Available in PDF, EPUB and Kindle. Book excerpt: The larger insular areas have come under the sovereignty of the United States in various ways. Puerto Rico and Guam were ceded to the United States by treaty at the end of the Spanish-American War in 1898. The Virgin Islands were purchased from Denmark in 1917. Following the renunciation by Great Britain and Germany of their claims to what is now American Samoa and the cession by the Samoan chiefs to the United States of these islands, the Congress, in 1929, ratified the instruments ceding the islands to the United States. The United States was responsible for administering the Northern Mariana Islands after World War II under a United Nations trusteeship agreement. Ultimately, a covenant between the United States and the Northern Marianas established the islands as a commonwealth under the sovereignty of the United States. At present, general federal administrative responsibility for the CNMI, Guam, the Virgin Islands, and American Samoa is vested in the Department of the Interior.

Book excerpt: Pursuant to a congressional request, GAO provided information on the applicability of relevant constitutional provisions to five insular areas, focusing on: (1) congressional representation; (2) the Uniformity Clause; (3) the Commerce Clause; (4) presidential election; (5) trial by jury; (6) the Equal Protection Clause; and (7) voting rights. GAO found that: (1) the insular areas, Puerto Rico, the U.S. Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands, can not elect representatives or senators since they were not states, but four of the insular areas elect nonvoting members to the U.S. House of Representatives; (2) the Uniformity Clause, which requires certain taxes imposed by Congress, does not apply to Puerto Rico, and most likely would not apply to the other four areas; (3) court decisions on the Commerce clause giving Congress the power to regulate commerce between the United States and foreign nations have been inconsistent; (4) residents of insular areas can not vote in presidential elections, but four of the five areas participate in the presidential nomination process, which is not governed by the constitution; (5) the courts reached different conclusions on the applicability of the sixth and seventh amendments, addressing the right to trial by jury, to the insular areas; (6) the Equal Protection Clause applies to Puerto Rico, and federal laws extend the clause to the other three insular areas; (7) the amendments that prohibit denying U.S. citizens the right to vote on the basis of race, color, previous condition of servitude, and sex apply to Puerto Rico, and federal laws extend it to three insular areas, but its applicability to American Samoa has never been addressed by Congress; (8) all of the areas have laws allowing those 18 years of age and older to vote; and (9) the Virgin Islands is the only area still required by federal law to follow the Internal Revenue Code.

Book excerpt: Focuses on America's first attempts at empire-building through a string of U.S. Supreme Court decisions in the early part of the 20th century that tried to define the legal and constitutional status of America's island territories: Puerto Rico, Cuba, and the Philippines, among others, and reveals how the Court provided the rationalization for the establishment of an American empire.

Available in PDF, EPUB and Kindle. Book excerpt: Over a century has passed since the United States Supreme Court decided a series of cases, known as the “Insular Cases,” that limited the applicability of constitutional rights in Puerto Rico and other overseas territories and allowed the United States to hold them indefinitely as subordinated possessions without the promise of representation or statehood. Essays in this volume, which originated in a Harvard Law School conference, reconsider the Insular Cases. Leading legal authorities examine the history and legacy of the cases, which are tinged with outdated notions of race and empire, and explore possible solutions for the dilemmas they created. Reconsidering the Insular Cases is particularly timely in light of the latest referendum in Puerto Rico expressing widespread dissatisfaction with its current form of governance, and litigation by American Samoans challenging their unequal citizenship status. This book gives voice to a neglected aspect of U.S. history and constitutional law and provides a rich context for rethinking notions of sovereignty, citizenship, race, and place, as well as the roles of law and politics in shaping them.

Available in PDF, EPUB and Kindle. Book excerpt: In this groundbreaking study of American imperialism, leading legal scholars address the problem of the U.S. territories. Foreign in a Domestic Sense will redefine the boundaries of constitutional scholarship. More than four million U.S. citizens currently live in five “unincorporated” U.S. territories. The inhabitants of these vestiges of an American empire are denied full representation in Congress and cannot vote in presidential elections. Focusing on Puerto Rico, the largest and most populous of the territories, Foreign in a Domestic Sense sheds much-needed light on the United States’ unfinished colonial experiment and its legacy of racially rooted imperialism, while insisting on the centrality of these “marginal” regions in any serious treatment of American constitutional history. For one hundred years, Puerto Ricans have struggled to define their place in a nation that neither wants them nor wants to let them go. They are caught in a debate too politicized to yield meaningful answers. Meanwhile, doubts concerning the constitutionality of keeping colonies have languished on the margins of mainstream scholarship, overlooked by scholars outside the island and ignored by the nation at large. This book does more than simply fill a glaring omission in the study of race, cultural identity, and the Constitution; it also makes a crucial contribution to the study of American federalism, serves as a foundation for substantive debate on Puerto Rico’s status, and meets an urgent need for dialogue on territorial status between the mainlandd and the territories. Oquendo, Juan Perea, Efrén Rivera Ramos, Rogers M. Smith, E. Robert Statham Jr., Brook Thomas, Richard Thornburgh, Juan R. Torruella, José Trías Monge, Mark Tushnet, Mark Weiner
