Rawls aims to express an essential part of the common core of the democratic tradition--justice as fairness--and to provide an alternative to utilitarianism, which had dominated the Anglo-Saxon tradition of political thought since the nineteenth century. Rawls substitutes the ideal of the social contract as a more satisfactory account of the basic rights and liberties of citizens as free and equal persons. "Each person," writes Rawls, "possesses an inviolability founded on justice that even the welfare of society as a whole cannot override." A grande discordância e a veemência com a qual os críticos de Rawls atacam os seus argumentos acabam por ressaltar ainda mais a figura do filósofo norte-americano no pensamento atual, principalmente devido as adaptações de suas ideias nas obras posteriores. A obra geral de Rawls apresenta-se como último estágio na evolução do pensamento liberal, enfatizando a importância das instituições legais e políticas no contexto de sociedades caracterizadas pela pluralidade de doutrinas abrangentes. Neste trabalho, propõe-se uma reflexão geral da obra do autor, centrando a análise em um ponto crítico da obra do autor: as questões relativas à aplicação do direito (seja no âmbito interno ou externo) e ao papel do Estado na implementação prática dos princípios. Assim, pretende-se confirmar que, mesmo com a virada política proposta pelo autor, a ideia de garantir um mundo propício ao bem humano, orientada pelos princípios de justiça e pelo efeito positivo sobre a formação moral de seus cidadãos, permanece sendo a grande herança teórica do autor.
