Book excerpt: In light of the controversy of the Philip Morris cases against Australia and Uruguay, this book systematically explores trade marks and brands as foreign direct investment, and in particular their substantive protection under international investment treaties. With the use of various hypothetical examples of devaluation of investments made in brands, the book explores the specifics of arbitrating investment claims arising out of state trade mark regulation. This work aims to establish useful tools in bridging the terminological and analytical gaps between experts in intellectual property law and international investment law.

Available in PDF, EPUB and Kindle. Book excerpt: The international community has made great progress in improving global health. But staggering health inequalities between rich and poor still remain, raising fundamental questions of social justice. In a book that systematically defines the burgeoning field of global health law, Lawrence Gostin drives home the need for effective global governance for health and offers a blueprint for reform, based on the principle that the opportunity to live a healthy life is a basic human right. Gostin shows how critical it is for institutions and international agreements to focus not only on illness but also on the essential conditions that enable people to stay healthy throughout their lifespan: nutrition, clean water, mosquito control, and tobacco reduction. Policies that shape agriculture, trade, and the environment have long-term impacts on health, and Gostin proposes major reforms of global health institutions and governments to ensure better coordination, more transparency, and accountability. He illustrates the power of global health law with case studies on AIDS, influenza, tobacco, and health worker migration. Today's pressing health needs worldwide are a problem not only for the medical profession but also for all concerned citizens. Designed with the beginning student, advanced researcher, and informed public in mind, Global Health Law will be a foundational resource for teaching, advocacy, and public discourse in global health.

Available in PDF, EPUB and Kindle. Book excerpt: The number of people now protected by tobacco control measures is growing at a remarkable pace. The progress made on adopting measures that reduce the demand for tobacco is a sign of the increasing impact of the WHO Framework Convention on Tobacco Control, which continues to be one of the most rapidly embraced, measurably successful treaties in United Nations history. This report, the third periodic country-level examination of the global tobacco epidemic, identifies the countries that have taken effective tobacco control measures that save lives. These countries can be held up as models of action for the many countries that need to do more to protect their people from the harms of tobacco use. Tobacco continues to kill nearly 6 million people each year, including more than 600,000 non-smokers who die from exposure to tobacco smoke. Up to half of the world s 1 billion smokers will eventually die of a tobacco-related disease. However, we have the power to change these circumstances. The focus of this report is on warning people about the harms of tobacco use. People have an inherent right to receive this information, and countries have an obligation to provide it. The two main types of warnings are examined: health warning labels on tobacco packages and national anti-tobacco mass media campaigns. Large and graphic warning labels and hard-hitting mass media campaigns have proven effective in reducing tobacco use and encouraging people to quit. This report presents for the first time detailed national-level data collected on a global basis for anti-tobacco mass media campaigns.

This book was released on 2024-05-28 with total page 178 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Ottawa Charter specifies that health promotion “has to be facilitated in schools, homes, workplaces and community settings” because “health is created and lived by people within the settings of their everyday life; where they learn, work, play and love”. COVID-19 had a profound impact on people’s lives and settings-based approaches have been developed in different shapes and formats. COVID-19 has also highlighted social vulnerabilities and laid bare how structural drivers of health inequity interact with class, race, ethnicity, gender, and education. Evidence is needed to document how these determinants can be addressed using settings-based approaches, and how new settings such as digital media, theories and frameworks can be used to tailor context appropriate strategies. Evidence is also needed to address challenges related to sustainability, resilience, and adaptation of complex systems in view of global health issues such as geopolitical instability, climate change and migration, as well as competencies needed to address them.
