Book excerpt: This paper presents an overview of the findings, recommendations and the rationale of the Wallis Inquiry compared to those of a major competitor, a conference on the future of the Australian Financial System run by the Economic Group of the Reserve Bank of Australia. The conclusion of this overview is that although the Wallis Inquiry presents the potential for radical change in the financial system vis a changing of the deliniation between the banking and non banking sectors, in relation to loosening protective measures aimed at confining bank shareholdings, in relation to removing restrictive measures confining equity links between banks and customers and industrial investors, and removing measures preventing the opening up of the financial sector to more competition and more concentration, the final outcome will probably be minimalistic. One, because the position and lobbying power of the banking sector, combined with the countervailing power of providers of insurance and superannuation, will ensure their particular interests are protected. Two, because the power of the Australian Competition and Consumer Commission (ACCC) has been changed in terms of vetoing mergers and acquisitions in the financial sector, possibly deflecting flack from the government for unpopular decisions. Three, because the Reserve Bank of Australia remains vehemently oposed to the hiving off of prudential supervision to a new Commonwealth agency, The Australian Prudential Regulation Commission (APRC) as well as the combining of prudential supervision of all financial institutions in the one body. Finally, whether the approach of the Wallis Inquiry is adopted or not depends on the passage of legislation through both houses of parliament, a political factor which could mean that the Wallis Inquiry is merely an academic exercise in scenario analysis.

Available in PDF, EPUB and Kindle. Book excerpt: The Great Post Office Scandal is the extraordinary story behind the recent ITV drama series Mr Bates vs The Post Office. This gripping page-turner recounts how thousands of subpostmasters were accused of theft and false accounting on the back of evidence from Horizon, the flawed computer system designed by Fujitsu, and how a group of them, led by Alan Bates, took their fight to the High Court. Their eventual victory in court vindicated their claims about the defects of the software and exposed the heavy handed attempts by the Post Office to suppress them. The book also chronicles how successive senior managers, business leaders, lawyers, civil servants and Government ministers, at best failed to expose the injustice or, even worse, sought to cover it up, resulting in one of the largest miscarriages of justice in UK history. The author, Nick Wallis, is a journalist and broadcaster who has been reporting on the scandal for over ten years and who acted as script consultant on Mr Bates vs The Post Office, the ITV drama that brought the affair into the national consciousness. As the public inquiry reaches its climax, and senior figures such as Paula Vennells come to be questioned, The Great Post Office Scandal reveals the full scale of what happened and will leave you enraged at how so many of our trusted institutions allowed the saga to go on for nearly a quarter of a century, shattering the lives of thousands of innocent people.

Book excerpt: The EU and the US responded to the global financial crisis by changing the rules for the functioning of financial services and markets and by establishing new oversight bodies. With the US Dodd–Frank Act and numerous EU regulations and directives now in place, this book provides a timely and thoughtful explanation of the key elements of the new regimes in both regions, of the political processes which shaped their content and of their practical impact. Insights from areas such as economics, political science and financial history elucidate the significance of the reforms. Australia's resilience during the financial crisis, which contrasted sharply with the severe problems that were experienced in the EU and the US, is also examined. The comparison between the performances of these major economies in a period of such extreme stress tells us much about the complex regulatory and economic ecosystems of which financial markets are a part.

Available in PDF, EPUB and Kindle. Book excerpt: Financial stability is one of the key tenets of a central bank’s functions. Since the financial crisis of 2007-2009, an area of hot debate is the extent to which the central bank should be involved with prudential regulation. This book examines the macro and micro-prudential regulatory frameworks and systems of the United Kingdom, Australia, the United States, Canada and Germany. Drawing on the regulator frameworks of these regions, this book examines the central banks’ roles of crisis management, resolution and prudential regulation. Alison Lui compares the institutional structure of the new ‘twin-peaks’ model in the UK to the Australian model, and the multi-regulatory US model and the single regulatory Canadian model. The book also discusses the extent the central bank in these countries, as well as the ECB, are involved with financial stability, and argues that the institutional architecture and geographical closeness of the Bank of England and Financial Policy Committee give rise to the fear that the UK central bank may become another single super-regulator, which may provide the Bank of England with too much power. As a multi-regional, comparative study on the importance and effectiveness of prudential regulation, this book will be of great use and interest to students and researchers in finance and bank law, economics and banking.
