The book provides rich material for researchers studying the WIPO journey and also the practitioners by throwing light on discussions that led to a treaty that has in general withstood the trials of time.
