D'une part, le Conseil de l'Europe a produit d'autres instruments juridiques de protection des droits assortis de mécanismes de protection, comme la Charte sociale européenne. D'autre part, la place de la protection des droits fondamentaux s'est progressivement accrue depuis les années 70 dans les Communautés européennes, devenues l'Union européenne. Le signe majeur de cette place désormais centrale est l'entrée en vigueur, en 2009, de la Charte des droits fondamentaux de l'Union européenne. Enfin, cette protection est assurée, au premier chef, par les autorités nationales et plus particulièrement par le juge national, juge de droit commun du respect des droits fondamentaux européens. Le présent ouvrage entend rendre compte de cette protection européenne des droits fondamentaux au sens large, en intégrant les enjeux et les défis qu'implique la pluralité de ces systèmes européens de protection des droits fondamentaux. Il s'adresse aux étudiants en droit mais également aux universitaires et praticiens du droit, ainsi qu'à toute personne ayant un intérêt pour la problématique des droits de l'Homme et des libertés individuelles.

Although the Court's jurisprudence has provoked significant structural, procedural, and policy innovation in every State examined, its impact varies widely across States and legal domains. The book charts this variation and seeks to explain it. Across Europe, national officials - in governments, legislatures, and judiciaries - have chosen to incorporate the ECHR into domestic law, and they have developed a host of mechanisms designed to adapt the national legal system to the ECHR as it evolves.
