Book excerpt: Nepal, a country emerging from armed conflict and with a strong base of patriarchy and feudalism at its roots, has institutionalized the norm of violence as portrayed in social values, political criminalisation and impunity. The practice of routinely subjecting women to various forms of violence from the womb to the grave is pervasive. Socially, the sanctity of marriage remains a key structure through which the liberty of women is hampered. Thus, the inter-linkages of women’s chastity with their sexuality wherein any breaches are considered to be contaminating norms have contributed to situate rape as the crime shrouded in secrecy, giving rise to a pervasive and prevalent culture of silence among the survivors. Rape is a heinous human rights violation that infringes upon the sexual autonomy and integrity of an individual. Nepal committed herself to uphold the international human rights norms as stipulated in the Convention on the Elimination of all forms of Discrimination against Women (CEDAW); Convention on the Rights of the Child; International Covenant of Civil and Political Rights (ICCPR); International Covenant on Economic, Social and Cultural Rights (ICESCR); as a State party to international law. In addition, with the UNSCR 1325 and 1820 which are clear on promoting women’s participation and working towards combating sexual violence, it is mandatory for the Government of Nepal to put in place mechanisms to actualize its commitment to women’s rights. It is within this mandate that WOREC-Nepal and Isis-WICCE set out to examine the extent to which survivors of rape and sexual violence access justice and the efficacy of response mechanisms, in an effort to inform and draw the attention of decision and policy makers, activists, development workers, legal practitioners, and academic practitioners, to this critical development concern. Based on 55 in-depth interviews with survivors, 114 key informant interviews, 33 focus group discussions as primary sources; and media review (MR) of 201 cases and analysis of 723 documented cases WOREC xvii by organizations (OR) as secondary sources, the research team covered the 10 districts of Morang, Dhanusha, Kailali, Udayapur, Kavrepalanchowk, Kathmandu, Baglung, Dailekh, Dolakha and Darchula. Major findings i) Prevalence and magnitude of rape The findings show that the reporting and documentation of rape cases is still very marginal. An average of 443 cases in a year1reflects a high prevalence of rape if systems are conducive for survivors to report. The analysis further indicates that rape is a deeply entrenched national problem that transcends class, caste, ethnicity, age, economic, educational, geographical and religious status. From the regional perspective, Terai/Madhes was rated at (46.5% -MR and 45.1% -OR); and Jhapa (43-OR) district as having the highest rate of rape. According to the media review, the most affected group was in Hill Janjati (39.3%); and as per organizations’ documentation review, Brahmin/Chhetri and Hill Dalit (24.5% for each) followed by Hill Janjati (23%). The groups of minors (62.8%-OR, 63.6%-MR and 65.9%-police), students (67.9% -MR and 62.5%-OR) and unmarried women (79.4%-MR and 88.3%- OR) were the most vulnerable and affected. Though it is a fact that rape within marriage exists, it remains a taboo subject which is kept well hidden and institutionalized within the family structure. It was therefore difficult to identify and document marital rape related cases.

In Assault on the Small Screen: Representations of Sexual Violence on Prime Time Television Dramas, Molly Ann Magestro examines the ways in which police and legal dramas on network and cable channels portray rape narratives. In this discussion, the author focuses on eight successful shows—NCIS, Criminal Minds, CSI, The Closer, Rizzoli & Isles, Dexter, Law and Order: Special Victims Unit, and The Good Wife. Each chapter offers a close reading and analysis of how one or more of the shows represent rape narratives and rape victims in ways that more or less address feminist understandings of rape and rape culture. The arguments in each chapter explore the specific narrative content of individual series rather than a single critical approach. Each of the eight shows considered within the book is the focus of its own argument, as the representations of rape narratives on television are as complex as issues surrounding rape can be in the real world. In a time when rape narratives are frequently making headlines, taking the time to examine and understand the messages broadcast by a medium as ubiquitous as television serves an important role in developing an understanding of rape culture. Working in feminist film theory, the book adopts a cultural studies approach, considering the creation of a female-centered and thematically feminist film culture in light of structural and ideological shifts in Israeli society. Author Rachel S. Harris situates these changes in dialogue with the cinematic history that preceded them and the ongoing social inequalities that perpetuate women’s marginalization within Israeli society. While no one can deny Israel’s Western women’s advancements, feminist filmmakers frequently turn to Israel’s less impressive underbelly as sources for their inspiration. Their films have focused on sexism, the negative impact of militarism on women’s experience, rape culture, prostitution, and sexual abuse. These films also tend to include subjects from society’s geographical periphery and social margins, such as female foreign workers, women, and refugees. Warriors, Witches, Whoresis divided into three major sections and each considers a different form of feminist engagement. The first part explores films that situate women in traditionally male spheres of militarism, considering the impact of interjecting women within hegemonic spaces or reconceptualizing them in feminist ways. The second part recovers the narratives of women’s experience that were previously marginalized or silenced, thereby creating a distinct female space that offers new kinds of storytelling and cinematic aesthetics that reflect feminist expressions of identity. The third part offers examples of feminist activism that reach beyond the boundaries of the film to comment on social issues, particularly those which affect women. This section demonstrates how feminists use film (and work within the film industry) in order to women’s position in society. While there are thematic overlaps between the chapters, each section marks structural differences in the modes of feminist response. Warriors, Witches, Whores considers the ways social and political power have impacted the representation of women and looks to how feminist filmmakers have fought against these inequities behind the camera, in the stories they tell, and in the ways women are depicted on screen. While rape and other forms of sexual violence have attracted considerable local and international attention, this often excludes wartime sexual violence among women belonging to so-called ‘perpetrator’ war-torn nations. This book explores the silence surrounding women’s experiences of wartime sexual violence within academic, legal and public discourses. Olivera Simić argues that the international criminal law and feminist legal discourse on wartime sexual violence can construct a problematic victim hierarchy that excludes and misrecognises certain women’s experiences of sexual violence during and after armed conflict. The book focuses on the experiences of Bosnian Serb women, where the collapse of the former Yugoslavia led to brutal war and gross human rights violations throughout the 1990s. Two decades after the war, women in Bosnia and Herzegovina are still facing the legacies of the violence in the 1990s. Through this case Simić argues that while all women survivors of rape face problems of stigma, shame and lack of political visibility, their legal and symbolic status differ according to their ethno-national identity. Drawing on interviews with Bosnian Serb women survivors of rape in Bosnia and Herzegovina, feminist activists, local media, documentary and archival sources, the book examines ‘post-conflict justice’ as it is seen, lived and interpreted by women who belong to ‘perpetrator’ nations and will be of great interest and use to researchers, students and practitioners within post-conflict law and justice, international criminal law, security studies and gender studies.
