Available in PDF, EPUB and Kindle. Book excerpt: How often is the defense of insanity or temporary insanity for accused criminals valid—or is it ever legitimate? This unique work presents multidisciplinary viewpoints that explain, support, and critique the insanity defense as it stands. What is the role of "the insanity defense" as a legal excuse? How does U.S. law handle criminal trials where the defendant pleads insanity, and how does our legal system's treatment differ from those of other countries or cultures? How are insanity defenses used, and how successful are these defenses for the accused? What are the costs of incarceration versus psychiatric treatment and confinement? This book presents a range of expert viewpoints on the insanity defense, exposing common myths; investigating its effectiveness and place in our legal system through history, case studies, and comparative analysis; and supplying perspectives from the disciplines of psychology, psychiatry, sociology, and neuroscience. The content also addresses the ramifications of declaring citizens insane or incapacitated and examines trials that involved pleas of insanity and temporary insanity.

Available in PDF, EPUB and Kindle. Book excerpt: Suzanne O'Malley takes a close look at the Andrea Yates murder trial and discovers medical misjudgment, professional negligence, misapplied law, and a revelation that led to the overturning of Yates's conviction. It took a jury less than four hours to find Houston housewife Andrea Yates guilty of the drowning deaths of three of her five children—and a mere half hour to sentence the troubled woman with a stunning history of severe mental problems to life in prison. But beyond the media coverage of her heinous crimes, there is a story that only investigative reporter Suzanne O'Malley has fully illuminated. This updated edition of Are You There Alone? features a new chapter on the appeal of the Yates case, as well as personal updates on both Andrea and Rusty Yates. Having drawn upon hundreds of interviews—with expert witnesses, close friends, family advisers, and Andrea and Rusty themselves—O'Malley has produced a riveting true-crime account that shatters our notions about criminal law, mental illness, death-penalty politics, and religious fanaticism in America today.

"Dr. Meiklejohn, in a book which greatly needed writing, has thought through anew the foundations and structure of our theory of free speech . . . he rejects all compromise. He reexamines the fundamental principles of Justice Holmes' theory of free speech and finds it wanting because, as he views it, under the Holmes doctrine speech is not free enough. In these few pages, Holmes meets an adversary worthy of him . . . Meiklejohn in his own way writes a prose as piercing as Holmes, and as a foremost American philosopher, the reach of his culture is as great . . . this is the most dangerous assault which the Holmes position has ever borne." --JOHN P. FRANK, Texas Law Review 27:405-412. ALEXANDER MEIKLEJOHN [1872-1964] was dean of Brown University from 1901-1913, when he became president of Amherst College. In 1923 Meiklejohn moved to the University of Wisconsin- Madison, where he set up an experimental college. He was a longtime member of the National Committee of the American Civil Liberties Union. In 1945 he was a United States delegate to the charter meeting of UNESCO in London. Lectureships have been named for him at Brown University and at the University of Wisconsin. He was awarded the Presidential Medal of Freedom in 1963.

Available in PDF, EPUB and Kindle. Book excerpt: The governmental pledge to the American people is found in the First Amendment: "Congress shall make no law...abridging the freedom of speech, or of the press." Written more than two hundred years ago, these words now protect a wide range of expressive activity. A broad-gauged discussion of freedom of expression in America, this book begins by studying the period after the Civil War and Reconstruction when new and unsettling ideas appeared with great regularity on the American scene. So many of these ideas were floating around during this period that the nation's leaders often joined forces to repress aberrant notions. In response to such suppression, individuals seeking to better their lives through the expression of new ideas began to demand their rights to speak, write, and associate together to advance their points of view. Blanchard traces this contest for control through the Watergate scandal of the 1970s and the Reagan and early Bush administrations. Blanchard presents a lively discussion of freedom of speech ranging from questions of national security to those of public morality, from loyalty during times of national stress to the right to preach on a public street corner. Including examinations of controversies involving the press, the national government, the Supreme Court, and civil liberties and civil rights concerns, Revolutionary Sparks presents a strong case for the right of Americans to speak their minds and to have access to knowledge necessary for informed self-government.

