Book excerpt: Since the 1990s, the countries of Latin America and the Caribbean have been a focus of United States trade policy, as demonstrated by the passage of the North American Free Trade Agreement (NAFTA), the U.S.-Chile free trade agreement (FTA), and, more recently, the Central America-Dominican Republic Free Trade Agreement (CAFTA-DR). The Bush Administration has made bilateral and regional trade agreements important elements of U.S. trade policy. The United States currently is in the process of completing trade negotiations with Andean countries for an FTA and on reactivating talks for a U.S.-Panama FTA and a Free Trade Area of the Americas (FTAA). The FTAA is an on-going regional trade initiative that was first discussed in 1994 and formally started in 1998. The last FTAA trade ministerial meeting was held in Miami in November 2003, but the talks are currently stalled. The efforts of the United States in regional trade integration in the Americas are significant for Congress because U.S. entry into any free trade agreement may only be done with the legislative approval of the Congress. U.S. supporters of trade integration in the Americas believe it helps U.S. economic and political interests in several ways. Proponents believe that the movement towards trade integration of the Americas is beneficial for U.S. prosperity, and also serves to strengthen democratic regimes and support U.S. values and security. Forming closer economic relations with countries in the region is seen by some as a means to improve cooperation on other issues such as the environment and anti-drug efforts. U.S. opponents of trade integration proposals are mainly concerned that hemispheric free trade would lead to a loss of jobs in the United States through increased import competition or as a result of U.S. companies shifting production to lower-wage countries with weak labor standards. The number of regional trade agreements in the Americas has been increasing since the 1990s. Major trade arrangements include NAFTA, CAFTA-DR, the Southern Common Market (Mercosur) in South America, the Andean Community (CAN), the Caribbean Community and Common Market (CARICOM), the Central American Common Market (CACM), and the Latin American Integration Association (ALADI). With a total of 12 trade agreements involving over 40 countries, Mexico is one of the countries with the highest number of agreements. Supporters note that if countries in the Western Hemisphere ultimately establish an FTAA, it could have as many as 34 members and nearly 800 million people, nearly twice the population of the European Union. Trade integration in the Americas is of interest to policymakers because of the implications for the United States. Issues under debate include the pros and cons of deepened trade relations with Latin America and the Caribbean, and whether the current focus on bilateral and regional FTAs is the most appropriate trade policy. Some analysts do not believe that such a policy is a good idea because it is creating a complicated network of trade agreements throughout the region could slow down the FTAA process. Others believe that regional trade agreements lead to the consolidation of regional trade areas into larger free trade areas, and although a slow process, may eventually lead to a hemispheric free trade area.

But most Latin American countries would benefit from such an agreement with the United States. In the past decade a sea change has taken place in trade policies in Latin America: Within a few years, most of the region's economies have changed from restrictive to open policies. But unlike trade liberalization in Europe, most trade barriers in Latin America have been reduced unilaterally. Recently bilateral or multilateral agreements have been considered, especially preferential trade agreements within the region.Michaely evaluates the relevance and desirability of multilateral free trade agreements (such as NAFTA) for the Latin American continent and the Caribbean, with an emphasis on how they affect trade flows. Is a preferential trade agreement among some Latin American countries more or less likely to be meaningful than others - important in intensity of impact, or beneficial, or both? The evidence strongly suggests little likelihood that these agreements will succeed in Latin America. Paradoxically, the intense liberalization in recent years has made it less likely that such agreements would be beneficial - except possibly for agreements between some countries and Brazil, Mexico, or (to a lesser extent) Argentina.When the level of tariffs and nontariff barriers is already low, a preferential agreement is more likely to have an adverse impact than a beneficial one (although in any case only a slight impact). Between countries, the patterns of exports and imports are similar, suggesting a potential for trade diversion. Most countries would benefit from a preferential trade agreement with the United States, however. And U.S. agreements with blocks of Latin American countries are no more beneficial to those countries than are U.S. agreements with individual countries.This paper is a product of the Office of the Chief Economist, Latin America and the Caribbean Regional Office. Book excerpt: Geographic proximity has ensured strong linkages between the United States and Latin America and the Caribbean. The United States is a major trading partner and the largest source of foreign investment for many countries in the region, with free-trade agreements enhancing economic linkages with 11 countries. The region is a large source of U.S. immigration, both legal and illegal; geographic proximity and economic and security conditions are major factors driving migration trends. Curbing the flow of illicit drugs has been a key component of U.S. relations with the region for more than three decades and currently involves close security cooperation with Mexico, Central America, and the Caribbean. U.S. support for democracy and human rights in the region has been long-standing and currently focuses on Cuba and Venezuela. Under the Trump Administration, the outlook for U.S. relations with Latin America and the Caribbean has changed. The Administration's FY2018 and FY2019 foreign aid requests for the region would significantly cut assistance compared with FY2017. On trade, President Trump ordered U.S. withdrawal from the proposed Trans-Pacific Partnership trade agreement, an accord that would have increased U.S. economic linkages with Mexico, Chile, and Peru. The Administration is renegotiating the North American Free Trade Agreement (NAFTA) with Mexico and Canada. At times, President Trump has raised the possibility of withdrawal from NAFTA. The Administration announced it would end the deportation relief program known as Deferred Action for Childhood Arrivals (DACA), potentially affecting some 550,000 Mexicans and more than 100,000 migrants from other countries in the region. It also announced the termination of Temporary Protected Status (TPS) designations for El Salvador, Haiti, and Nicaragua, affecting more than 300,000 nationals from those countries. President Trump unveiled a new policy toward Cuba that partially rolls back U.S. efforts to normalize relations. As the situation in Venezuela has deteriorated, the Trump Administration has imposed additional targeted sanctions on individuals and broader financial sanctions on the government and is considering restrictions on oil trade. Congress traditionally has played an active role in policy toward Latin America and the Caribbean in terms of both legislation and oversight. Although Congress has not completed action on FY2018 foreign aid appropriations, it is poised to not include many of the cuts proposed by the Trump Administration for the region and will soon begin consideration of the FY2019 budget request. To date in the 115th Congress, the House has approved bills on Nicaragua and Venezuela: H.R. 1918 would require the United States to vote against any loan to Nicaragua from the international financial institutions unless the government takes steps to hold free and fair elections, and H.R. 2658 would authorize humanitarian assistance for Venezuela. Looking ahead, congressional attention to the region could focus on numerous issues, including consideration of legislation affecting DACA recipients or TPS beneficiaries; the U.S. response to the crisis in Venezuela; the Administration's efforts to renegotiate NAFTA; Cuba's expected political transition; the status of security partnerships with Mexico, Central America, and the Caribbean to combat transnational crime; Colombia's implementation of its peace accord; and the role of external actors in the region, including China and Russia. This report provides an overview of U.S. policy toward Latin America and the Caribbean during the 115th Congress. It begins with background on the region's political and economic environment and then examines U.S. policy toward the region, focusing on the Trump Administration. The report then examines selected regional and country issues, highlighting congressional interest and legislative action. An Appendix lists hearings on the region in the 115th Congress.
