Eine nationale Gesetzgebung ist nicht umfassend geeignet, Jugendschutz in einem Medium zu gewährleisten und durchzusetzen, dessen Strukturen nicht ausschließlich national organisiert sind. Wenn die tatsächliche Herkunft von Internetinhalten nur schwerlich zu bestimmen und wenn, eindeutig internationaler Herkunft zuzuordnen ist, stößt eine wirkungsvolle Regulierung durch die nationale Gesetzgebung an ihre Grenzen. Wie kann jedoch Jugendschutz in einem Medium gewährleistet werden, wenn Gesetze nicht mehr die Spielregeln vorgeben, bzw. Verstöße gegen Inhalte des Internets wegen des grenzüberschreitenden Charakters nur unzulänglich kontrolliert, begrenzt und verfolgt werden können, weil sich der Täter außerhalb der Bundesrepublik Deutschland befindet? Wie können nationale Gesetze einerseits ihre Wirkung entfalten und angewendet, und andererseits die Abwehrrechte gegen den Staat, auf die jeder Bürger einen Anspruch hat, gewahrt werden? Ist mit dem Internet möglicherweise ein sozialer Raum entstanden, dessen juristische Regulierung durchgängig unmöglich geworden ist? Oder sind für diesen sozialen Raum nur andere als die bisherigen Konzepte zur Gefahrenabwehr erforderlich, um das Ziel “Jugendschutz“ trotzdem zu erreichen? Werden an die beteiligten Akteure neue Anforderungen gestellt werden (müssen)? Die zunehmende Nutzung des Internets führt zu großen Veränderungen in allen gesellschaftlichen Bereichen. Das löst Ängste und Unsicherheiten aus, die insbesondere beim Umgang mit Kindern und Jugendlichen in Erscheinung treten. Die Frage, die sich hieraus ergibt ist, ob das vom Internet ausgehende Gefährdungspotential für Kinder und Jugendliche realistisch oder nicht vielmehr überhöht eingeschätzt wird. Die vor der Verbreitung des Internets eingesetzten Verfahren zur Publikation von Informationen waren entweder auf einen sehr kleinen Teilnehmerkreis beschränkt oder benötigten die Kooperation mehrerer Individuen zur Produktion und Verbreitung der Inhalte.
