Book excerpt: " VA compensates veterans for disabling conditions incurred in or aggravated by military service. Veterans can appeal VBA's decisions on their compensation claims, first to VBA and then to the Board, a separate agency within VA. In fiscal year 2015, more than 427,000 appeals were pending and veterans waited over 3 years on average for decisions. Of this total, about 81,000 were pending at the Board and the average cumulative time veterans waited for a decision by the Board in 2015 was almost 5 years. This report examines VA's approaches to address challenges it identified as contributing to lengthy appeals processing times, and the extent to which those approaches are consistent with sound planning practices. GAO focused mainly on the Board, which experienced an increase in workload of about 20 percent from fiscal year 2014 to 2015. GAO reviewed VA's proposed plans and actions and compared them to sound practices relevant to workforce planning and implementing process redesign and new information technology identified in federal guidance, such as internal control standards, and prior GAO work. GAO also analyzed VA's data for fiscal years 2011-2015 (the most recent available) on appeals decision timeliness and workloads

VA needs this information to certify, as specified under the Act, that it has sufficient resources to implement appeals reform and make timely appeals decisions under the new and legacy processes. VA's appeals plan reflects certain sound planning practices, but it could benefit from including important details in several key planning areas.

Book excerpt: In response to a congressional request, GAO evaluated the Department of Veterans Affairs' (VA) appeals process for disability compensation and pension decisions, to determine whether VA could improve the timeliness of its appeals process without detriment to quality. GAO found that VA did not: (1) effectively manage appeals, since it lacked adequate data to identify systemic problems; (2) accurately report on the time the appeals process took, and lacked adequate time standards; (3) ensure timely resolution of processing and reporting problems, which often involved multiple organizational units; (4) provide adequate guidance and oversight for regional offices; or (5) ensure that regional offices were complying with procedures. GAO also found that: (1) despite the appeals process being the same for all regions, the average time varied widely among VA regional offices; (2) delays in regional offices were due to slow case statement processing, and delays in requesting or using appeals medical information and forwarding appeals to the Board of Veterans Appeals (BVA); and (3) VA developed an automated Veterans Appeals Records Management System to provide BVA with appeals data for reporting and control purposes, but the system had never provided accurate data. In addition, GAO found that: (1) the reported average processing time did not accurately reflect the time VA took to provide final decisions on appeals, because it did not account for regional office time spent on remanded decisions, and VA double-counted cases remanded to BVA; and (2) VA management, Congress, and others did not have a complete picture of how long veterans waited for appeal decisions.

Book excerpt: For years, the disability compensation claims process has been the subject of concern and attention by the Department of Veterans Affairs (VA), Congress, and veteran service organizations (VSO), due in part to long waits for decisions and the large number of claims pending a decision. As GAO and other organizations have reported over the last decade, VA has also faced challenges in improving the accuracy and consistency of disability decisions. GAO was asked to examine (1) trends in VA's disability compensation claims processing at the initial claims and appeals levels and (2) actions that VA has taken to improve its disability claims process. To do this, GAO reviewed and analyzed VA performance data, budget submissions, program documents, and external studies and interviewed VA officials and VSO representatives. GAO recommends that the Secretary of Veterans Affairs direct (1) VBA to collect data on redistributed claims to help assess the effect of workload redistribution, (2) VBA and the Board of Veterans' Appeals to establish a plan with criteria for assessing whether ECA should be widely implemented, and (3) VBA to develop a plan with criteria for assessing whether its pilot reorganization of claims processors should be expanded. VA agreed with the recommendations, and noted plans to address them.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. Compensation is a monthly cash benefit based on a rating schedule that determines the degree of disability on a scale of 0 to 100. Although a disability rating may also entitle a veteran to ancillary services, such as vocational rehabilitation and employment services, the rating schedule is out of date medically and contains ambiguous criteria and obsolete conditions and language. The current rating schedule emphasizes impairment and limitations or loss of specific body structures and functions which may not predict disability well. 21st Century System for Evaluating Veterans' Disability Benefits recommends that this schedule could be revised to include modern concepts of disability including work disability, nonwork disability, and quality of life. In addition to the need for an updated rating schedule, this book highlights the need for the Department of Veterans' Affairs to devote additional resources to systematic analysis of how well it is providing services or how much the lives of veterans are being improved, as well as the need for a program of research oriented toward understanding and improving the effectiveness of its benefits programs.
