Book excerpt: The research project CuveWaters developed and implemented adapted technologies and accompanying measures to support the national process towards an Integrated Water Resources Management (IWRM). The aim is to give people in the Cuvelai-Etosha Basin reliable access to clean water over the long term, thus enhancing their livelihood and health, and to create job opportunities. IWRM relies on solutions that use various sources, types and qualities of water for different purposes. CuveWaters implemented pilot plants for rain- and floodwater harvesting, groundwater desalination, as well as facilities for sanitation and water reuse. Technical components of the project were framed by societal and scientific components. Integrated Water Resources Management in Water-scarce Regions provides a comprehensive view on the complexity and interconnectedness of findings and conclusions regarding the principle strategic approach within the CuveWaters project’s concept. The book aims to present the work of technical, social and natural scientists but also of media professionals: It gives thematically focussed details on the three technology-based solutions which go beyond mere technical considerations and embed this into the overarching process towards IWRM in Namibia. Finally, it critically addresses lessons learnt and limits of projects in the context of research for implementation. Book excerpt: This book argues for the existence of a court enforceable human right to water that is implied from the right to life in Article 6 of the Namibian Constitution. The book builds this argument by using tools of constitutional interpretation and with the aid of comparative materials. As such, the African value of ubuntu is invoked. Ubuntu – which is legally developed through its four key principles of community, interdependence, dignity and solidarity – is anchored in a novel approach to Namibian constitutional interpretation that is conceptualised as ‘re-invigorative constitutionalism’. The book advances the ‘AQuA’ (adequacy – quality – accessibility) content of water and articulates the correlative duties within the context of the respect – protect – fulfil trilogy, which are duties imposed upon the Namibian state as the primary duty bearer for a right to water. These duties include irreducible essential content duties that are argued to be immediate when compared to general obligations. In giving substance to duties that flow from a right to water, international law interpretative resources are also relied upon, including General Comment No 15 by the United Nations Committee on Social, Economic and Cultural Rights, the African Commission’s Principles and Guidelines on Social and Economic Rights, and the World Health Organisation’s Drinking-water Quality Guidelines. Moreover, the book addresses various justiciability concerns that may arise, arguing that Namibian courts are institutionally competent and legitimate in enforcing right to water claims through the application of the bounded deliberation model. Additionally, because the Principles of State Policy in Article 95 of the Namibian Constitution are rendered court unenforceable by Article 101, the argument is made that this does not undermine the claim that a right to water, anchored in the right to life, can be enforced through the courts. - Dr Ndjodi Ndeunyema Modern Law Review Early Career Research Fellow, University of Oxford.

The first chapter paints the backdrop of the water scarcity problem, reviewing historical approaches from the 1992 Earth Summit in Rio de Janeiro to the Johannesburg World Summit on Sustainable Development (2002) to the United Nations Rio+20 Conference on Sustainable Development (2012), and recapping principles and agreements reached during and after these conferences. Chapter two examines the Southern Africa region’s efforts to combat water scarcity including principles, policies and strategies and the responsibility of each member to implement them. Written by the editor, J.P. Msangi, the chapter describes Namibia’s efforts to ensure management of scarce water. Beyond enacting management and pollution control regulations and raising public awareness, Namibia encourages research to ensure attainment of the requirements of both the SADC Protocol and its own water scarcity management laws. The next three chapters offer Namibia-based case studies on impacts of pollution on water treatment; on the effects of anthropogenic activities on water quality and on the effects of water transfers from dams upstream of Von Bach dam. The final chapter provides detailed summaries of the issues discussed in the book, highlighting conclusions and offering recommendations. Combating Water Scarcity in Southern Africa synthesizes issues pertinent to the SADC countries as well as to other regions, and offers research that up to now has not been conducted in Namibia.

Book excerpt: Prepared by the US Bureau of Mines with the purpose of providing the latest available data and information on mining and mineral resources in Namibia, this is a well-informed and useful reference work. The study covers regional geology, the history of exploitation, mining policies and legislation, production (including detailed tables on production and reserves 1970-1981) as well as water resources, energy supply, labour and transport. It argues that uranium has the greatest potential for long-term growth, and that elsewhere a pattern of diminishing ore reserves in the metals and to a lesser extent diamonds suggests a declining resource base. Shortages of water supplies, lack of artisans and skilled labour and "the unresolved international dispute"are identified as constraints to future growth in Namibia's mining industry. There is a chapter outlining the main features of mining legislation, and a lengthy, mainly technical bibliography listing close to 200 items. As a technical and economic surveyrelying heavily on information provided by the mining companies themselves, the study has considerable value. As a guide to the political economy of Namibia, it is, however, quite misleading. The UN Decree No. 1 of 1974 is not mentioned at all, while two decades of worker organization, liberation struggle and harsh colonial repression are dismissed in the assertion that "differences among worker languages and interests have inhibited the formation of a uniform political party or union". The study is notably weak on labour and social conditions, wages and labour legislation. For up-to-date information along the same lines, see Bureau of Mines Minerals Yearbook, vol. Book excerpt: Access to water and sanitation is indeed a human right; however quality water and sanitation service provision should not be assumed a 'free service' as a result. Hence it is crucial to understand the costs involved of monopoly water service provision to enable informed decision-making on tariff determination. Namibia, is not only characterised with extreme conditions of water scarcity and skewed income distribution, with a history of free water services, but it also is prone to information asymmetry and lack of transparency (especially financial) challenges in the price-setting process. Hence, the research aim was to adapt a framework for determining price-setting processes and to investigate the potential role of an economic regulator to inform the process and policy accordingly in Namibia. In this regard, the research explores the price-setting processes of independent economic regulators in England and Wales and Zambia (as a guide to understand the dynamics and intricacies of setting and enforcing prices for utilities based on the need for sustainable cost recovery and efficient service provision) to further investigate possible improvements to the Namibian price-setting process. The research objectives were explored through descriptive and exploratory case study approaches, mainly comprising of semi-structured interviews and focus group discussions. The research found that the most appropriate regulatory framework for Namibia is an intermediate framework- a hybrid regulatory body (consisting of a combination between government and independent expert panels). The research also identifies crucial operating principles, regulatory tools (with emphasis on accounting separation within financial models) and consumer involvement as major components for the Namibian price-setting process.
