Available in PDF, EPUB and Kindle. Book excerpt: In the last two decades there has been positive change in how the Canadian legal system defines Aboriginal and treaty rights. Yet even after the recognition of those rights in the Constitution Act of 1982, the legacy of British values and institutions as well as colonial doctrine still shape how the legal system identifies and interprets Aboriginal and treaty rights. The eight essays in Aboriginal and Treaty Rights in Canada focus on redressing this bias. All of them apply contemporary knowledge of historical events as well as current legal and cultural theory in an attempt to level the playing field. The book highlights rich historical information that previous scholars may have overlooked. Of particular note are data relevant to better understanding the political and legal relations established by treaty and the Royal Proclamation of 1763. Other essays include discussion of such legal matters as the definition of Aboriginal rights and the privileging of written over oral testimony in litigation.

Available in PDF, EPUB and Kindle. Book excerpt: Section 35 of the Constitution Act expressly acknowledges, for thefirst time, that there are "aboriginal people" and"aboriginal rights." What, then, are the implications forCanada of the inclusion of this section in our constitution? Central tothis question is the definition of aboriginal rights and whether theyinclude such "special" political rights asself-determination. Home and Native Land is divided into twomajor sections. The first focuses on definitions and provides adetailed account of the meaning of the phrase "aboriginalrights" as used by the two main actors: the government and theaboriginal peoples. The second is devoted to the question of politicalrights and the means by which this issue can be resolved.

Available in PDF, EPUB and Kindle. Book excerpt: Nearly 40 years after the concept of finite deterrence was popularized by the Johnson administration, nuclear Mutual Assured Destruction (MAD) thinking appears to be in decline. The United States has rejected the notion that threatening population centers with nuclear attacks is a legitimate way to assure deterrence. Most recently, it withdrew from the Anti-Ballistic Missile Treaty, an agreement based on MAD. American opposition to MAD also is reflected in the Bush administration's desire to develop smaller, more accurate nuclear weapons that would reduce the number of innocent civilians killed in a nuclear strike. Still, MAD is influential in a number of ways. First, other countries, like China, have not abandoned the idea that holding their adversaries' cities at risk is necessary to assure their own strategic security. Nor have U.S. and allied security officials and experts fully abandoned the idea. At a minimum, acquiring nuclear weapons is still viewed as being sensible to face off a hostile neighbor that might strike one's own cities. Thus, our diplomats have been warning China that Japan would be under tremendous pressure to go nuclear if North Korea persisted in acquiring a few crude weapons of its own. Similarly, Israeli officials have long argued, without criticism, that they would not be second in acquiring nuclear weapons in the Middle East. Indeed, given that Israelis surrounded by enemies that would not hesitate to destroy its population if they could, Washington finds Israel's retention of a significant nuclear capability totally "understandable."

Book excerpt: Operation Iraqi Freedom (OIF), the U.S.-led coalition military operation in Iraq, was launched on March 20, 2003, with the goal of removing Saddam Hussein¿s regime and destroying its ability to use weapons of mass destruction. The focus of OIF has shifted from regime removal to helping the Gov¿t. of Iraq improve security, establish a system of governance, and foster economic development. This report addresses these policy issues: Identifying how U.S. national interests and strategic objectives, in Iraq and the region, should guide further U.S. engagement; Monitoring and evaluating the impact of the changes in the U.S. presence and role in Iraq; and Laying the groundwork for a traditional bilateral relationship.
