Or, on sait que depuis un arrêt de la Chambre civile en date du 18 décembre 1912, la jurisprudence affirme d'une manière constante l'identité de la faute civile et de la faute pénale. A l'époque contemporaine où, en matière civile, la faute n'apparaît plus, souvent, que comme un simple prétexte à assurer une réparation civile, pratiquement toujours supportée par l'assurance, la conséquence pratique de cette identité est le risque de voir s'installer une paradoxale, mais combien redoutable, autorité de fait du civil sur le criminel, préjudiciable à une bonne administration de la justice pénale. C'est pourquoi une partie importante de la doctrine contemporaine conteste le principe de l'identité des fautes. Mais, mené sur le terrain strict de la faute, le combat n'est pas mené sur un terrain propice.
