Book excerpt: Over the last fifty years in the United States, unions have been in deep decline, while income and wealth inequality have grown. In this timely work, editors Richard Bales and Charlotte Garden - with a roster of thirty-five leading labor scholars - analyze these trends and show how they are linked. Designed to appeal to those being introduced to the field as well as experts seeking new insights, this book demonstrates how federal labor law is failing today's workers and disempowering unions; how union jobs pay better than nonunion jobs and help to increase the wages of even nonunion workers; and how, when union jobs vanish, the wage premium also vanishes. At the same time, the book offers a range of solutions, from the radical, such as a complete overhaul of federal labor law, to the incremental, including reforms that could be undertaken by federal agencies on their own.

Book excerpt: "The United States Code is the official codification of the general and permanent laws of the United States of America. The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. Grateful acknowledgment is made of the contributions by all who helped in this work, particularly the staffs of the Office of the Law Revision Counsel and the Government Printing Office"--Preface.

Book excerpt: The author is convinced that there is a ruling class in America today. He examines the American power structure as it has developed in the 1980s. He presents systematic, empirical evidence that a fixed group of privileged people dominates the American economy and government. The book demonstrates that an upper class comprising only one-half of one percent of the population occupies key positions within the corporate community. It shows how leaders within this "power elite" reach government and dominate it through processes of special-interest lobbying, policy planning and candidate selection. It is written not to promote any political ideology, but to analyze our society with accuracy.

Available in PDF, EPUB and Kindle. Book excerpt: Labour law has traditionally aimed to protect the employee under a hierarchy built on constitutional provisions, statutory law, collective agreements at various levels, and the employment contract, in that order. However, in employment regulation in recent years, ‘flexibility’ has come to dominate the world of work – a set of policies that reshuffle the relationship among the fundamental pillars of labour law and inevitably lead to degrading the protection of employees. This book, the first-ever to consider the sources of labour law from a comparative perspective, details the ways in which the traditional hierarchy of sources has been altered, presenting an international view on major cross-cutting issues followed by fifteen country reports. The authors’ analysis of the changing hierarchy of labour law sources in the light of recent trends includes such elements as the following: the constitutional dimension of labour rights; the normative intervention by the State; the regulatory function of collective bargaining and agreements; the hierarchical organization of labour law sources and the ‘principle of favour’; the role played by case law in both common law and civil law countries; the impact of the European Economic Governance; decentralization of collective bargaining; employment conditions as key components of global competitive strategies; statutory schemes that allow employees to sign away their rights. National reports – Australia, Brazil, China, Denmark, France, Germany, Hungary, Italy, Poland, Russia, Spain, Sweden, South Africa, the United Kingdom and the United States – describe the structure of labour law regulations in each legal system with emphasis on the current state of affairs. The authors, all distinguished labour law scholars in their countries, thus collectively provide a thorough and comprehensive commentary on labour law regulation and recent tendencies in national labour laws in various corners of the globe. With its definitive analysis of such crucial matters as the decentralization of collective bargaining and how individual employment contracts can deviate from collective agreements and statutory law, and its comparison of representative national labour law systems, this highly informative book will prove of inestimable value to all professionals concerned with employment relations, labour disputes, or labour market policy, especially in the context of multinational workforces.

Available in PDF, EPUB and Kindle. Book excerpt: An update to the classic history of labor and unions for a post-9/11 world. Highly acclaimed and widely read since its first publication in 1986, American Workers, American Unions provides a concise and compelling history of American workers and their unions in the twentieth century and the first decade of the twenty-first. Taking into account recent important work on the 1970s and the Reagan revolution, the fourth edition newly considers the stagflation issue, the rise of globalization and big box retailing, the failure of Congress to pass legislation supporting the right of public employees to collective bargaining, the defeat in Congress of legislation to revise the National Labor Relations Act, the emasculation of the Humphrey-Hawkins Act, and the changing dynamics of blue-collar politics. In addition to important new information on the 1970s and 1980s, the fourth edition contains a completely new final chapter. Largely written by Timothy J. Minchin, this chapter provides a rare survey of American workers and their unions between 9/11 and the 2012 presidential election. Gilbert J. Gall presents new information on government workers and their recent battles to defend workplace rights.

This book was released on 2018-10-06 with total page 252 pages. Available in PDF, EPUB and Kindle. Book excerpt: This abridged version of the United States Code Annotated is written for those persons wishing to know more about the laws as they apply to Labor Organizations and their member's rights. Thus it is about the National Labor Relations Act, the National Labor Management Act, and the National Labor-Management Reporting and Disclosure Act. This work will, if read front to back, give you a striking understanding of how the Federal Courts are interpreting these laws. The dull repetition in the original work is not here, here every case covers a distinct angle of the law. If you read only one book on Labor law as it applies to Unions, this work is the best thing to read. There is no conjecture, nor speculation, here you will only find the law.As regards the last section of this book dealing with the criminal codes, one of the stated purposes for the racketeering codes was to eliminate Mafia control and influence of Labor Organizations. Thus, there are very important reasons to study these Codes. Blacklisting by Unions is a common tactic used to keep memberships pliable and obedient, and to punish dissenters. This activity can be "Witness Tampering" and carries a twenty-year prison term and a $250,000 fine under the RICO Act, and it is always interference in interstate commerce to denying the Blacklisted person his right to enter into interstate commerce to obtain Wages, Profits, Sales, or Contracts, as due process allows. The taking of dues from members greater than the law allows is also common and can amount to Extortion. Denying Union dissenters the right to democratic participation also may qualify as Extortion.Unionism has become big business, and so, corrupt. This section will provide you with a basic understanding of the Racketeering Codes and how they apply to Unions, but that is all. The vast breath of the Racketeering Codes are not addressed here, for this book is not about Racketeering. As one Lawyer said to me after reading this section of the book "This is big!" Indeed, the Racketeering Codes are our most powerful weapon against illegal Union and Employer acts. Learn the law, and use it whenever possible. Happy Reading.
