Available in PDF, EPUB and Kindle. Book excerpt: Since the 1970s the federal government has been involved in the regulation of wetlands under Section 404 of the Clean Water Act. Like most federal environmental programs, authority for this regulation is premised upon an expansive reading of the Commerce Clause. In 1995, however, the Supreme Court suggested that Congress' Commerce Clause power is limited, raising questions about the constitutional limits of federal environmental regulation. This article analyzes the Commerce Clause doctrines explicit and implicit in United States v. Lopez and the extent to which this decision should limit federal wetlands regulation. The article continues to question whether judicially enforced limits on federal regulatory authority will compromise wetland conservation efforts. Based upon a review of the theoretical literature and empirical evidence, the article concludes that limiting the federal government's ability to regulate wetlands need not undermine conservation efforts, and there is substantial reason to believe that reimposing constitutional limits on federal regulatory authority may well improve environmental protection efforts.

Available in PDF, EPUB and Kindle. Book excerpt: It is unrealistic and unwise to believe that water law will or should govern land use decisions, or alternatively that land use planning and regulation will or should govern water management. Nonetheless, the initially unsettling question of whether one area of law and policy should control the other provokes discussion and reflection on both why and how we might move toward greater integration of land and water controls. Wet Growth: Should Water Law Control Land Use? was written as a means to disseminate new ideas about the land/water interface in law and policy and provides an overview of the relevant issues, current trends toward integrating land and water controls, and prospects for further progress. The authors of this book describe the nature and costs of our currently fragmented management of land and water resources that results in unsustainable practices and suggest principles that should guide and direct our response to these problems. Although they take differing perspectives, the authors share common, or at least overlapping, observations about the fragmentation and integration of land and water controls.

Book excerpt: Polls suggest up to twenty percent of Americans describe their beliefs as 'libertarian', but libertarians are often derided as heartless Social Darwinists or naïve idealists. This illuminating handbook brings together scholars from a range of fields (from law to philosophy to politics to economics) and political perspectives (right, left, and center) to consider how classical liberal principles can help us understand and potentially address a variety of pressing social problems including immigration, climate change, the growth of the prison population, and a host of others. Anyone interested in political theory or practical law and politics will find this book an essential resource for understanding this major strand of American politics.

Available in PDF, EPUB and Kindle. Book excerpt: An exploration of commercially available technologies that can enhance energy security and address climate change and public policy options crucial to their adoption. Tackling climate change and improving energy security are two of the twenty-first century's greatest challenges. In this book, Marilyn Brown and Benjamin Sovacool offer detailed assessments of the most advanced commercially available technologies for strengthening global energy security, mitigating the effects of climate change, and enhancing resilience through adaptation and geo-engineering. They also evaluate the barriers to the deployment of these technologies and critically review public policy options crucial to their adoption. Arguing that society has all the technologies necessary for the task, Brown and Sovacool discuss an array of options available today, including high-efficiency transportation, renewable energy, carbon sequestration, and demand-side management. They offer eight case studies from around the world that document successful approaches to reducing emissions of greenhouse gases and improving energy security. These include the Danish approach to energy policy and wind power, Brazil's ethanol program, China's improved cookstove program; and the U.S. Toxics Release Inventory. Brown and Sovacool argue that meeting the twin challenges of climate change and energy security will allow us to provide energy, maintain economic growth, and preserve the natural environment—without forcing tradeoffs among them.

Available in PDF, EPUB and Kindle. Book excerpt: Congress empowered the Environmental Protection Agency on the theory that only a national agency that is insulated from accountability to voters could produce the scientifically grounded pollution rules needed to save a careless public from its own filth. In this provocative book, David Schoenbrod explains how his experience as an environmental advocate brought him to this startling realization: letting EPA dictate to the nation is a mistake. Through a series of gripping and illuminating anecdotes from his own career, the author reveals the EPA to be an agency that, under Democrats and Republicans alike, delays good rules, imposes bad ones, and is so big, muscle-bound, and remote that it does unnecessary damage to our society. EPA stays in power, he says, because it enables elected legislators to evade responsibility by hiding behind appointed bureaucrats. The best environmental rules—those that have done the most good—have come when Congress had to take responsibility or from states and localities rather than the EPA. With the passion of an authentic environmentalist, Schoenbrod makes a sensible plea for “bottom-up” environmental protection now. The responsibility for pollution control belongs not in agencies but in legislatures, and usually not at the federal level but rather closer to home.
