Available in PDF, EPUB and Kindle. Book excerpt: This book of essays champions tort scholarship that puts judges at centre stage: what they do, how they understand their role, the heterogeneous reasons they give for their decisions, and their constitutional responsibility to identify and articulate the 'living' and 'evolving' common law. This is 'reflexive tort scholarship'. Reflexive tort scholars seek dialogue with Bench and Bar. Their approach is very different from the currently fashionable academic search for 'grand theories' that descriptively assert that tort law is fundamentally 'all about one thing', a unifying idea that alone explains and justifies the whole of tort law. This book illustrates the advantages and pay-offs of the reflexive style of scholarship by showing how it illuminates key features of tort law. The first essay contrasts the reflexive approach with the Grand Theory approach, while the second essay identifies a principle of tort law (the 'cooperative principle'), that is latent in the cases and that vindicates the value of collaborative human arrangements. Identifying this principle calls into question, in disputes between commercial parties, the reasoning used to support one of the most entrenched lines of authority in tort law - that based on the famous case of Hedley Byrne v Heller. The final essay deploys the reflexive method to argue that the iconic 'but-for' test of factual causation is inadequate and narrower than the concept actually utilized in the cases. Application of the method also prompts a reassessment of the 'scope of duty' concept and of the appropriate characterisation of the much-discussed decision in SAAMCO. These essays, based on the 2018 Clarendon Law Lectures given at Oxford University, clearly demonstrate the value of scholarship that 'takes the judges seriously'.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores how digital transformation is reshaping the manner in which higher education sectors emerge, work, and evolve and how auditors should respond to this challenging and risky digital audit universe in transforming the higher education system. It serves to help professionals to understand the reality of performing the Chief Audit Executive (CAE) role in today’s evolving business economy, specifically in the higher education sector. It compares and contrasts the stated IIA standards with the challenges and realities auditors may face and provides alternative scenarios to gaining a "seat at the table." This book also provides insight into critical lessons learned when executing the CAE role relevant for digitally transforming universities. The main purpose of this study is to rethink the audit culture in the digital era and reveal the key characteristics that are open for improvement so that digitally transforming universities can be audited according to the higher education standards with a digitally supported value-added audit approach. Based on this approach, the audit culture is reassessed considering the digital university conceptual framework and business model. There are two main points to consider for the digital university work environment: traceability and auditability. In this respect, policy recommendations are made for best practices to achieve value-added digital audits in transforming universities. The book has been written from both the reality and academic perspectives of two experienced authors. Sezer is a past CAE, CEO, and long-term senior internal auditor who has worked in the internal audit role for various listed companies, financial institutions, and government entities. Erman has extensive information technology and university accreditation knowledge in the global higher education sector. This brings a blend of value-added approaches to the readers and speaks to issues about understanding and dealing with audit culture and business evolution in digitally transforming organizations along with the requirements for upholding IIA standards. Geared toward the experienced or new CAE, University Auditing in the Digital Era: Challenges and Lessons for Higher Education Professionals and CAEs can be a tool for all auditors to understand some of the challenges, issues, and potential alternative solutions when executing the role of university auditing. In addition, it can be a valuable reference for university administrators and CIOs, as well as academics and all stakeholders related to the higher education sector.

Available in PDF, EPUB and Kindle. Book excerpt: The effectiveness of internal audit activities is important for the sustainability of change in the public sector. In this sense, the tools and techniques used and the level of competencies of public sector auditors are decisive. This book deals with the effects of current technological developments in the public sector on auditing and risk management activities. Therefore, it is a resource for public internal auditors to create a digital audit strategy based on artificial intelligence (AI) and blockchain-based applications. Institutionalisation of their structures is important for public sector internal auditors. For this, basic requirements, future expectations, and best practices are explained. The digital business model is presented to produce value-added audit findings and outputs that guide public internal auditors and all digital-era stakeholders. This book is a pioneering work based on continuous auditing/continuous monitoring approaches using various AI and blockchain-based tools and techniques. There is nothing more valuable to the success of a public internal auditor than a detailed understanding of the business. The important lesson in developing business knowledge, especially in the new audit universe emerging with digital transformation, is that all auditors must understand that they never finish learning about business processes, risks, and control points in the digital era. They must constantly push themselves to be motivated and learn about the business operations they audit to implement new audit approaches powered by AI. In addition to obtaining up-to-date business information from process owners and stakeholders, public auditors responsible for conducting an AI-based continuous audit programme should also look inside their departments for a different perspective on business information that impacts continuous audit programme phase details and has the potential to add value. It should be noted that the additional source of information begins with your individual audit experience, digital skills, and qualifications.

Book excerpt: Good Practice: What it means to put the patient first, not politics, posturing, pretentiousness, protocols or process. This is a text book for all doctors but especially GPs, Appraisers and Registrars. It is written by a 40 year plus front line NHS doctor who for most of his career worked twice to three times the current doctors’ Working Time Directive limited week. Chris Heath has been a Paediatric Lecturer in a teaching hospital, an Anaesthetist, various junior specialists and a GP for over 30 years in 3 different practices. He has been a GP Trainer and Appraiser and has seen politics and political correctness harm patients’ interests constantly over the last half of his career. From the way the NHS selects young doctors to the way they are educated and assessed, the best interests of the patient are largely ignored. This is a text book but it also contains home truths, advice, insights and original, honest guidance on being a safe, effective doctor. As well as giving an assessment of what has gone wrong with the NHS over the last 20 years, the author explains why today’s politicians, medical schools, Royal Colleges and many doctors will resist the changes essential to put the patients’ needs first again. 1 Politics, Who we are, The CQC etc 2 Administration, Training, The Consultation and Teaching 3 Basic Biology 4 Acute Medicine in General Practice 5 Alcohol 6 Allergy 7 Analgesics 8 Anticoagulants, Clotting 9 The Breast 10 Cancer and Terminal Care 11 Cardiology 12 Useful Clinical Signs, Eponymous diseases 13 Dermatology 14 Diabetes, Metabolism 15 Diet, Vitamins and Nutrition 16 Driving 17 Odd drugs 18 Ear, Nose and Throat 19 Gastroenterology 20 Geriatrics 21 Haematology 22 Hormones 23 Immunisation and Vaccines 24 Infections, Antibiotics, Microbiota 25 Legal Issues 26 Liver 27 Miscellaneous 28 Musculoskeletal, Orthopaedics, Sports, NSAIDs 29 Neurology 30 Ophthalmology 31 Paediatrics 32 Pathology 33 Pregnancy, Obstetrics and Gynaecology, Contraception 34 Psychiatry and Controlled Drugs 35 Respiratory 36 Sex and STDs 37 Sleep 38 Travel 39 Urology 40 Work References
