However, some state scope of practice laws limit the ability of nurse practitioners to deliver care by requiring physician supervision of their practices and prescribing activities. A robust literature has evolved around examining the role of these scope of practice laws in various contexts, including labor market outcomes, healthcare access, healthcare prices, and the delivery of care for specific diseases. Unfortunately, these studies use different, and sometimes conflicting, measures of scope of practice laws, limiting their comparability and overall usefulness to policymakers and future researchers. We address this salient problem by providing a consistent coding of nurse practitioner scope of practice laws over a 23-year period based on actual statutory and regulatory language. Our classification of scope of practice laws solves an important problem within this growing literature and provides a solid legal foundation for researchers as they continue to investigate the effects of these laws.

On average, 22% of state populations are living in primary care health professional shortage areas. There are over 158,000 nurse practitioners that can meet the demand for health care providers. They are educated in diagnosing and managing common acute and chronic diseases across the lifespan, ordering diagnostic tests, prescribing medications, and performing minor procedures. Most practice in primary care. A review of the literature supports that nurse practitioners deliver safe, cost-effective primary care and should be used. Nurse practitioners could help fill gap between the supply and demand for primary care providers. The scope of practice for nurse practitioners is determined by state law. Even though education requirements are similar across all states, laws for nurse practitioners range from permitting independent practice to requiring physician supervision. This is problematic because in many states nurse practitioners are not allowed to practice to the full extent of their education and training. This paper examines the variation in state laws for nurse practitioners from all 50 states and the District of Columbia. State laws as of January 2012 were accessed from Board of Nursing websites. A ranking criteria was developed to score the restrictiveness of each state's law based on the following characteristics: regulation of nurse practitioners, practice authority and prescriptive authority. States were categorized as being unrestrictive, minimally restrictive, moderately restrictive, or highly restrictive. Nine states had unrestrictive laws for nurse practitioners, twenty-three states had minimally restrictive laws, and sixteen states had moderately restrictive laws, while only three states had highly restrictive laws. The association between the restrictiveness of state nurse practitioner laws and several state characteristics were also examined. State characteristics were obtained from secondary sources and included: state population, region of the United States, number of nurse practitioners per 100,000 people in each state, percentage of the state population living in a primary care health professional shortage area, and male to female earnings ratio. Only state population and region were significantly correlated to the degree of restrictiveness of state laws. Western states and states with smaller populations had less restrictive laws. State policymakers can use the results of this study to see how their laws compare to other states and identify the specific features of their laws that can be amended to promote the independent practice of nurse practitioners. Changing restrictive laws will help reduce access to care barriers for the underserved and potentially lower health care costs. With the vi increasing demand for health care providers, it is imperative that nurse practitioners be allowed to practice to their full scope of their education and training.

Physician groups have argued against this change, citing patient safety concerns. In this paper, we use a ratio-in-ratio approach to evaluate whether the transition to full practice authority results in harm to patients as proxied by rates of malpractice payouts and adverse action reports against nurse practitioners. We find no evidence of such harm, and instead find that physicians may benefit from the law change in terms of reduced malpractice payouts against them.

Such revisions reflect the expanded qualifications and abilities of nurse practitioners and provide a mechanism by which to better utilize the full scope of nurse practitioner services that are available to address growing demands for access to health care. Although the research literature is beginning to describe strategies that states have used to successfully achieve regulatory changes to full practice authority for nurse practitioners, no published study identified in the literature has explored how stakeholders within a state decide on the appropriate time to pursue such legislation. This is the first known study to use an embedded single case study design, guided by the Kingdon (2011) policy stream model, to provide a detailed account of how stakeholders for nurse practitioner full practice authority in one stated determined the appropriate time to pursue legislative changes to nurse practitioner scope of practice regulations. Qualitative data analysis was guided by Yin (2014), and used theoretical propositions, the development of a case description, pattern matching, and explanation building. Findings from the study addressed the research question by revealing four themes which included the components considered by the study state's stakeholders as they determined the appropriate time to pursue legislation to change nurse practitioner scope of practice regulations. Study findings can be used as a reference to increase the competency with which the nursing profession pursues the policy process for full practice authority legislation, and can be used by stakeholders in other states as a guide for the assessment components to consider when making decisions to pursue related legislation."--Abstract from author supplied metadata.
