Until this thoroughly researched book, the criteria and factors against which international dispute bodies assess such claims have remained unclear. Now, by providing an in-depth comparative analysis of relevant jurisprudence under four distinct international dispute resolution systems – trade, investment, human rights and international commercial arbitration – the author of this invaluable book identifies common core benchmarks for the application of the public order exception. To achieve the broadest possible scope for her analysis, the author examines the public order exception’s function, role and application within the following international dispute resolution systems: relevant World Trade Organization (WTO) agreements as enforced by the organization’s Dispute Settlement Body and Appellate Body; international investment agreements as enforced by competent Arbitral Tribunals and Annulment Committees under the International Center for Settlement of Investment Disputes; provisions under the Inter-American Convention of Human Rights and the European Convention of Human Rights as enforced by the Inter-American Court of Human Rights and the European Court of Human Rights, respectively; and the New York Convention as enforced by national tribunals across the world. Controversies, tensions and pitfalls inherent in invoking the public order exception are elucidated, along with clear guidelines on how arguments may be crafted in order to enhance prospects of success. Throughout, tables and graphs systematize key aspects of the relevant jurisprudence under each of the dispute resolution systems analysed. As an immediate practical resource for lawyers on any side of a dispute who wish to invoke or strengthen a public order exception claim, the book’s systematic analysis will be welcomed by lawyers active in WTO disputes, international investment arbitration, human rights law or enforcement of foreign arbitral awards. You can't afford such a Climate Suit, as they are called, so you try to get your errands done even though you can barely breathe. You're sweating all over your body, but so is everyone else who is not wearing a Climate Suit, which is most people at the time. There is some relief at night, but even nights are hot enough so that you can't get any sleep unless you spray yourself with water every few minutes. You turn your air conditioning unit on its highest setting, but there is not enough electricity to keep it running for more than a few minutes because it's being rationed everywhere. Your best friend, the family dog has been put down because the heat is now too much for any furry animals and most of them are dying by the billions, their carcasses littering the streets. There is no one to pick up their bodies because no one has that much energy for non-essential things. The TV news tells you that the government is working feverishly on the problem of the growing heat wave. Gas powered cars and trucks have been abandoned long ago. So, part of the problem is that there is no industrial infrastructure any more that can construct enough solar panels and wind turbines because there isn't enough food for workers or electrical power to manufacture anything at this point and everyone knows it would just add to the growing pollution of the air. All the trees have died out, or been used for heating and cooking years ago, the only natural element that could have saved us. Everyone lives hour by hour expecting the President to come on TV and finally admit that these are the final days for the stubborn lot of remaining citizens to stay alive. Soon, all oxygen will be depleted. When the President finally comes on the air and starts to finally admit to these things. you can feel the last few molecules of oxygen as they leave your lungs and makes you gasp your last gasp. This is the TIME BOMB. It's ticking down right now to the end of our existence here on Planet Earth. There is hope, although it is a fading one, and only if everyone within the sound of my voice learns how to defuse this FINAL TIME BOMB and begins taking the necessary actions listed in this book that can and will stop it ticking STARTING NOW!

In this book, Jennifer Thomson untangles the complex web of political, social, and intellectual developments that gave rise to the multiplicity of claims and concerns about environmental health. Thomson traces four strands of activism from the 1970s to the present: the environmental lobby, environmental justice groups, radical environmentalism and bioregionalism, and climate justice activism. By focusing on health, environmentalists were empowered to intervene in the rise of neoliberalism, the erosion of the regulatory state, and the decimation of mass-based progressive politics. Yet, as this book reveals, an individualist definition of health ultimately won out over more communal understandings. Considering this turn from collective solidarity toward individual health helps explain the near paralysis of collective action in the face of planetary disaster.
