Legal method is an important area of study for two main reasons. First, it is important for the range of techniques that it can offer to break into legal texts, both primary and secondary. Secondly, it exposes reasoning processes concerned with the theory and practise of law. The book deals in both the areas mentioned, and aims to deal with issues of.

Book Synopsis Federalism and Political Restructuring in Nigeria by : Kunle Amuwo
Download or read book Federalism and Political Restructuring in Nigeria written by Kunle Amuwo and published by . This book was released on 1998 with total page 388 pages. Available in PDF, EPUB and Kindle. Book excerpt: Twenty essays by four generations of Nigerian scholars are included in this volume, the first to examine the historical, political, economic and comparative dimensions of attempts by the military to restructure the Nigerian federation. Evidence is accumulated in support of the book's central thesis that autocratic rule is antipathetic to the sustenance of genuine federal practice, and that federal restructuring initiated under the tight control of repressive governments cannot but lead to a situation in which federalism is assaulted, if not dismantled. It is argued that, in such a context, the vending of a federal doctrine becomes more or less an exercise in the propagation of false consciousness in the service of power - portraying a picture of divided power to hide the reality of undivided power.

Book Synopsis Women, Law and Human Rights by : Fareda Banda
Download or read book Women, Law and Human Rights written by Fareda Banda and published by Bloomsbury Publishing. This book was released on 2005-10-04 with total page 454 pages. Available in PDF, EPUB and Kindle. Book excerpt: Africa, with its mix of statute, custom and religion is at the centre of the debate about law and its impact on gender relations. This is because of the centrality of the gender question and its impact on the cultural relativism debate within human rights. It is therefore important to examine critically the role of law, broadly constructed, in African societies. The book focuses on women's experiences in the family. This is because the lives of women continue to be lived out largely in the private domain, where the right to privacy is used to conceal unequal treatment of women which is justified by invoking 'custom' and 'tradition'. The book shows how law and its interpretation is used to disenfranchise women, resulting in their being deprived of land and other property which they may have helped to accumulate. It also considers issues of violence within the home, reproductive rights and examines the issue of female genital cutting. The role of women in development is explored as is their participation in politics and the NGO sector. A major theme of the book is a consideration of the linkages of constitutional and international human rights norms with local values. This is done using feminist tools of analysis. The book considers the provisions of the Protocol to the African Charter on Human and People's Rights on the Rights of Women which was adopted by the African Union in July 2003.

Book excerpt: "Mediation is not a soft option for the advocate. If you are unprepared, if you do not know what to expect, if you do not know what you are doing, your client will be at a considerable disadvantage and you will come unstuck. This book is aimed at lawyers and other professional advocates who represent clients in mediation. It is written not only for ""first-timers"" needing to learn about the basics of mediation very quickly, particularly as to what they should expect and how they should prepare. More seasoned advocates wishing to specialise in mediation advocacy and who want to develop the particular skills that it requires will also find it invaluable. ""The advocacy skills necessary in a mediation are quite different from those required for the (usually civilised) battle that takes place in a courtroom. That is why Mediation Advocacy is such a valuable book. It gives a great deal of very useful advice as to how to prepare for and conduct a mediation from beginning to end. It is an
