This edited volume explores how chieftancy is practised, experienced and contested in contemporary South Africa. Set against a backdrop of widespread security threats – including insurgency, land disputes, communal violence, regional independence movements, and widespread criminal activities – perhaps more than ever before, Nigeria’s conventional security infrastructure seems ill-equipped for the job. This book offers a fresh, empirical analysis of the roles of traditional authorities – including kings, Ezes, Obas, and Emirs – who are often hailed as potent alternatives to the state in security governance. It complicates the assumption that these traditional leaders, by virtue of their customary legitimacy and popular roots, are singularly effective in preventing and managing violence. Instead, in exploring their creative adaptation to governance roles after a dramatic postcolonial downturn, this book argues that traditional leaders can augment, but not substitute, the state in addressing insecurity. Freely translated, this proverb of the Ovakwanyama of northern Namibia means: "New leaves produce a good shade; the laws of a king are always as good as new". The proverb paints a picture of wisdom to express the dialectical relationship between continuity and change in customary law. Since royal orders are supposed not to change from one king to the next, they are always as good as new, reads the explanatory note to the proverb by the anthropologist Loeb, who recorded the proverb. Traditional authority is like a tree standing on its roots, rooted in the tradition created by the ancestors of the ruler and the community. These roots remain firm, stable and unchanged, not so the concrete manifestation of authority that changes and responds to changes of the environment. This makes that new leaves are produced by the rooted tree. The new leaves are new and old. They are old, because in structure, colour and their capacity to protect by giving shade, they are more or less like the leaves of last year and the year before; they are new because they react to the challenge of seasons. The Shade of New Leaves emerged out of an international conference on the living reality of customary law and traditional governance held in Windhoek in 2004. The conference was organised by the Centre for Applied Social Sciences and the Human Rights and Documentation Centre, both affiliated to the Faculty of Law of the University of Namibia, in co-operation with the Law Departments of the Universities of Bremen, Germany, and the School of Oriental and African Studies, University of London. This discussion paper addresses some fundamental questions pertaining to the 2002 official recognition of traditional leaders as community authorities. After a brief history of the changing role of, and faith in, traditional authorities as a basis for understanding the importance of their recent official recognition, the paper outlines the key objectives of the Decree 15/2000 that officially recognizes community authorities. Some of the key concepts underpinning the Decree are then critically assessed. It is argued that the double role that community authorities are expected to fulfill as both community-representatives and state-assistants is not equally balanced in the Decree: the scale tips heavily towards the state-assistance aspect. The reasons for this are explored in the context of a set of reified notions underpinning the Decree, such as its understanding of "traditional rules" and the concept of "community." The paper concludes by pointing out some unintended consequences of these reified notions for kin-based forms of community authority and especially for the ideal of community participation.

In thisperspective, fact is a continually contested and volatile social category. Ironically, chiefs' undemocratic character gives them a capacity to organize responses to rural problems that elected politicians and state institutions lack. Specifically, chiefs' longer time horizons encourage investment in local institutions that enable the provision of local public goods. This is the paradox of traditional chiefs in democratic Africa: elected politicians can only effectively respond to rural constituents through institutions constructed and maintained by local leaders who are not worried about electoral terms. Furthermore, the critical role played by chiefs in brokering local development projects forces us to reassess how we understand the basis of their political influence during elections. The book examines the effects of traditional leaders on the electoral connection in Africa through a multi-method approach that combines qualitative research, surveys, and experiments, with particular attention to the Zambian case.

International policy is currently witnessing a renewed interest in customary tenure systems as well as traditional leadership, through which it aims to enhance the efficiency of local governance and create general access to and secure rights in land. Contrary to these ideas, practice reveals a lack of security of customary tenure in areas with a high competition for land. Mounting evidence displays that customary systems often evolve inequitably and that traditional elites benefit disproportionally from commodification of land. In an effort to understand customary land management by traditional authorities and the role policymakers, lawmakers, judges and civil servants play in this process, this book studies practices of land management in peri-urban Ghana where traditional leadership forms a vibrant part of social life. This book combines local case studies with theories about efficient land management, the resilience of traditional leadership, the negotiability of customary law and the gap between judges' customary law and local practices. Doing so, it offers a unique body of empirical and theoretical knowledge for those interested in customary land management, as well as those interested in how customary law functions both at the local level and at the level of the state.
