Parvenir à un équilibre entre deux intérêts apparemment antagoniste rend toujours la preuve un sujet délicat. Cette complexité d'établir la preuve en matière pénale s'accroît considérablement en matière de criminalité organisée. Cette complexité est due tantôt à la menace conséquente de cette délinquance à nos sociétés, tantôt à ses caractéristiques. Après avoir fait apparaître ces difficultés, deux réactions peuvent être observées pour y faire face : soit adopter un arsenal juridique hors de commun qui peut se heurter fortement aux droits de l'homme, soit sacrifier les intérêts de la communauté au profit des libertés individuelles ce qui menace la stabilité et les valeurs d'un État de droit. L'objectif de cette étude est de faciliter la preuve en matière de criminalité organisée ; une lourde tâche d'autant plus qu'il s' agit de parvenir à une conciliation entre deux intérêts également puissants, également sacrés. Par conséquent, nous nous bornons à étudier le renversement de la charge de la preuve ainsi que quelques moyens de preuve dont surgissent des inquiétudes préoccupantes relatives à leur compatibilité avec les droits de l'homme, comme les opérations sous couverture et certaines méthodes scientifiques. Cette recherche dépend des expériences nationales, tout en essayant de dégager les solutions appropriées.

L’objectif de cette étude est de définir les actes d’investigation et de se prononcer sur leur caractère légal ou non, étant précisé que la recherche de la vérité ne justifie pas en procédure pénale l'emploi du tout moyen de preuve. Par conséquent, nous nous bornerons dans la première partie à étudier le domaine des actes d’investigation. Un titre premier est consacré aux actes autorisés par la loi, comme les perquisitions, les saisies, les écoutes téléphoniques, les sonorisations et captations d’images, la garde à vue, les constatations, le transport sur les lieux, l’audition, etc. Sont examinés les cadres juridiques d’investigation : les enquêtes de police autonomes et l’enquête subordonnée sur commission rogatoire du juge. Est également pris en compte l’important projet du futur Code de procédure pénale qui préconise la disparition du juge d’instruction et l’institution d’un nouvel cadre d’enquête entre les mains du parquet. De même, sont étudiées les limites à la recherche des preuves, posées par certains principes consacrés par la Convention européenne des droits de l’homme, notamment les principes de dignité et de proportionnalité. Le deuxième titre porte sur les actes d’investigation non réglementés par la loi, qu’ils émanent des autorités policières et judiciaires ou des particuliers. Sont traités les provocations policières, les stratagèmes, les pratiques discriminatoires et les écoutes clandestines.La deuxième partie a trait précisément au régime des actes d’investigation les plus attentatoires aux libertés individuelles et aux garanties auxquels ils sont soumis. Le titre premier procède à une analyse détaillée des différents actes intrusifs, qui touchent les aspects les plus intimes de la vie privée : perquisition, saisie, écoutes téléphoniques et sonorisation et captation d’images. Quant au titre deuxième, il envisage le régime de la garde à vue, véritable atteinte à la liberté d’aller et venir.Cette recherche intègre les dernières dispositions législatives et l’apport des décisions jurisprudentielles les plus récentes, qu’elles émanent des juridictions nationales ou de la Cour de Strasbourg.

Book excerpt: Much orthodox economic theory is based on assumptions which are treated as self-evident: supply and demand are regarded as independent entities, the individual is assumed to be a rational agent who knows his interests and how to make decisions corresponding to them, and so on. But one has only to examine an economic transaction closely, as Pierre Bourdieu does here for the buying and selling of houses, to see that these abstract assumptions cannot explain what happens in reality. As Bourdieu shows, the market is constructed by the state, which can decide, for example, whether to promote private housing or collective provision. And the individuals involved in the transaction are immersed in symbolic constructions which constitute, in a strong sense, the value of houses, neighbourhoods and towns. The abstract and illusory nature of the assumptions of orthodox economic theory has been criticised by some economists, but Bourdieu argues that we must go further. Supply, demand, the market and even the buyer and seller are products of a process of social construction, and so-called ‘economic' processes can be adequately described only by calling on sociological methods. Instead of seeing the two disciplines in antagonistic terms, it is time to recognize that sociology and economics are in fact part of a single discipline, the object of which is the analysis of social facts, of which economic transactions are in the end merely one aspect. This brilliant study by the most original sociologist of post-war France will be essential reading for students and scholars of sociology, economics, anthropology and related disciplines.
