Such a strategy recognizes that no one specific tool will deter, disrupt or prevent the illicit activities of terrorists, proliferators, insurgents, organized criminals or other transnational threats, and that employing a variety of instruments in a coordinated fashion is likely to produce the best results. However, one tool that shows particular promise, especially when used in concert with other policy tools, is combating the financing of transnational threats. Combating illicit financing can be effective, depending on the target, at three levels: deterrence, prevention and disruption. Freezing terrorist funds, for example, has a deterrent effect on major donors, pressing financiers to rethink their support because of the potential hindrance to their day-to-day business activities. Countering terrorist financing will not dry up all the funding available to terrorists, but it is an effective and efficient means of constricting our adversaries’ operating environment by making it difficult to fund illicit activities. The financial sector provides reliable and substantive intelligence to investigators tracing money both upstream and downstream, from funding sources to potential operators. Following the “money trail” enables authorities to thwart attacks, and despite the difficulty of permanently disabling terrorist entities, disrupting their financial transactions constrains their ability to function. Weapons proliferation, especially in the area of missile technology and weapons of mass destruction (WMD), is extremely expensive. Similarly, insurgencies require significant funding, as do organized terrorist groups, which require extensive resources to train, equip and pay operatives; bribe officials; support members’ families; secure materials; and publicly promote their cause. Since even inexpensive attacks require funding, small-scale interventions can effectively thwart terrorists if they are unable to access necessary funds when and where they need them. Since the 9/11 attacks the terrorist threat has evolved structurally and financially. Globalization has exponentially increased the flow of transactions through the international financial system, in part making it easier to conduct illicit transactions in plain sight.

Book excerpt: The single greatest threat to U.S. homeland security remains the proliferation of nuclear weapons, especially among terrorists and other non-state actors who are not governed by the Non-Proliferation Treaty. One of the most important tools for combating terrorism among such rogue actors is counter-financing. Without funding, terrorists cannot acquire, maintain, or deploy nuclear weapons. According to the official report of the 9/11 Commission, counter-financing could have prevented the attacks of September 11, 2001. Unfortunately, no single country can defeat global terrorism. Successful counter-financing requires significant international cooperation. Since 2001, the United States and the European Union, despite vastly different approaches to intelligence gathering, have shared information through the Terrorist Finance Tracking Program (TFTP). That shared information allows authorities to trace suspicious transactions, identify culprits, and map out global terrorist networks. The TFTP successfully thwarted a 2011 plot to assassinate the Saudi Arabian Ambassador to the U.S. and multiple threats during the 2012 Summer Olympics in London; it also aided in the investigation of the 2013 Boston Marathon bombing. That program is necessary but not sufficient. To strengthen our ability to detect and disrupt terrorist plotting and prevent nuclear proliferation, we must expand and coordinate two additional transnational measures: (1) the Society for Worldwide Interbank Financial Telecommunications (SWIFT), a standardized global messaging network for financial institutions to quickly, accurately, and securely send and receive money transfer instructions, and (2) International Bank Account Numbers (IBAN) to identify individual accounts involved in international transactions. Both initiatives were incompletely adopted in the wake of 9/11, but most global banks use one or neither. More fully implementing and coordinating these two systems would allow for coherent information sharing, an essential tool for combating money laundering and terrorist financing, verifying sanctions against rogue nations and non-state actors, tracking nuclear proliferation networks, and protecting dual-use materials. These steps can save lives without interfering with state sovereignty or individual rights. The specter of nuclear threat is real and constant. This paper will provide forensic analysis of the most effective financial tools and policies to combat that threat, placing special emphasis on multinational and public-private cooperation.

The approval of Executive Order 13224 on September 24, 2001, marked a bold initial step toward targeting terrorists' financial networks. The success of terrorist organizations is dependent upon these financial networks because even though terrorist attacks are not necessarily expensive, the support of international terrorist networks, training camps, command and control, and infrastructure requires either a large reserve of available finances or the ability to raise significant funding. Because terrorist organizations must raise, move, and use money, aggressively pursuing terrorists on a financial front can and should be an integral component of any counterterrorism strategy. There are three different but interrelated dimensions of this front that either target terrorists' financial networks or capitalize on their dependency on finances. First, the government can freeze and block financial assets by labeling individuals or organizations as terrorists or as being associated with terrorism. These actions degrade terrorists' access to funds and increase the costs of raising, transferring, and using funds. Second, tracking the movement of funds among individuals in terrorist groups and their supporters provides verifiable indications of associations, relationships, and networks. Third, many of the acts in which terrorist networks engage to raise and move funds are illegal. Terrorists and their financial supporters frequently commit illegal fund raising, money laundering, tax evasion, fraud, and international currency violations. Thus, prosecuting individuals for financial crimes can be an effective strategy. With this framework the authors examine some of the actions taken and lessons learned by the multiple agencies, corporations, and individuals that have played critical roles in the financial war on terrorism.
