Available in PDF, EPUB and Kindle. Book excerpt: Victims of crime are still marginalized in criminal law practice, even though an increasingly large number of legislatures have introduced reforms on their behalf. This collection of papers from some of the leading experts in the field sets out to provide a better understanding of the problems associated with restorative justice, with the aim of improving criminal law in the area. Questions asked include whether retribution may be plausibly reinterpreted as restoration by offenders on behalf of victims?; the relationship between criminal law and tort law; and issues relating to the rights of victims.

Book excerpt: Legal reform in the name of victims of crime began to appear in state and federal law in the 1960's. It can be seen in victim restitution and compensation laws, in the reform of rape laws, drunk driving statutes, bail laws, and in provisions for victim impact statements at sentencing, to name a few. Over time in many jurisdictions these specific victim provisions were joined by a more general, more comprehensive victims' bills of rights. Thus, by the close of the twentieth century, thirty-three states had added victims' rights amendments to their state constitutions and each of the states had general statutory declarations of victims' rights.

Download or read book Review of the Victims of Crime Assistance Act 1996: Report written by and published by . This book was released on 2018 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The genesis of this report was a reference to the Commission by the Victorian Attorney-General, the Hon. Martin Pakula MP, in December 2016 that asked the Commission to review the provision of state-funded financial assistance to victims of family violence under the Victims of Crime Assistance Act 1996 (Vic). The Commission was asked to consider specified matters raised by recommendation 106 of the Victorian Royal Commission into Family Violence. In July 2017, supplementary terms of reference were issued by the Attorney-General, expanding the reference to consider the effectiveness of the Victims of Crime Assistance Act 1996 (Vic) and the Victims of Crime Assistance Tribunal for all victims, including family violence victims. The supplementary terms of reference asked the Commission to consider whether 'there are other models that would more effectively deliver assistance, for example an administrative or quasi-administrative model'. The Commission has consulted widely, including with the general community, victims, stakeholders, academics, the legal profession and relevant courts and tribunals. The result of the Commission's consultations, research and consideration is this report.
Book Synopsis Migrant Rights at Work by : Laurie Berg
Download or read book Migrant Rights at Work written by Laurie Berg and published by Routledge. This book was released on 2015-06-26 with total page 342 pages. Available in PDF, EPUB and Kindle. Book excerpt: Public debates about the terms of membership and inclusion have intensified as developed economies increasingly rely on temporary migrant labour. While most agree that temporary migrant workers are entitled to the general protection of employment laws, temporary migrants have, by definition, restricted rights to residence, full social protections and often to occupational and geographic mobility. This book raises important ethical questions about the differential treatment of temporary and unauthorised migrant workers, and permanent residents, and where the line should be drawn between exploitation and legitimate employment. Taking the regulatory reforms of Australia as a key case study, Laurie Berg explores how the influence of immigration law extends beyond its functions in regulating admission to and exclusion from a country. Berg examines the ways in which immigration law and enforcement reconfigure the relationships between migrant workers and employers, producing uncertain and coercive working conditions. In presenting an analytical approach to issues of temporary labour migration, the book develops a unique theoretical framework, contending that the concept of precariousness is a more fruitful way than equality or vulnerability to evaluate and address issues of temporary migrant labour. The book will be of great interest to scholars and practitioners of immigration law and employment law and policy.
