Download or read book Courts and Trials written by Christopher Smith and published by Bloomsbury Publishing USA. This book was released on 2003-02-25 with total page 278 pages. Available in PDF, EPUB and Kindle. Book excerpt: A collective overview of contemporary developments affecting court organization and judicial procedures. America has a long history of sensationalized trials and infamous lawyers and judges, but what is the truth about how our system of jurisprudence really works? Courts and Trials: A Reference Handbook makes the subject accessible by presenting an overview of the organization of courts and procedures used in criminal and civil cases, with special emphasis on contemporary developments. The book analyzes specific issues: methods of selecting judges, the capacity of citizen-jurors to make appropriate decisions, cameras in the courtroom, "three strikes" laws, and the prosecution of juveniles as adults. The discussions illuminate competing perspectives on controversies that influence new initiatives and reforms affecting courts and their operations.

Book Synopsis Handbook of Justice Research in Law by : Joseph Sanders
Download or read book Handbook of Justice Research in Law written by Joseph Sanders and published by Springer Science & Business Media. This book was released on 2007-05-08 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: Justice—a word of great simplicity and almost frightening scope. When we were invited to edit a volume on justice in law, we joked about the small topic we had been assigned. Often humor masks fear, and this was certainly one of those times. Throughout the project, we found daunting the task of covering even a fraction of the topics that usually fall under the umbrella of justice research in law. Ultimately, the organization of the book emerged from the writing of it. Our introductory chapter provides a road map to how the topics weave together, but as is so often the case it was written last, not ?rst. It was only when we had chapters in hand that we began to see how the many strands of justice research might be woven together. Chapters 2–4 on the basic forms of justice—procedural, retributive, and distributive—are the lynchpin of the volume; they provide the building blocks that permit us to think and write about each of the other substantive and applied chapters in terms of how they relate to the fundamental forms of justice. In the large central section of the volume (Chapters 5–9), the contributors address many ways in which the justice dimensions relate to one another. Most important for law is the relationship of perceptions of procedural justice and the two types of substantive justice—retributive and distributive.

Book Synopsis Guide to Judicial Management of Cases in ADR by : Robert J. Niemic
Download or read book Guide to Judicial Management of Cases in ADR written by Robert J. Niemic and published by . This book was released on 2001 with total page 212 pages. Available in PDF, EPUB and Kindle. Book excerpt: This publication offers guidance to federal trial and bankruptcy courts on when and how to refer appropriate cases to ADR and how to manage cases referred to ADR. FJC research found that although much has been written about basic ADR concepts, little comprehensive, easily accessible advice on ADR referrals had been written from the court's perspective. The purpose of the book is not to advocate ADR use but rather to present various approaches that judges and parties may choose to follow when considering and using ADR. The book identifies areas where there may be disagreement, describing advantages and disadvantages of various approaches. The book also alerts readers to emerging trends or what are perceived by many as preferred approaches. The publication's ten chapters have titles including "Considering the Use of ADR: How and When"; "Selecting Cases Appropriate for ADR"; and "Matching the ADR Process to the Case." Other topics covered are neutral selection and compensation; party consent; client attendance; party participation; confidentiality; referral orders and case management issues.
