Available in PDF, EPUB and Kindle. Book excerpt: The U.S. Justice Department's Civil Rights Div. (which uses the abbreviation CRT) is the principal Fed. authority charged with the responsibility of enforcing the nation's civil rights laws. The direction of CRT enforcement efforts has been the subject of several hearings by Congress. Furthermore, CRT enforcement actions have been affected by several U.S. Supreme Court decisions rendered in the 1990s that provided new guidelines for the enforcement of certain Fed. civil rights laws and affirmative action programs. This report reviews several issues that include, among other things, determining CRT's approach for selecting cases to pursue and the reasons that matters were closed.

Book Synopsis The Initiative by : Joseph F. Zimmerman
Download or read book The Initiative written by Joseph F. Zimmerman and published by State University of New York Press. This book was released on 2014-10-07 with total page 250 pages. Available in PDF, EPUB and Kindle. Book excerpt: The initiative is the product of the populist movement, which in the late nineteenth century sought to increase voter control of what were viewed as unrepresentative state and local governments. Today, twenty-four states allow registered voters to place proposed state laws on the referendum ballot, and eighteen states authorize voters to place proposed state constitutional amendments on the referendum ballot by collecting a specified number of valid voter signatures. Numerous local governments have a charter provision or a state law provision allowing voters to employ the popular lawmaking device. In The Initiative, Second Edition, Joseph F. Zimmerman traces the origin and spread of the initiative in the United States. The initiative has been a controversial device since first being introduced in South Dakota in 1898, with arguments both in support and in opposition. Zimmerman examines and evaluates both the legal foundation of the initiative, and the arguments against its use. He then concludes with a chapter that develops model constitutional, statutory, and local government charter provisions to assist jurisdictions and their voters contemplating adoption of the initiative or amendment of already existing constitutional, statutory, and charter initiative provisions.
Book Synopsis Law of Property Rights Protection, 2nd Edition by : Laitos
Download or read book Law of Property Rights Protection, 2nd Edition written by Laitos and published by Wolters Kluwer. This book was released on 2018-11-14 with total page 1344 pages. Available in PDF, EPUB and Kindle. Book excerpt: Law of Property Rights Protection: Limitations on Governmental Powers, Second Edition is a comprehensive, up-to-date review of the on-going battle between government's desire to regulate and limit private property use, and property owners' equally powerful desire to avoid economically damaging or unreasonable or unconstitutional limitations. Federal, state, and local governments often wish to restrict or condition uses of private property, while private property owners wish to avoid or seek compensation for such regulatory controls. This battle between property and regulation is one of the most emotionally charged and fiercely contested issues in contemporary law. An enormous amount of litigation, at both the federal and state level, has stemmed from questions surrounding the extent to which government may restrict or even prevent certain private property uses. The relevant law is constantly changing and evolving, so count on the Law of Property Right Protection to bring you completely up to date. The book is organized according to the many ways that government powers over private property are limited, by the federal and state constitutions, the common law, and equitable principles and has been cited by the United States Supreme Court, federal courts, and state appellate courts. Law of Property Rights Protection: Limitations on Governmental Powers, Second Edition: Analyzes relevant and current case law, and identifies (1) which challenges by private property owners were successful, (2) what facts seemed compelling to reviewing courts considering property-restrictive regulations, and (3) what arguments by property owners tend to fail in the eyes of reviewing courts. Offers advice on which property-protective provisions in constitutional law maximize the likelihood of a successful challenge to restrictive regulations, as well as advice on how to mount a legal challenge which will not be dismissed on jurisdictional or procedural grounds. Considers all of the primary limitations on government regulations of property - Takings; Due Process; Contracts Clause; Equal Protection; the Vested Rights Doctrine; Anti-Retroactivity Presumptions; Internal Limits on the Police Power Includes the full range of property interests - such as real property; contract rights; leasehold rights; unpatented mining claims; water rights; intellectual property; rights of access and entry; royalty rights; all forms of intangible property interests Using Laitos' strategic approach, and easy-to-follow organization, this book will help you formulate arguments and challenges which may overcome or invalidate onerous regulations on the use and enjoyment of private property. Book Synopsis Bringing in the People by : Markku Suksi
Download or read book Bringing in the People written by Markku Suksi and published by BRILL. This book was released on 2024-02-26 with total page 324 pages. Available in PDF, EPUB and Kindle. Book excerpt: The referendum is not a monolithic method of national decision making. There are a multitude of referendum forms which exist under varying constitutional conditions and operate in different ways. A global comparison shows that more than half the constitutions of the world provide for the referendum at a national level, but referendums are also carried out without explicit constitutional support. Two main forms of referendum can be observed, the mandatory constitutional referendum and the policy vote. This book argues that the referendum does not undermine representative decision making, but supplements it in various ways: the referendum is not diametrically opposed to representative government, and when properly designed and used, the institution of the referendum can enhance the legitimacy of a constitutional and political system. This book is the first comprehensive constitutional and comparative analysis of the referendum. It offers illuminating and intriguing reading for all those interested in national decision making.
Book Synopsis Land Use Law in Florida by : W. Thomas Hawkins
Download or read book Land Use Law in Florida written by W. Thomas Hawkins and published by Taylor & Francis. This book was released on 2021-06-28 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: Land Use Law in Florida presents an in-depth analysis of land use law common to many states across the United States, using Florida cases and statutes as examples. Florida case law is an important course of study for planners, as the state has its own legal framework that governs how people may use land, with regulation that has evolved to include state-directed urban and regional planning. The book addresses issues in a case format, including planning, land development regulation, property rights, real estate development and land use, transportation, and environmental regulation. Each chapter summarizes the rules that a reader should draw from the cases, making it useful as a reference for practicing professionals and as a teaching tool for planning students who do not have experience in reading law. This text is invaluable for attorneys; professional planners; environmental, property rights, and neighborhood activists; and local government employees who need to understand the rules that govern how property owners may use land in Florida and around the country.
