Available in PDF, EPUB and Kindle. Book excerpt: The 1961 Vienna Convention on Diplomatic Relations has for over 50 years been central to diplomacy and applied to all forms of relations among sovereign States. Participation is almost universal. The rules giving special protection to ambassadors are the oldest established in international law and the Convention is respected almost everywhere. But understanding it as a living instrument requires knowledge of its background in customary international law, of the negotiating history which clarifies many of its terms and the subsequent practice of states and decisions of national courts which have resolved other ambiguities. Diplomatic Law provides this in-depth Commentary. The book is an essential guide to changing methods of modern diplomacy and shows how challenges to its regime of special protection for embassies and diplomats have been met and resolved. It is used by ministries of foreign affairs and cited by domestic courts world-wide. The book analyzes the reasons for the widespread observance of the Convention rules and why in the special case of communications - where there is flagrant violation of their special status - these reasons do not apply. It describes how abuse has been controlled and how the immunities in the Convention have survived onslaught by those claiming that they should give way to conflicting entitlements to access to justice and the desire to punish violators of human rights. It describes how the duty of diplomats not to interfere in the internal affairs of the host State is being narrowed in the face of the communal international responsibility to monitor and uphold human rights.

Book Synopsis Diplomatic Law in Belgium by : Frédéric Dopagne
Download or read book Diplomatic Law in Belgium written by Frédéric Dopagne and published by Maklu. This book was released on 2014-06-02 with total page 172 pages. Available in PDF, EPUB and Kindle. Book excerpt: Foreword by Mr. Didier Reynders, Deputy Prime Minister and Minister of Foreign Affairs, Foreign Trade and European Affairs. Belgium hosts numerous diplomatic missions. These are either accredited to the Kingdom of Belgium or to one of the international organisations headquartered in Belgium. Their operation, as well as the legal status and privileges and immunities of their members, are essentially regulated by the Vienna Convention on Diplomatic Relations, dated 18 April 1961. This handbook describes Belgium’s practice vis-à-vis these missions, and analyses the day-to-day implementation of the Vienna Convention by the various Belgian authorities. It systematically reviews the limited number of legislative or regulatory provisions, the Government’s practice – set out inter alia in several ‘circular notes’ communicated to the missions present in Belgium – and, additionally, identifies the jurisprudence of courts and tribunals and highlights the possible deviations from the practice of the executive branch. Designed as a guide intended primarily for diplomatic missions established in Belgium, this handbook is also relevant for civil servants, judges, lawyers and bailiffs encountering questions of diplomatic law in Belgium, as well as for students and researchers seeking information on national practice in this area of law.

Book excerpt: "The Vienna Convention on Diplomatic Relations (VCDR) was signed at the height of the Cold War more than fifty years ago. The agreement and its negotiation have become a cornerstone of diplomatic law. A Cornerstone of Modern Diplomacy, which is based on archival research in the National Archives (London), the Austrian State Archives (Vienna) and the Political Archive (Berlin), delivers the first study of the British policy during the negotiation of the key convention governing diplomatic privileges and immunities: the 1961 Vienna Convention on Diplomatic Relations. The book provides a complete commentary on the political aspects of the codification process of diplomatic law. By clearly presenting the case with accessible analysis, author Kai Bruns makes the relations between international law and politics understandable, stressing the impact of the emergence of the third world in UN diplomacy. This unique study is a crucial piece of scholarship, shedding light on the practice of United Nations conference diplomacy and the codification of diplomatic law at the height of the Cold War"--

Available in PDF, EPUB and Kindle. Book excerpt: This book is a commentary on the 1961 Vienna Convention on Diplomatic Relations, the universally-accepted framework for diplomacy between sovereign States. It is the second edition of a highly-respected work, first published in 1976, which was written with the benefit of the author's deep andpractical understanding of the subject as a Legal Counsellor in the Foreign and Commonwealth Office. Denzas book is widely-recognized as the leading work of authority in the field. In this enlarged, rewritten and fully-updated edition, she places each provision of the Convention in its historical context. The negotiating background to the provisions is supplemented with a comprehensivecommentary on the application of the Convention by the United Kingdom, and the United States of America, together with expanded coverage of the diplomatic practice and jurisprudence of other States. The book also includes a thorough examination of novel problems in the field, not least the abuse ofdiplomatic immunity, as exemplified in the mid-1980s by notorious cases such as the Libyan Peoples Bureau siege and the attempted kidnapping of Umaru Dikko, as well as terrorist violence and hostile demonstrations against embassies. This eagerly-awaited new edition provides an invaluable source of practical guidance for ministries of foreign affairs and diplomats in the field. It will be equally welcomed by practitioners and scholars of public international law as an indispensable source of reference and learning.

Available in PDF, EPUB and Kindle. Book excerpt: The Vienna Convention on Diplomatic Relations of 1961 (VCDR) is the cornerstone of the relationship between sovereign states. It outlines the principles of diplomatic law and codifies the rules for the exchange and treatment of diplomats as well as their staff. In the meantime about 190 states have ratified the Convention. The VCDR consists of 53 articles, defining, for instance, the diplomatic mission, the agreement, the declaration of a diplomat to be persona non grata, the privileges of diplomats in person, of their families and their premises, the freedom to gather information and to communicate etc. This Commentary covers the VCDR article-by-article, giving a historical overview, followed by a concise commentary of the relevant law and its implementation in the diplomatic and consular practice taking into consideration the wording of the Convention as well as its practical implementation on the basis of harsh political reality.
