Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Text-Book of Constitutional Law: Act of March 3, 1875 This Text-Book of Constitutional Law is offered to those high schools and colleges whose aim is to give their students, first, a thorough knowledge of what the Constitution is, how it originated, and the subjects with which it deals; second, a sufficient, practical knowledge of the questions that have arisen under it, how they have been decided, and the general principles of constitutional law. Experience as an instructor has led the writer to the conclusion that the method of presentation here adopted is the best possible to secure these results. Written in such simple and readable language as to be easily understood, it is believed that this book will meet the wants of all institutions except those whose course is so extended as to require a treatise, and that it will be found useful to those members of the bar who desire a work whose simplicity of arrangement and reference will enable them to refer at once to the leading cases that have arisen under the Constitution and laws of the United States. Attention is invited to the treatment of the following subjects: the taxing power, the power to regulate commerce, the money and war powers of Congress, laws impairing the obligation of contracts, the Federal judicial system, the status of the Territories belonging to the United States, and the proper relation of the State and Federal Governments - subjects which the student seldom understands, owing to the brief and imperfect consideration given them in what are usually called manuals of the Constitution. The list of questions given in an Appendix will serve to test the students' knowledge of the subject. They are intended to be used by him for purposes of review and self-examination. Book excerpt: John Ross Browne (1817-1875) of Kentucky, the official reporter for the California State Constitutional Convention of September-October 1849, came to California in 1849 as an employee of the government revenue service. He traveled widely in the next two decades before settling down in Oakland. Report of the debates of the Convention of California (1850) comprises the official records of the convention. Browne had been a shorthand reporter for the U.S. Senate before coming west, and he provides transcripts of the proclamation calling the convention, proceedings of the convention, text of the state constitution adopted by the delegates, and official correspondence regarding the convention and the institution of state government under that constitution.

Available in PDF, EPUB and Kindle. Book excerpt: Arguably no political principle has been more central than the separation of powers to the evolution of constitutional governance in Western democracies. In the definitive work on the subject, M. J. C. Vile traces the history of the doctrine from its rise during the English Civil War, through its development in the eighteenth century—when it was indispensable to the founders of the American republic—through subsequent political thought and constitution-making in Britain, France, and the United States. The author concludes with an examination of criticisms of the doctrine by both behavioralists and centralizers—and with "A Model of a Theory of Constitutionalism." The new Liberty Fund second edition includes the entirety of the original 1967 text published by Oxford, a major epilogue entitled "The Separation of Powers and the Administrative State," and a bibliography. M. J. C. Vile is Professor of Politics at the University of Kent at Canterbury and author also of The Structure of American Federalism.

Available in PDF, EPUB and Kindle. Book excerpt: Classic Books Library presents this brand new edition of “The Federalist Papers”, a collection of separate essays and articles compiled in 1788 by Alexander Hamilton. Following the United States Declaration of Independence in 1776, the governing doctrines and policies of the States lacked cohesion. “The Federalist”, as it was previously known, was constructed by American statesman Alexander Hamilton, and was intended to catalyse the ratification of the United States Constitution. Hamilton recruited fellow statesmen James Madison Jr., and John Jay to write papers for the compendium, and the three are known as some of the Founding Fathers of the United States. Alexander Hamilton (c. 1755–1804) was an American lawyer, journalist and highly influential government official. He also served as a Senior Officer in the Army between 1799-1800 and founded the Federalist Party, the system that governed the nation’s finances. His contributions to the Constitution and leadership made a significant and lasting impact on the early development of the nation of the United States.
