Available in PDF, EPUB and Kindle. Book excerpt: Prize-winning author Martha Derthick draws on the recent experience of the Social Security Administration to examine the quality of policymaker's guidance and the feasibility of their policies. Derthick concludes that many structural features of American government hinder good administration, that policymakers lack concern for administration, and that they often miscalculate the administrative consequences of their policy choices. To illustrate this argument, Agency Under Stress analyzes two much-publicized cases of poor performance by one of the biggest and best established of U.S. government agencies, the Social Security Administration. The first case is that of the supplemental security income program to support needy blind, aged and disabled persons. Given responsibility of administering the program in 1974, the Social Security Administration was unequal to the task: many payments were made in error; many eligible persons were not paid; computer systems were not ready; field employees worked millions of hours of overtime; and other agency programs suffered. The second case is that of an eligibility review that Congress ordered the Social Security Administration to conduct for disability insurance recipients in the 1980s. The results were similarly traumatic: of over 1.2 million cases examined, 495,000 had benefits terminated, and, flooded with appeals, the courts ruled overwhelmingly against the agency. Derthick's analysis and conclusions have far-reaching implications for how the government can effectively serve its clients.

Book excerpt: Introduction to the Laws.....Series Volume 5 As issues in American law turn up with ever-greater frequency in dozens of countries worldwide, some familiarity with the legal system of the United States of America has become de rigueur for practising lawyers everywhere. This incomparable handbook, now in its Second Edition, provides an authoritative description of the major elements, including all matters likely to emerge in the course of normal legal activity. Written from a clear and cogent comparative perspective, it is of great practical value for both counselling and courtroom use. Eighteen lucid chapters by distinguished American law professors, each of whom is also knowledgeable about a legal system outside that of the United States, explain the major laws, legal standards, and legal institutions of the United States. Substantive and procedural comparisons are presented in plain English, with appropriate commentary where deemed helpful to clarify particularly complex or unsettled matters. The resulting volume is an expert historical, systematic, and critical introduction to the law of the United States.

Book excerpt: Keith Wailoo examines how pain and compassionate relief define a line between society's liberal trends and conservative tendencies. Tracing the development of pain theories in politics, medicine, and law, and legislative and social quarrels over the morality and economics of relief, Wailoo points to a tension at the heart of the conservative-liberal divide. Beginning with the advent of a pain relief economy after World War II in response to concerns about recovering soldiers, Wailoo explores the 1960s rise of an expansive liberal pain standard, along with the emerging conviction that subjective pain was real, disabling, and compensable. These concepts were attacked during the Reagan era of the 1980s, when a conservative political backlash led to decreasing disability aid and the growing role of the courts as arbiters in the politicized struggle to define pain. Wailoo identifies how new fronts in pain politics opened in the 1990s in states like Oregon and Michigan, where advocates for death with dignity insisted that end-of-life pain warranted full relief. In the 2006 arrest of conservative talk show host Rush Limbaugh, Wailoo finds a cautionary tale about deregulation, which spawned an unmanageable market in pain relief products as well as gaps between the overmedicated and the undertreated. Today's debates over who is in pain, who feels another's pain, and what relief is deserved form new chapters in the ongoing story of liberal relief and conservative care. People in chronic pain have always sought relief—and have always been judged—but who decides whether someone is truly in pain? The story of pain is more than political rhetoric; it is a story of ailing bodies, broken lives, illness, and disability that has vexed government agencies and politicians from World War II to the present.
