Book excerpt: The American West in the nineteenth century was a violent place. Fear of punishment exercised no restraining influence on the conduct of men who had turned crime into a profession. They hesitated at no atrocity necessary to accomplish their guilty designs. In the lands of Montana, Idaho, Oregon, Washington and Wyoming, murder and robbery often went hand in hand. The country, filled with canyons, gulches, and mountain passes, was especially adapted to conducting murder, and the unopulated distances between mining camps afforded ample opportunity for carrying them into execution. Pack trains and companies, stage coaches and express messengers, were as much exposed as the solitary traveller, and often selected as objects of attack. Miners, who had spent months of hard labor in the accumulation of a few hundred dollars, were never heard of again after they left the mines to return to their distant homes. There was no limit to this system of organized brigandage. When not murdering and stealing, these villains spent their ill-gotten gains through gambling, licentiousness and further terrorizing the local populations. But the people of these regions did not bow down to the bandits forever, instead they rose up against their oppressors and formed vigilance committees, took the "law unto themselves" and condemned the outlaws to death. What else could they do? How else were their own lives and property to be preserved? What other protection was there for a country entirely destitute of law? Nathaniel Pitt Langford's fascinating Vigilante Days and Ways uncovers the ways of life of early pioneers to the American West, how they survived in the face of lawlessness and eventually killed those who were persecuting them. By presenting the details of people lived during this time he allows the reader to come to their own conclusion as to whether the vigilantes were justified in their actions or not. "Vigilante Days And Ways brings to life dramatic scenes of Montana in the 1860s when it was attractive to most of its newest residents only for the gold that lay waiting to be scooped from its streams." Midwest Book Review Nathaniel Pitt Langford was an explorer, businessman, bureaucrat, vigilante and historian from Saint Paul, Minnesota who played an important role in the early years of the Montana gold fields, territorial government and the creation of Yellowstone National Park. Vigilante Days and Ways was first published in 1890 and Langford died in 1911.

Book excerpt: Excerpt from Vigilante Days and Ways: The Pioneers of the Rockies; The Makers and Making of Montana and Idaho Let those who would condemn these men try to realize how they would act under similar circumstances, and they will soon find everything to approve and nothing to con demn in the transactions of the early Vigilantes. I have endeavored to narrate nothing but facts, and these will enable every reader to judge correctly of the merits of each case. I would fain believe that this history, bloody as it is, will prove both interesting and instructive. In all that concerns crime of the blackest dye on the one hand, and love for law and order on the other, it stands without a parallel in the annals of any people. Nowhere else, nor at any former period since men became civilized, have murder and robbery and social Vice presented an organ ized front, and ofi'ered an open contest for supremacy to a large civilized community. Their works for centuries have been done by stealth, in darkness, and as far away from society as possible. I cannot now remember the instance, within the past three hundred years, when the history of any country records the fact that the crim inal element of an entire community, numbering thou sands, was believed to be greater than the peaceful element. Yet it was so here. And when the Vigilantes of Montana entered upon their work, they did not know how soon they might have to encounter a force numerically greater than' their own. Mr. A. J. It was, at best, a very precarious mode of conveyance; but as it was the only public one, it was always full. Book excerpt: Excerpt from Vigilante Days and Ways, Vol. 1 of 2: The Pioneers of the Rockies, the Makers and Making of Montana, Idaho, Oregon, Washington, and Wyoming It is stated, on good authority, that soon after the first appearance of Schiller's drama of "The Robbers" a number of young men, charmed with the character of Charles De Moor, formed a band and went to the forests of Bohemia to engage in brisrand life. I have no fear that such will be the influence of this volume. It deals in facts. Robber life as delineated by the vivid fancy of Schiller, and robber life as it existed in our mining regions, were as widely separated as fiction and truth. No one can read this record of events, and escape the conviction that an honest, laborious, and well-meaning life, whether successful or not, is preferable to all the temporary enjoyments of a life of recklessness and crime. The truth of the adage that "Crime carries with it its own punishment" has never received a more powerful vindication than at the tribunals erected by the people of the North-West mines for their own protection. Available in PDF, EPUB and Kindle. Book excerpt: A history and legal analysis of vigilantism in Montana in the 1860s, from a state Supreme Court justice and legal historian. Historians and novelists alike have described the vigilantism that took root in the gold-mining communities of Montana in the mid-1860s, but Mark C. Dillon is the first to examine the subject through the prism of American legal history, considering the state of criminal justice and law enforcement in the western territories and also trial procedures, gubernatorial politics, legislative enactments, and constitutional rights. Using newspaper articles, diaries, letters, biographies, invoices, and books that speak to the compelling history of Montana’s vigilantism in the 1860s, Dillon examines the conduct of the vigilantes in the context of the due process norms of the time. He implicates the influence of lawyers and judges who, like their non-lawyer counterparts, shaped history during the rush to earn fortunes in gold. Dillon’s perspective as a state Supreme Court justice and legal historian uniquely illuminates the intersection of territorial politics, constitutional issues, corrupt law enforcement, and the basic need of citizenry for social order. This readable and well-directed analysis of the social and legal context that contributed to the rise of Montana vigilante groups will be of interest to scholars and general readers interested in Western history, law, and criminal justice for years to come. “[Justice Dillon’s] book reads like a Western. Dillon masterfully sets the stage for the rise of the Montana vigilantes by bringing alive the people who created and lived in [mining] towns. There are heroes, villains, shady characters, and more than a few politicians, businessmen, lawyers and judges. What sets Dillon’s book apart from historical texts and fictional tales is that he provides legal analyses and explanations of the trials, sentences, due process and procedures of the day . . . And shed[s] grisly light on the details of the hangings. Dillon’s unique background as an attorney and judge and his downright dogged research are what makes this complex story so engaging. The prose is clear, crisp and gets to the point. . . . The book is satisfying because it answers contemporary nagging questions about the law regarding the vigilantes and the hangings.” —Gregory Zenon, Brooklyn Barrister “Dillon’s analysis of the vigilantes of Bannack, Alder Gulch, and Helena in Montana Territory is the most detailed, insightful, and legally nuanced yet produced. . . . This book is a model for historians to follow when dealing with 19th-century criminal proceedings. Establishing historical context includes examining the laws in books as well as the law in action.” —Gordon Morris Bakken, Great Plains Research