Available in PDF, EPUB and Kindle. Book excerpt: Describes landmark free speech decisions of the Supreme Court while highlighting the issues of language, rhetoric, and communication that underlie them. At the intersection of communication and First Amendment law reside two significant questions: What is the speech we ought to protect, and why should we protect it? The 20 scholars of legal communication whose essays are gathered in this volume propose various answers to these questions, but their essays share an abiding concern with a constitutional guarantee of free speech and its symbiotic relationship with communication practices. Free Speech on Trial fills a gap between textbooks that summarize First Amendment law and books that analyze case law and legal theory. These essays explore questions regarding the significance of unregulated speech in a marketplace of goods and ideas, the limits of offensive language and obscenity as expression, the power of symbols, and consequences of restraint prior to publication versus the subsequent punishment of sources. As one example, Craig Smith cites Buckley vs. Valeo to examine how the context of corruption in the 1974 elections shaped the Court's view of the constitutionality of campaign contributions and expenditures. Collectively, the essays in this volume suggest that the life of free speech law is communication. The contributors reveal how the Court's free speech opinions constitute discursive performances that fashion, deconstruct, and reformulate the contours and parameters of the Constitution’s guarantee of free expression and that, ultimately, reconstitute our government, our culture, and our society.

Available in PDF, EPUB and Kindle. Book excerpt: One of the most important collections of documents pertaining to the formation of the Constitution of the United States. Notes on the convention taken by Robert Yates, Chief Justice of New York, and copied by John Lansing, Jun. Esquire, late chancellor of that state, members of that convention. Including "The Genuine Information, " laid before the Legislature of Maryland, by Luther Martin, Esquire, then attorney-general of that state, and member of the same convention. James Madison thought that Yates and Martin "appear to have reported in angry terms what they observed with jaundiced eyes." It must be added that in many particulars Yates' notes were fuller than Madison's own. Luther Martin's Genuine Information is a general summary of the course of the Debates, with a running criticism on the provisions of the Constitution. Also contains an appendix with documents by Edmund Randolf, and others.

Book excerpt: What should happen when doctors and parents disagree about what would be best for a child? When should courts become involved? Should life support be stopped against parents’ wishes? The case of Charlie Gard, reached global attention in 2017. It led to widespread debate about the ethics of disagreements between doctors and parents, about the place of the law in such disputes, and about the variation in approach between different parts of the world. In this book, medical ethicists Dominic Wilkinson and Julian Savulescu critically examine the ethical questions at the heart of disputes about medical treatment for children. They use the Gard case as a springboard to a wider discussion about the rights of parents, the harms of treatment, and the vital issue of limited resources. They discuss other prominent UK and international cases of disagreement and conflict. From opposite sides of the debate Wilkinson and Savulescu provocatively outline the strongest arguments in favour of and against treatment. They analyse some of the distinctive and challenging features of treatment disputes in the 21st century and argue that disagreement about controversial ethical questions is both inevitable and desirable. They outline a series of lessons from the Gard case and propose a radical new ‘dissensus’ framework for future cases of disagreement. This new book critically examines the core ethical questions at the heart of disputes about medical treatment for children. The contents review prominent cases of disagreement from the UK and internationally and analyse some of the distinctive and challenging features around treatment disputes in the 21st century. The book proposes a radical new framework for future cases of disagreement around the care of gravely ill people.

This book was released on 2002-07-19 with total page 804 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume is the newest release in the authoritative series issued by the National Academy of Sciences on dietary reference intakes (DRIs). This series provides recommended intakes, such as Recommended Dietary Allowances (RDAs), for use in planning nutritionally adequate diets for individuals based on age and gender. In addition, a new reference intake, the Tolerable Upper Intake Level (UL), has also been established to assist an individual in knowing how much is "too much" of a nutrient. Based on the Institute of Medicine's review of the scientific literature regarding dietary micronutrients, recommendations have been formulated regarding vitamins A and K, iron, iodine, chromium, copper, manganese, molybdenum, zinc, and other potentially beneficial trace elements such as boron to determine the roles, if any, they play in health. The book also: Reviews selected components of food that may influence the bioavailability of these compounds. Develops estimates of dietary intake of these compounds that are compatible with good nutrition throughout the life span and that may decrease risk of chronic disease where data indicate they play a role. Determines Tolerable Upper Intake levels for each nutrient reviewed where adequate scientific data are available in specific population subgroups. Identifies research needed to improve knowledge of the role of these micronutrients in human health. This book will be important to professionals in nutrition research and education.
