This amount represents the 2012 accumulation of both the spent fuel from more than one hundred commercial reactors in the U.S. and the high-level radioactive waste from defense (military) programs. This book is intended for the wide dissemination of scientific information pertaining to the actual containment and isolation potential of the Yucca Mountain site amongst earth scientists, decision-makers, and the lay public. Hopefully, it will foster a strong, factual and therefore rational foundation for the decision making process. The book demonstrates that a multitude of indisputable lines of evidence, derived from the results of both the various geophysical measurements and the extensive analyses of the local geological record, indicate this mountain is situated in a region profoundly affected by the isostatically uncompensated (rising) and supra solidus (melting) sub-lithosphere mantle. This mantle acts therefore as a practically inexhaustible source of energy (potential gravitational, strain, and thermal) and matter (gaseous phases and basalt magma) being introduced into the corresponding geological system. As a consequence of that, it has the direct effect of causing long-term evolution of this system to proceed with the involvement of sequent evolutionary loops, each consisting of a long period of accumulations of various forms of energy and matter followed by a fairly brief period of releasing the accumulated energy and matter. It is in this manner that Yucca Mountain inevitably, at times, becomes what it actually represents: a mountain underlain by a steadily maturing thermodynamic "bomb." Although innate forms of this release evolve, the essential character remains the same in that it amounts to a diffusive outward transfer of the accumulated endogenic energy and matter, including the transformation and dispersion thereof into various kinds of mechanical and kinetic work, which could lead to catastrophic (life-endangering) releases of the entombed radioactivity directly into the atmosphere. In a nutshell, this book grapples with a question that has extraordinary moral and many other implications: Does the proposed repository represent a potential peril to future generations that is without precedence in the entire history of our civilization? On the one hand, the main purpose of this book is to demonstrate, at long last, that the indisputable facts allow for concluding the subject mountain is neither suitable nor licensable as a site of the proposed repository. On the other hand, the purpose is also to provide a fact-based foundation for ascertaining the wisdom of the anticipated attempts in the future, by both the nuclear industry and the newly constituted Donald Trump administration, to resurrect the Yucca Mountain Project, one way or the other.

Magmatic consequences are divided into an eruptive component, which pertains to the possibility of radioactive waste being erupted onto the surface of Yucca Mountain, and a subsurface component, which occurs whether there is an accompanying eruption or not. The subsurface component pertains to a suite of processes such as hydrothermal activity, changes in country rock properties, and long term alteration of the hydrologic flow field which change the waste isolation system. This paper is the second in a series describing progress on studies of the effects of magmatic activity. We describe initial results of field analog studies at small volume basaltic centers where detailed measurements are being conducted of the amount of wall rock debris that can be erupted as a function of depth in the volcanic plumbing system. Constraints from field evidence of wall rock entrainment mechanisms are also discussed. Evidence is described for a mechanism of producing subhorizontal sills versus subvertical dikes, an issue that is important for assessing subsurface effects. Finally, new modeling techniques, which are being developed in order to capture the three dimensional complexities of real geologic situations in subsurface effects, are described.

These reviews were submitted as reports to the Nuclear Waste Project Office, State of Nevada by Technology and Resource Assessment Corporation under Contract No. 92/94.0004. A copy of the review report by C.B. Archambeau was also sent to Dr. Frank Press, President of the National Academy of Sciences, along with a cover letter from Dr. Archambeau expressing his concerns with the NRC report and his suggestion that the Academy President consider a re-evaluation of the issues covered by the NRC report. Dr. Press responded in a letter to Dr. Archambeau in February of this year which stated that, based on his staff recommendations and a review report by Dr. J.F. Evernden of the United States Geological Survey, he declined to initiate any further investigations and that, in his view, the NRC report was a valid scientific evaluation which was corroborated by Evernden's report. He also enclosed, with his letter, a copy of the report he received from his staff. In March of this year Dr. Archambeau replied to the letter and NRC staff report sent by Dr. Press with a detailed point-by-point rebuttal of the NRC staff report to Press. Also, in March, a critical review of Dr. Evernden's report by M. Somerville was submitted to the Nuclear Waste Project Office of the State of Nevada and this report, along with the earlier review of the NRC report by Somerville et al., was included as attachments to the letter sent to Dr. Press.

Book excerpt: Passed in 1982, the Nuclear Waste Policy Act (NWPA) was an effort to establish an explicit statutory basis for the Department of Energy (DOE) to dispose of the nation's most highly radioactive nuclear waste. The NWPA requires DOE to remove spent nuclear fuel from commercial nuclear power plants, in exchange for a fee, and transport it to a permanent geologic repository or an interim storage facility before permanent disposal. Defense-related high-level waste is to go into the same repository. In order to achieve this goal, and in an effort to mitigate the political difficulties of imposing a federal nuclear waste facility on a single community, Congress attempted to establish an objective, scientifically based multi-stage statutory process for selecting the eventual site of the nation's new permanent geologic repository. Congress amended the NWPA's site selection process in 1987, however, and designated Yucca Mountain, Nevada, as the sole candidate site for the repository by terminating site specific activities at all other sites. The Obama Administration, in conjunction with DOE, has taken three important steps directed toward terminating the Yucca Mountain project. First, the Administration's FY2011, FY2012, and FY2013 budget proposals eliminated all funding for the Yucca Mountain project. Second, the President and Secretary of Energy Steven Chu established a Blue Ribbon Commission to consider alternative solutions to the nation's nuclear waste challenge. Third, and most controversial, DOE has attempted to terminate the Nuclear Regulatory Commission's (NRC's) Yucca Mountain licensing proceeding by seeking to withdraw the license application for the Yucca Mountain facility. DOE's withdrawal motion triggered strong opposition from a number of concerned parties. The states of Washington and South Carolina—each awaiting cleanup and removal of defense-related nuclear waste at the Hanford and Savannah River Sites, respectively—have played significant roles in the legal challenge to the license withdrawal. Claims challenging the Secretary's authority to withdraw the Yucca Mountain license application were filed with both the NRC and the U.S. Court of Appeals for the District of Columbia (D.C. Circuit). Although DOE's motion to withdraw the Yucca Mountain license application was denied by the NRC's Atomic Safety and Licensing Board, the NRC suspended the Yucca Mountain licensing proceeding in 2011 due to budgetary limitations. The D.C. Circuit has since dismissed a challenge to DOE's authority to withdraw the license application and heard oral arguments on claims challenging NRC's authority to terminate the licensing proceeding. While the result of the ongoing dispute over the legality of the attempted termination of the Yucca Mountain program remains uncertain, congressional action could have a significant impact on the fate of the Yucca Mountain facility. A number of leading House Republicans have voiced strong opposition to shutting down the Yucca Mountain facility. Consequently, the Yucca Mountain dispute will not only be contested before the NRC and the D.C. Circuit, but also in Congress.~
