Book excerpt: Il problema della rilevanza penale del trattamento medico arbitrario, ossia della condotta terapeutica realizzata a regola d’arte ma senza il consenso del paziente, ha dato vita nella dottrina penalistica a un vivace dibattito, all’interno del quale si sono confrontate le più diverse ricostruzioni dogmatiche. Queste si sono soffermate, oltre che sulle conseguenze penali da riconoscere al trattamento arbitrario, soprattutto sul fondamento giustificativo dell’intera professione medica, individuato alternativamente in svariati ambiti dell’antigiuridicità o in sede di tipicità. Le varie soluzioni prospettate non sono riuscite però a porre fine al dibattito, che ha avuto ripercussioni sulla giurisprudenza, la quale, dopo la pronuncia delle Sezioni Unite della Suprema Corte del 2009, vive una quiete solo apparente. Il volume, partendo dalla multidimensionalità etica che caratterizza la professione sanitaria, suggerisce una chiave di lettura che possa tener conto dell’eterogeneo fondamento morale della medicina. A tal fine, accertato che tale variegato quadro etico non assume rilevanza sul solo piano dell’antigiuridicità, il testo esorta ad abbandonare l’approccio rigidamente naturalistico allo studio della tipicità, ad oggi dominante, in favore di una chiave di lettura che sia capace di cogliere l’effettivo disvalore della condotta arbitraria. La ricostruzione proposta, letta unitamente alla centralità oggi indiscussa del consenso del malato, permette di meglio conciliare l’ottica personalistica della medicina moderna con il suo riconosciuto valore sociale.

In that report, Defining Death: Medical, Legal and Ethical Issues in the Determination of Death, the President's Commission forwarded a uni form determination of death act, which laid heavy accent on the signifi cance of the brain stem in determining whether an individual is alive or dead: An individual who has sustained either (1) irreversible cessation of circulatory and respiratory functions, or (2) irreversible cessation of all functions of the entire brain, including the brain stem, is dead. A determination of death must be made in accordance with accepted medical standards ([1], p. 2). The plausibility of these criteria is undermined as soon as one confronts the question of the level of treatment that ought to be provided to human bodies that have permanently lost consciousness but whose brain stems are still functioning.
