Book Synopsis The Unpublished Opinions of the Rehnquist Court by : the late Bernard Schwartz
Download or read book The Unpublished Opinions of the Rehnquist Court written by the late Bernard Schwartz and published by Oxford University Press. This book was released on 1996-01-04 with total page 501 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the last twenty years, the veil of secrecy surrounding the workings of the United States Supreme Court has been lifted. Justice Thurgood Marshall's controversial decision to make his papers available to the public ushered in a new era of openness about the operation of the Court--but not without criticism from Chief Justice William H. Rehnquist. The Unpublished Opinions of the Rehnquist Court provides a behind-the- scenes look at the Supreme Court, showing how changes between the drafts and the Justices' final opinions have created substantial differences in the outcome of the Court's decisions. As with his two previous works The Unpublished Opinions of the Warren Court and the Unpublished Opinions of the Burger Court, author Bernard Schwartz uses private court papers to follow these decisions and explore the key role and responsibility of the Chief Justice. Among the ten cases examined by Schwartz are key abortion cases Hodgson v. Minnesota and Webster v. Reproductive Health Services-- the original draft of which would have virtually overruled Roe v. Wade--as well as a civil rights case, Patterson v. McLean Credit Union. Schwartz considers the draft opinions and explains why the drafts were not issued as the final opinions and dissents in these cases. In particular, he shows what would have happened if the draft opinions had come down as the final opinions. The Unpublished Opinions of the Rehnquist Court serves to clarify and explore the actual operation of the judicial decision-making process. It will be fascinating and informative reading for attorneys, judges, law students, politicians and anyone interested in the mechanics of the nation's highest Court.

Download or read book Contemporary Cases in Women's Rights written by Leslie Friedman Goldstein and published by Univ of Wisconsin Press. This book was released on 1994 with total page 356 pages. Available in PDF, EPUB and Kindle. Book excerpt: American Socialists and Evolutionary Thought, 1870-1920 demonstrates how evolutionary theories fundamentally shaped, and ultimately undercut, the American socialist movement. Mark Pittenger examines the attempts of radicals in the late 19th and early 20th centuries to synthesise the evolutionary ideas of Charles Darwin and Herbert Spencer with socialist philosophy, social theory and political practice. In contrast to authors who have shown the influence of Darwinism on conservative and progressive political ideologies, Pittenger establishes that radicals also took scientific ideas seriously and wanted to link the public fascination with evolution to their own cause.

Book Synopsis The Limits of Legitimacy by : Michael Zilis
Download or read book The Limits of Legitimacy written by Michael Zilis and published by University of Michigan Press. This book was released on 2015-09-22 with total page 255 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the U.S. Supreme Court announces a decision, reporters simplify and dramatize the complex legal issues by highlighting dissenting opinions and thus emphasizing conflict among the justices themselves. This often sensationalistic coverage fosters public controversy over specific rulings despite polls which show that Americans strongly believe in the Court’s legitimacy as an institution. In The Limits of Legitimacy, Michael A. Zilis illuminates this link between case law and public opinion. Drawing on a diverse array of sources and methods, he employs case studies of eminent domain decisions, analysis of media reporting, an experiment to test how volunteers respond to media messages, and finally the natural experiment of the controversy over the Affordable Care Act, popularly known as Obamacare. Zilis finds that the media tends not to quote from majority opinions. However, the greater the division over a particular ruling among the justices themselves, the greater the likelihood that the media will criticize that ruling, characterize it as "activist," and employ inflammatory rhetoric. Hethen demonstrates that the media’s portrayal of a decision, as much as the substance of the decision itself, influences citizens’ reactions to and acceptance of it. This meticulously constructed study and its persuasively argued conclusion advance the understanding of the media, judicial politics, political institutions, and political behavior.

Available in PDF, EPUB and Kindle. Book excerpt: A thorough exploration of an individual's right to bodily autonomy versus the state's power to regulate and control the bodies of its citizens. The Human Body on Trial asks the basic question: Who's in charge of your body—you or the authorities? Four narrative chapters examine key constitutional questions addressed by the U.S. Supreme Court over the past century concerning the power of the state to regulate the human body, placing the issues in historical context and examining the contemporary legal and medical knowledge that informed each decision. The book focuses on individual cases, such as Jacobson v. Massachusetts (compulsory vaccination), Buck v. Bell (forced sterilization), and Roe v. Wade (abortion), and discusses such controversial issues as AIDS testing and physician-assisted suicide. A special reference section includes court decisions and other primary documents.
