Book excerpt: Founded by French military entrepreneur Antoine Laumet de Lamothe Cadillac in 1701, colonial Detroit was occupied by thousands of French settlers who established deep roots on both sides of the river. The city's unmistakable French past, however, has been long neglected in the historiography of New France and French North America. Exploring the French colonial presence in Detroit, from its establishment to its dissolution in the early nineteenth century, Fruits of Perseverance explains how a society similar to the rural settlements of the Saint Lawrence valley developed in an isolated place and how it survived well beyond the fall of New France. As Guillaume Teasdale describes, between the 1730s and 1750s, French authorities played a significant role in promoting land occupation along the Detroit River by encouraging settlers to plant orchards and build farms and windmills. After New France's defeat in 1763, these settlers found themselves living under the British flag in an Aboriginal world shortly before the newly independent United States began its expansion west. Fruits of Perseverance offers a window into the development of a French community in the borderlands of New France, whose heritage is still celebrated today by tens of thousands of residents of southwest Ontario and southeast Michigan.

Book excerpt: The European Convention for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment was adopted by the Committee of Ministers of the Council of Europe in June 1987. It entered into force in February 1989 and all 47 member States are Parties to the Convention. The Convention has already established itself as an important human rights instrument. Its approach is quite different from that of the European Convention on Human Rights. Whereas the ECHR provides a remedy for particular human rights violations after the event, the Convention for the Prevention of Torture (ECPT) seeks to prevent human rights violations, through a system of visits to places of detention. The Convention is intended to be an integrated part of the Council of Europe system for the protection of human rights, placing a proactive non-judicial mechanism alongside the reactive judicial mechanism established under the ECHR. The Yearbook of the European Convention for the Prevention of Torture offers an essential annual overview of developments in relation to the ECPT. Part One contains information on ratifications and other such issues in the authentic English and French texts. Part Two has details in English and French of the membership and activities of the Convention. Part Three reprints the twentieth annual General Report of the ECPT in the official English and French texts. Part Four contains the ECPT's reports to States and the State responses thereto that were made public during the year in question. The ECPT's reports are published in the official English and/or French texts and State responses in the English and/or French versions submitted by the States concerned. Territorial States are normally affected most strongly by core international crimes committed during a conflict or an attack directed against its civilian population. Most victims reside in such States. Most damaged or plundered property is there. Public order and security are violated most severely in the territorial States. It is also on their territory that most of the evidence of the alleged crimes can be found. There are, in other words, obvious policy and practical reasons why States should accord priority to territoriality as a basis of jurisdiction. But is there also an obligation for States to defer exercise of universal jurisdiction of core international crimes to investigation and prosecution of the same crimes by the territorial State? What - if any - is the impact of the principle of complementarity in this respect? These are among the questions discussed in this anthology.
