Book excerpt: The era of liberal interventionism is over, and the prevailing international discourse is once again about defending state borders and putting up walls. This broad re-assertion of sovereignty and non-intervention—-often considered the normative foundation of the BRICS countries, of the Non-Aligned Movement, of Bandung, of the “Westphalian” South—-raises a series of difficult questions, not least about the management of challenges shared by all. How are we to make sense of re-organisations of intervention and non-intervention in global order? Recently the dominant way of approaching these issues has been through the lens of cosmopolitan or liberal-solidarist duties, including the Responsibility to Protect. Yet it seems doubtful that this framework is still capable of posing the right questions or generating the right sorts of answers. This volume offers a new approach that provincializes the conventional debate, de-naturalises what it takes as universal or given, and lays out a series of alternatives at a time when non-intervention, quite suddenly, seems everywhere in the discourse of international society. It does so through a genealogy of the intervention concept since 1945. Intervention before Interventionism is about the ways in which statespeople have re-ordered intervention and non-intervention since the middle of the twentieth century; it is concerned primarily with non-Western contestations of Western-dominated order; it illustrates institutional change in and through decolonization; and it provides a conceptual roadmap for understanding dilemmas of intervention and non-intervention today, particularly in relation to contestation as it has re-emerged in the twenty-first century. While building upon and conversing with existing literature, the book stands out from previous approaches insofar as it is a mapping of international struggles for the re-constitution of intervention in the globalization of the society of states.

Book excerpt: Without the Canadian mediation between the two world blocs in 1947, UN resolution 181(II) to partition Palestine would likely have failed to secure the two thirds majority necessary for adoption by the General Assembly. In fact, the Canadians were among the main initiators of the partition plan and the establishment of a Jewish state. Tauber demonstrates that this Canadian involvement was not an official government policy, but rather a private initiative of some high-ranking Canadian foreign service officials who believed partition to be the only practicable solution for the Palestine question. Thus, due to humanitarian concerns, these officials followed an independent policy against the express will of their prime minister. The results would forever change the history of the Middle East. Tauber explores this little known aspect of Canadian foreign policy. Canada's under secretary of state for external affairs, Lester Pearson, assisted by other foreign service officials, decided on his own accord which policy to follow in this instance. Based upon many original Canadian, British, American, UN, and Israeli documents, this study shows that Pearson's motivation was not the desire to make Canada a middle power involved in international affairs, as some scholars of Canadian international affairs have previously argued. Instead, the impact of the Holocaust drove these officials to break ranks with their superiors at home to support the establishment of a Jewish state in Palestine.

By recovering the contributions of those Asian, African, and Arab voices that joined the global rights debate, Burke demonstrates the central importance of Third World influence across the most pivotal battles in the United Nations, from those that secured the principle of universality, to the passage of the first binding human rights treaties, to the flawed but radical step of studying individual pleas for help. The very presence of so many independent voices from outside the West, and the often defensive nature of Western interventions, complicates the common presumption that the postwar human rights project was driven by Europe and the United States. Drawing on UN transcripts, archives, and the personal papers of key historical actors, this book challenges the notion that the international rights order was imposed on an unwilling and marginalized Third World. Far from being excluded, Asian, African, and Middle Eastern diplomats were powerful agents in both advancing and later obstructing the promotion of human rights.

The phenomenon is not temporary but is expected to carry on during the 21st century and beyond. A distinctive feature of modern international law is the concept of maritime zones. Each maritime area is subject to an intricate scheme of States’ rights and obligations. Coastal geography is a fundamental component of a long-standing method, developed and agreed upon between States, to establish the outward limits of these areas. A feature of this method is the baseline. In international law it is the only reference line from where the outward limits of maritime zones are measured. There are clear rules on how this is established along a coast. There is a concern amongst a number of States that rising sea water levels as a result of climate change may compel them to shift their baselines inward thus affecting the outward limits of their maritime zones. It is clear that the stability of maritime boundaries is put into question and this may bring about serious political, legal and economic repercussions. This concern may also affect the outcome of dispute settlement procedures before a competent international court or tribunal the purpose of which is to resolve overlapping maritime claims. Key questions emerge. What is the role played by coastal geography in the legal regime determining the outward limits of maritime zones? What are the consequences of changes to coastal geography? To what extent are dispute settlement procedures before a Court or Tribunal immune from this concern? Is international law able to address this? If so, in what way and what are its limits? What can be done to resolve this?

Contrary to the wide-spread perception that 'spirituality' is primarily related to palliative care and has emerged relatively recently within the organisation, this study shows that its history is considerably longer and more complex, and has been closely connected to the WHO's ethical aspirations, its quest for more holistic and equitable healthcare, and its struggle with the colonial legacy of international health organisations. While such ideals and struggles silently motivated many of the key actors and policies - such as the provision of universal primary healthcare - which for decades have embodied the organisation's loftiest aspirations, the WHO's official relationship with 'spirituality' advanced in fits, leaps, and setbacks. At times creative and interdisciplinary, at others deeply political, this process was marked by cycles of institutional forgetting and remembering. Rather than as a triumph of religious lobbyists, this book argues, the 'spiritual dimension' of health may be better understood as a 'ghost' that has haunted - and continues to haunt - the WHO as it comes to terms with its mandate of advancing health as a state of 'complete well-being' available to all.
