Book excerpt: Probably the best record of the conference available now or in the future, because financial constraints prevented the UN Secretariat from issuing summary verbatim records. The conference was called for at the 1992 environmental conference in Rio to address problems arising from fishing fleets traveling far from depleted fisheries near home in pursuit of fish, and the increasing adoption of 200-mile economic zones by countries. Includes selected documents from the six sessions between April 1993 and August 1995, the agreement for the implementation of the provisions of the UN Convention on the Law of the Sea of 10 December 1982 relating to the conservation and management of straddling and highly migratory fish stocks, the final act of the conference, a list of documents, and a subject index. Book excerpt: Fisheries for highly migratory species are important in all oceans and semi-enclosed seas, except for polar regions. Fisheries for straddling fish stocks are much more localised, primarily occurring in a few regions where continental shelves extend beyond the 200 miles Exclusive Economic Zone (EEZ), while most fisheries for other high seas fishery resources are deep-water fisheries. This publication examines issues relating to the stocks of these resources, including information on their state of exploitation. Findings include that about 30 percent of the stocks of highly migratory tuna and tuna-like species, more than half of highly migratory oceanic sharks and nearly two-thirds of the straddling stocks and the stocks of other high seas fishery resources are overexploited or depleted. Although the stocks concerned represent only a small fraction of the world fishery resources, they are key indicators of the state of an overwhelming part of the ocean ecosystem which appears to be more overexploited than EEZs.

Book excerpt: The effective management of shared fish stocks stands as one of the great challenges towards achieving long-term sustainable fisheries. These resources account for as much as one-third of world marine capture fishery harvests. This paper explores the legal and economic aspects of the management of each of the several different categories of shared stocks, namely transboundary, highly migratory, straddling and discrete high seas stocks. The economics of the issue point to the conclusion that, with few exceptions, effective cooperation between and among states is a fundamental prerequisite for sustainable resource management.

Book excerpt: In the Western Central Atlantic Fishery Commission (WECAFC) area, large pelagics contribute only about 6% of total landings, but are nonetheless significant for many countries. Large pelagic fishes are caught in all WECAFC states, and within the WECAFC region by several distant water fishing nations. However only 19 of 40 WECAFC Member States report catches to FAO. The fisheries range in scale and technological sophistication from artisanal fishers trolling from canoes to modern commercial longliners and purse seiners (mostly from distant water fishing nations). The available information on development of small-scale and large scale fleets targeting large pelagics, indicates a significant trend of increasing fishing capacity in the countries of the WECAFC region. Several species which are not assessed by ICCAT are of considerable importance in large pelagic fisheries in the WECAFC region. Overall, about half the landings of large pelagics in the WECAFC region are from species which are assessed. Existing institutional mechanisms are not adequate for management of shared or straddling fish stocks and those of highly migratory fish, as per the recent UN Agreement. Any such institution must have linkages with extraregional organisations, primarily ICCAT, and, in order to maximise efficiency and avoid duplication, should also be able to deal with shared, straddling and migratory fish stocks other than pelagics, for example, lobster and reef fishes with planktonic early life history stages. WECAFC, with modifications to its statutes, appears to be the most feasible existing organisation to adopt such a role.

Book excerpt: The 1996 edition of the Yearbook of the United Nations is the single most comprehensive and authoritative reference book about the work of the United Nations and related international organizations and bodies. Fully indexed and reproducing all major General Assembly, Security Council and Economic and Social Council resolutions, the volume is not only useful for diplomats, government officials and scholars, but also for researchers, writers, journalists, teachers, students and others with a serious interest in international and UN affairs. This volume of the Yearbook details the many activities of the Organization and its organs, programmes and bodies, as they are carried out in all corners of the globe. It gives an account of their endeavours to create better and more peaceful conditions for all mankind and records their efforts to deal with matters of pressing concern in a variety of areas, including peacekeeping and peacemaking, disarmament, human rights, trade and development, control of drug abuse and illicit trafficking, crime prevention, assistance to refugees and other vulnerable populations. Building on the experience of its first 50 years, the United Nations continued in 1996 to confront major global challenges. The observance of the International Year for the Eradication of Poverty can be seen as a benchmark for action to address a plethora of global ills that beset the majority of Earth's nearly 6 billion inhabitants - hunger, inadequate housing, disease, the deterioration of the environment, unemployment. During the year, the United Nations convened two major conferences - the `City Summit' in Istanbul, centering on the two themes of adequate shelter for all, and sustainable human settlement development in an urbanizing world, and the World Food Summit in Rome, whose main goal was food security for all. The Yearbook chronicles these events and many other milestones reached, making it an invaluable tool for anyone seeking in-depth information about the United Nations family. Also available from the UN, Sales No. E.97.I.1 As of volume 51 (1997) the Yearbook of the United Nations will no longer be published by Kluwer Law International. Available in PDF, EPUB and Kindle. Book excerpt: Until recently, the international community failed to adopt either an agreed limit for the breadth of the territorial sea or a satisfactory regime of fisheries in the waters adjacent to the territorial sea. This provoked an eruption of unilateral acts by which coastal states extended their jurisdiction towards the high seas. The Third U.N. Conference on the Law of the Sea accepted the establishment of a 12-mile territorial sea and a 200-mile exclusive economic zone. While taking into account the non-existent rights and interests of the so-called geographically disadvantaged states and of states with broad continental shelves, the 1982 Convention on the Law of the Sea practically ignored existing rights and interests of habitual fishing states. It maintained the well-established principle of freedom of fishing on the high seas but with specific conditions. Dissatisfied with the Convention's regulation of fishing on the high seas, a few states elected to hold a U.N. Conference on Straddling and Highly Migratory Fish Stocks which adopted the 1995 Agreement for the implementation of the provisions of the Convention relating to the conservation and management of such stocks. Similarly, some of these states, like Chile, Argentina, and Canada, adopted legislation extending their jurisdiction beyond their respective 200-mile fishing or exclusive economic zones. This book explores these events in the historical development of the international regulations of fisheries and concludes with a look into recent developments in the area.

Book excerpt: This book places contemporary problems of ocean use management in historical context beginning with the time of Hugo Grotius, whose seminal 1609 work The Freedom of the Seas was the basis of ocean law for the next three centuries. Individual use problems are dealt with in detail and include overfishing, migrating fish stocks and fish wars, oil drilling, deep sea mining and marine pollution. Throughout the author notes the need to seek solutions in ocean management from a more integrated perspective. Emphasis is placed on the United Nations Conference on the Law of the Sea and the resulting agreements. This book therefore presents a unique breadth of view which will make it salient to policy makers, diplomats, scholars and ocean users.

Book excerpt: Now in its fifth year, the "Max Planck Yearbook of United Nations Law" is becoming a much sought-after forum for essays by the most distinguished professors in international law. These essays cover a variety of topics related to the activities of the United Nations: from the role of the Security Council to UN treaties, from environmental issues to humanitarian law. The "Yearbook" also contains essays e.g. on the World Bank, the IAEA, and the WTO. Volume 5 focuses in particular on the international dispute settlement system with articles on the activities of international courts and tribunals as well as the contributions to settlement of disputes by other institutions such as the World Bank Inspection Panel. But there are also tackled subjects as the future of peace-keeping, the UN Transitional Administration in Kosovo and East Timor, as well as human rights and their implementation. This book is a must-have for any academic involved in international law. For more information on this yearbook please visit the website of the Max Planck Institute
