Between 1866 and 1937, a coherent outlook shaped the way the American bar understood the sources of law, the role of the courts, and the relationship between law and the larger society. William M. Wiecek explores this outlook--often called "legal orthodoxy" or "classical legal thought"--which assumed that law was apolitical, determinate, objective, and neutral. American classical legal thought was forged in the heat of the social crises that punctuated the late nineteenth century. Fearing labor unions, immigrants, and working people generally, American elites, including those on the bench and bar, sought ways to repress disorder and prevent political majorities from using democratic processes to redistribute wealth and power. Classical legal thought provided a rationale that assured the legitimacy of the extant distribution of society's resources. It enabled the legal suppression of unions and the subordination of workers to management's authority. As the twentieth-century U.S. economy grew in complexity, the antiregulatory, individualistic bias of classical legal thought became more and more distanced from reality. Brittle and dogmatic, legal ideology lost legitimacy in the eyes of both laypeople and ever-larger segments of the bar. It was at last abandoned in the "constitutional revolution of 1937", but--as Wiecek argues in this detailed analysis--nothing has arisen since to replace it as an explanation of what law is and why courts have such broad power in a democratic society.

Many felt, on the one hand, a keen sense of loss as the GDR dissolved and an expanded Federal Republic summarily absorbed former Eastern Germany. They mourned the ideals of democratic socialism, tolerance, and internationalism that the GDR had held dear, as well as the country’s rich cultural life. On the other hand, however, they recognized that the GDR was a fundamentally corrupt surveillance state whose industry weighed heavily on the environment while failing to buoy the country’s economy. By looking at works by some of the most important authors from either side of the border, this study shows that those who unequivocally embraced the reunification were clearly in the minority.

Book excerpt: This study looks at the rich literature that has been spawned through the historical imagination of Bengali-speaking writers in West Bengal and Bangladesh through issues of homelessness, migration and exile to see how the Partition of Bengal in 1947 has thrown a long shadow over memories and cultural practices. Through a rich trove of literary and other materials, the book lays bare how the Partition has been remembered or how it has been forgotten. For the first time, hitherto untranslated archival materials and texts in Bangla have been put together to assess the impact of 1947 on the cultural memory of Bangla-speaking peoples and communities. This study contends that there is not one but many smaller partitions that women and men suffered, each with its own textures of pain, guilt and affirmation.

Dispatches have arrived from anthropology, communications, English, film studies (including theory, history, criticism), literary studies (including theory, history, criticism), media and screen studies, cognitive cultural studies, narratology, philosophy, poetics, politics, and political theory; and as a special aspect of the volume, theorist-filmmakers make their thoughts known as well.
