The book argues that Spain demonstrates a successful case of liberal economic nationalism, typified by aggressive, early state intervention to restructure Spanish banks, and help from the European Stability Mechanism even in the face of local political opposition. Italy, meanwhile, suffered from the weaker, delayed intervention which forced it to confront European institutions with demands for special treatment as a means of externalizing its own internal weakness. Son cuatro los pilares que forman la Unión Bancaria: la Autoridad Bancaria Europea (ABE), el Mecanismo Único de Supervisión (MUS), el Mecanismo Único de Resolución (MUR) y el Fondo de Garantía de Depósitos Único (FGDU). De estos cuatro pilares, solo tres han entrado ya en funcionamiento, y el último, el FGDU, es el único que falta por constituirse, y de esta forma completar la ansiada Unión Bancaria. Por ello, en este trabajo se pretende conocer cada uno de los mecanismos puestos en marcha, así como su funcionamiento, para solventar las posibles crisis financieras que puedan surgir en el futuro, sin que ello afecte a los contribuyentes. Las razones que justifican su creación, sus componentes, sus fines, sus fundamentos teóricos y sus debilidades, y su relación con la integración bancaria, como uno de sus fines principales. En esta tesis realizamos, en primer lugar, un seguimiento minucioso del proceso de construcción de la Unión Bancaria. Veremos por qué surge la necesidad de una unión bancaria en el seno de la Unión Monetaria Europea, el contexto económico en el que se genera, a mediados de 2012, las discusiones que se producen sobre su diseño, los elementos que la componen, el marco normativo que se aprueba para establecerlos, las autoridades que los dirigen, las funciones que realizan y su régimen de funcionamiento. También veremos la interrelación que se produce entre sus componentes, las reticencias y críticas que se plantean y las dificultades que aparecen en su implementación práctica. Realizamos también una revisión de los fundamentos teóricos que justifican la necesidad de una unión bancaria en el seno de una unión monetaria, clasificados en función de la contribución a alcanzar los objetivos que se persiguen con su constitución, que dividimos en cuatro, romper el círculo vicioso entre riesgo soberano y bancario, restaurar la confianza en el sector bancario, acabar con la fragmentación financiera y contribuir a preservar la estabilidad financiera en la UEM. Igualmente, hacemos una recopilación de argumentos teóricos esgrimidos en contra de esos fundamentos. Veremos hasta qué punto puede considerarse puede ser necesaria y suficiente la constitución de una Unión Bancaria para alcanzar esos objetivos. Nos centramos posteriormente en el objetivo concreto de incrementar la integración financiera, en concreto bancaria, viendo en primer lugar hasta qué punto es deseable fomentar la integración financiera, los beneficios y costes teóricos, y luego los desarrollos legales ya producidos en el seno de la Unión Europea para ese fin. Analizaremos después, en detalle, la evolución del proceso de integración financiera, y particularmente bancaria, desde el lanzamiento del euro como moneda única. Realizamos un estudio de múltiples indicadores, tanto de precio, cantidad y estructura, publicados por organismos internacionales (especialmente los publicados por el BCE), que nos servirán para medir el grado de integración alcanzado y de fragmentación posterior. A partir de lo observado en los datos, realizamos una serie de reflexiones sobre hasta qué punto se puede considerar integración financiera la que se alcanzó en la zona euro antes de la crisis, y hasta qué punto se puede considerar fragmentación financiera lo ocurrido después, y si es deseable volver a ese nivel de integración o buscar una integración diferente, más completa y estable.

Book excerpt: The Difficult Construction of European Banking Union examines the political, legal and economic issues surrounding the lacunae and design faults of European Banking Union and its problematic operation. The volume brings together the work of sixteen scholars focused on the diverse debates surrounding the construction and operation of Banking Union (BU), and its necessary reform. BU represents one of the most important developments in European integration since the launch of Monetary Union. Furthermore, the design of the BU agreed between 2012 and 2014 was a messy compromise among EU member states. It is not surprising then that BU has sparked a lively academic debate and triggered an ever-growing number of publications from different disciplinary backgrounds. The first wave of academic work on BU focuses upon the economic rationale underpinning the supranationalisation of control over banking -- regulation, supervision, support and resolution -- and the political dynamics and legal issues that shaped the design of the Union agreed. This volume is located at the intersection of this first phase of academic research and a second stage which analyses the functioning of the different elements of BU. New research questions are triggered by the albeit limited empirical evidence on BU's implementation and operation. Contributions to this second wave of research attempt to identify potentially dangerous lacunae and contribute to on-going reform debates.
