This article explores the potential of trade unions as the other in political CSR and the contribution of trade unions to deliberative democracy with the firm. We discuss the importance both of the legitimacy and the efficacy of the other in political CSR. We proceed to assess trade unions as legitimate and effective deliberative partners with the firm towards CSR, evaluating the contribution of trade unions to deliberative democracy and also the potential outcomes for trade unions in adopting this role.

Book excerpt: Trade unions in Europe have showed a mixed response to Corporate Social Responsibility (CSR) and have adopted a broad spectrum of positions on CSR. Prior research has identified five distinct positions of trade unions across Europe. The key argument is that the whole process is linked to neoliberalism and the outcome of neoliberal approach is deregulation. Withdrawal of state from regulation of businesses has created a vacuum of regulation and there are inadequate governance mechanisms available at all levels. Businesses have tried to fill this vacuum by engaging in CSR. Trade unions are apprehensive of CSR due to its voluntary nature and some see CSR as a threat because there is evidence that adoption of CSR as an alternative to binding regulations has hampered trade union power. Trade unions are trying to develop some supranational regulatory institutions and development of IFAs is an evidence of that. Trade unions are advised to broaden their agenda by adding non-traditional items such as climate change that might possibly provide further legitimacy to trade unions.

Book excerpt: Voluntary sustainability standards (VSS) and other private governance instruments (e.g., Fair Trade, Forest Stewardship Council, Fair Wear Foundation, GLOBALGAP) are increasingly regulating global production processes and economic activities. VSS verify the compliance of products or production processes with sustainability standards. The importance of voluntary sustainability standards is now widely recognized. After being operational for more than two decades, they have established themselves as private governance instruments. This recognition is also exemplified by their integration in public regulatory approaches. Governments and international organizations are partnering with voluntary sustainability standards to pursue sustainable development policies. We witness the integration of VSS in the regulatory approaches of local and national governments in countries around the world, the integration of VSS in trade policies, the emergence of public–private initiatives to govern global supply chains, and the inclusion of private initiatives in experimentalist governance regimes. This Special Issue seeks to bring together research on the interface between private and public governance. We welcome contributions which analyze specific case studies on the emergence and development of these private–public interactions, the design of public–private governance, the effectiveness of these governance arrangements, and critical perspectives on the possibilities and limitations of such public–private forms of governance. We welcome multi-disciplinary perspectives including contributions from economics, political science, law, sociology, geography, and anthropology. Papers selected for this Special Issue are subject to a peer review procedure with the aim of rapid and wide dissemination of research results, developments, and applications.

The rise of the business sector as a powerful global actor with a claim to participation and potential contributions as well as adverse impacts sustainability complicates the regulatory challenge. Recent decades’ efforts to govern transitions towards sustainability through public or hybrid regulation display mixed records of support and results. In combination, these issues highlight the need for insights on what conditions multi-stakeholder regulation for a process that balances stakeholder power and delivers results perceived as legitimate by participants and broader society. This book responds to that need. Based on empirical experience on public-private regulation of global sustainability concerns and theoretical perspectives on transnational regulation, the book proposes a new theory on collaborative regulation. This book focuses on a crucial dynamic in private efforts at regulating labor standards in international production chains. It addresses questions regarding the quality of rules (Are existing efforts to privately regulate labor standards credible?) as well as business demand for private regulation (To what extent are different types of regulation adopted by companies?). This volume seeks to understand the underlying issue of whether private regulation can be both stringent and popular with firms. The study analyzes the nature and origins of, the business demand for and the competition between all relevant private regulatory organizations focusing on clothing production. The argument of the book focuses on the interaction between activists and firms, in consensual (developing and governing private regulatory organizations) and in contentious forms (activists exerting pressure on firms). The book describes and explains an emerging divide in the effort to regulate working conditions in clothing production between a larger cluster of less stringent and a smaller cluster of more stringent private regulatory organizations and their supporters. The analysis is based on original data, adopting both comparative case study and inferential statistical methods to explain developments in apparel, retail and sportswear sectors.
